RESOLUTION NO. 2009-200
RESOLUTION APPROVING AND ACCEPTING QUIT CLAIM
DEED AND TEMPORARY CONSTRUCTION EASEMENT
AGREEMENT WITH BLACK HAWK COUNTY IN
CONJUNCTION WITH BOX CULVERT IMPROVEMENTS
ALONG WEST BIG ROCK ROAD BETWEEN WAGNER ROAD
AND BURTON AVENUE .
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the Quit Claim Deed and Temporary Construction Easement
Agreement dated March 9, 2009, conveying unto the City of
Waterloo, Iowa, certain real property in conjunction with box
culvert improvements along West Big Rock Road between Wagner Road
and Burton Avenue, described as follows :
Quit Claim Deed
A parcel of land situated in the Southwest 1/ and
Southeast 1/ of Section 34 , Township 90 North, Range 13
West of the 5th Principal Meridian, City of Waterloo,
County of Black Hawk, State of Iowa, more particularly
described as follows :
Commencing at the South 1/ corner of said Section 34 ;
thence North 01 (degrees) 09' (minutes) 36" (seconds)
West (assumed bearing for the purpose of this
description) on the East line of the Southwest 1/ of
said Section 34 , a distance of 33 . 00 feet to the
present North right-of-way line of Big Rock Road, being
the point of beginning; thence South 89°01 ' 42" West on
said right-of-way line, 25 . 00 feet to a line that is
25 . 00 feet West of and parallel with the East line of
the Southwest 1/ of said Section 34 ; thence North
Ol°09 ' 36" West on said line, 21 . 70 feet; thence North
64°44 ' 16" East, 27 . 39 feet to the East line of the
Southwest 1/ of said Section 34 ; thence North 89°03 ' 29"
East, 25 . 00 feet to a line that is 25 . 00 feet East of
and parallel with the West line of the Southeast 1/ of
said Section 34 ; thence South 01°09' 36" East on said
line, 32 . 98 feet to the present North right-of-way line
of Big Rock Road; thence South 89°04 ' 56" West on said
right-of-way line, 25 . 00 feet to the point of
beginning. (Containing 1, 508 square feet or 0 . 03 acre,
all in the City of Waterloo, Black Hawk County, Iowa) .
Exempt from declaration of value form under 428A. 2 (6)
of the Code of Iowa and the said Board of Supervisors
of Black Hawk County, State of Iowa releases all its
claim in and to the above described premises .
Temporary Easement

A parcel of land situated in the Southwest 1/ and
Southeast 1/ of Section 34 , Township 90 North, Range 13

County of Black Hawk, State of Iowa, more particularly
described as follows :
