RESOLUTION NO. 2009-299
RESOLUTION MAKING ASSESSMENT FOR REPAIRING
THE SERVICE LINE AND PREVENTION OF FURTHER
DAMAGE AT 141 NEWELL STREET.
WHEREAS, the Board of Water Works Trustees of the City of
Waterloo, Iowa, did, as provided by law, notify by written notice
the property owner of the premises known as 141 Newell Street to
have the service line repaired and further damage prevented, and
WHEREAS, the property owner failed to comply with the order
of the Board of Water Works Trustees, as by law provided, and
WHEREAS, the Board of Water Works Trustees proceeded to have
the work done on the premises described as 141 Newell Street, in
the City of Waterloo, Iowa, to comply with Ordinance No . 1118 of
the City of Waterloo, Iowa, and
WHEREAS, the Board of Water Works Trustees filed with the
City Clerk on the 19th day of March, 2009 , a report filing claim
for the repairing of the service line and preventing further
damage at above described premises and same met all the
requirements of the City ordinance and have been fully completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the said report of the Board of Water Works
Trustees be, and the same is hereby, approved; that the work was
done under and by virtue hereby, accepted, and that the cost of
said work is hereby determined to be as follows, which amount can
be assessed over a ten-year period against the property:

Legal Description:
East Thirty-two and one-half (32;x) feet of the West
Sixty-five (65) feet of Lot Number One (1) and the East
Thirty-two and one-half (32;x) feet of the West Sixty-
five (65) feet of the South Twenty-five (25) feet of
Lot No . Two (2) , all in Block No . One (1) in Ricker and
Bratnober' s Addition to the City of Waterloo, Iowa, and
the West Thirty-two and One-half (32 . 5) feet of Lots
Nos . One (1) and Two (2) in Block No. One (1) , in
Ricker and Bratnober' s Addition to Waterloo, Iowa,
Black Hawk County.
Unpaid Assessment : $2 , 800 . 00
BE IT FURTHER RESOLVED that there be, and are hereby
assessed and levied a special tax and assessment against the
property improved, described as 141 Newell Street in the City of
Waterloo, Iowa, the amount of $2 , 800 . 00, said assessment shall
bear interest from the date of levy of the assessment, viz :
April 6, 2009 , at the rate of nine (9) percent per annum until
paid on all the unpaid amount of this assessment certified to the
County Treasurer of Black Hawk County, Iowa, and

n o BE IT FURTHER RESOLVED that the City Clerk be, and she is
4-aereby instructed to notify J. Charles Gary, of said property,
00 gtordingly and also instructed to certify said assessment to the
2 r ipunty Treasurer of Black Hawk County, Iowa, to be entered upon
tax list to be collected as other taxes, as provided by law,
o d when collected to be credited to the Water Works Fund of said
s amity, and assessment to be made over a ten-year period.
