WHEREAS, Spicoli' s Grill, 3555 University Avenue, is
raquesting a variance to the Noise Ordinance on May 22, 2009 from
9) 4 :,00 to 8 : 00 p.m. and on May 23 and 24 , 2009 from 4 : 00 p.m. to
1100 p.m. in conjunction with a band playing in their beer
1-0 garden, and
co WHEREAS, said event will exceed the limits of the Noise
Ordnance, Ordinance No. 3094 , and

-‹ WHEREAS, said Spicoli' s Grill, 3555 University Avenue, has
,pe formal application for a variance on May 22, 2009 from 4 : 00
bY 8 : 00 p.m. and on May 23 and 24 , 2009 from 4 : 00 p .m. to 11 : 00
p.m.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the request of Spicoli' s Grill, 3555
University Avenue, for a variance to Ordinance No . 3094 , Noise
Ordinance, on May 22 , 2009 from 4 : 00 to 8 : 00 p.m. and on May 23
and 24 , 2009 from 4 : 00 p.m. to 11 : 00 p.m. in conjunction with a
band playing in their beer garden, be and the same hereby granted.
PASSED AND ADOPTED this 13th day of April, 2009 .
