HomeMy WebLinkAbout3981-11/08/1993ORDINANCE NO. 3981 ORDINANCE AMENDING ORDINANCE NO. 2479, AS AMENDED, BY ADDING SUBSECTION NO. 50 TO SECTION 2A -7N, CONDITIONAL REZONING CERTAIN PROPERTY. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That Section 2A -7N, of Ordinance No. 2479, as amended, be further amended by adding after Subsection No. 49, of said Section, the following Subsection No. Fifty (50). "50. from "A -i" Agricultural District to "R-2" One and Two Family Residence District/""C-Z" Conditional Zoning, legally described as follows: Parcel 1 That part of the Southeast Quarter of the Southwest Quarter of Section No. 33, Township No. 89 North, Range No. 13 West of the Fifth Principal Meridian, in the City of Waterloo, Black Hawk County, Iowa, described as follows: Commencing at the Southeast corner of said Southeast Quarter of the Southwest Quarter; thence North 90 degrees West along the South line of said Southeast Quarter of the Southwest Quarter 696.31 feet (Record 695.82 feet); thence North 1 degree 40 minutes 30 seconds West 50.02 feet to a point on the North line of Ridgeway Avenue; thence West along said North line 88 feet to the point of beginning; thence West along said North line 88 feet; thence North 1 degree 40 minutes 30 seconds West 400 feet; thence North 90 degrees East 88 feet, thence South 1 degree 40 minutes 30 seconds East 400 feet to the point of beginning. Parcel 2 That part of the Southeast Quarter of the Southwest Quarter of Section No. 33, Township No. 89 North, Range No. 13 West of the Fifth Principal Meridian, in the City of Waterloo, Black Hawk County, Iowa, described as follows: Commencing at the Southeast corner of said Southeast Quarter of the Southwest Quarter; thence North 90 degrees West along the South line of said Southeast Quarter of the Southwest Quarter 696.31 feet (Record 695.82 feet); thence North 1 degree 40 minutes 30 seconds West 50.02 feet to a point on the North line of Ridgeway Avenue, said point being the point of beginning; thence North 1 degree 40 minutes 30 seconds West 1276.86 feet to a point on the North line of said Southeast Quarter of the Southwest Quarter which is 19.53 feet East of the Southwest corner of Lot No. 9 in Jane Second Addition; thence North 89 degrees 50 minutes 15 seconds West along said North line 388.73 feet to the Southeasterly line of U.S. Highway 63; thence South 36 degrees 04 minutes 30 seconds West along said Southeasterly line 359.06 feet to the West line of said Southeast Quarter of the Southwest Quarter; thence South 89 degrees 50 minutes 15 seconds East 432.65 feet; thence South i degree 40 minutes 30 seconds East 586.40 feet; thence North 90 degrees East 88.00 feet; thence South 1 degree 40 minutes 30 seconds East 400.00 feet to the North line of Ridgeway Avenue; thence North 90 degrees East along said North line 88.00 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa; and to rezone from "R-2" One and Two Family Residence District to "C -Z" Conditional Zoning, legally described as follows: Parcel 3 That part of said parcel described as follows: Commencing at a point North of the Southeast corner of the Southwest Quarter t"5,.+'1J PAGE 266 Ordinance No. 3981 Page 2 a distance of 33 feet; thence North 90 degrees West 695.82 feet along the North right-of-way line of West Ridgeway Avenue; thence North 1 degree 40 minutes 30 seconds West 993.86 feet as the point of beginning; thence continuing North along said line a distance of 300 feet to the South line of Lot No. 9 Jane Second Addition, at a point which is 19.53 feet East of the Southwest corner of said lot; thence South 89 degrees 51 minutes 10 seconds East along the South line of said Jane Second Addition and Jane Addition 715.25 feet to the East line of said Southwest Quarter; thence South 0 degrees 49 minutes 20 seconds East 300 feet along said East line; thence West along a line lying 300 feet South of and parallel to the South line of Jane Second Addition and Jane Addition to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa; and to rezone from "R-3" Multiple Family Residence District to "C -Z" Conditional Zoning, legally described as follows: Parcel 4 The South Five Hundred Eighty-eight (588) feet of the North Seven Hundred Sixty-two (762) feet of the West Two Hundred Twenty-two (222) feet of the Southwest Quarter (SW 1/4) of the Southeast Quarter (SE 1/4) of Section Thirty-three (33), Township Eighty-nine North (T89N), Range Thirteen West (R13W) of the Fifth Principal Meridian, all in the City of Waterloo, Black Hawk County, Iowa, now zoned on the Zoning Map of Waterloo, Iowa, as "A-1" Agricultural District, "R-2" One and Two Family Residence District and "R-3" Multiple Family Residence District be and the same is hereby zoned as "C -Z" Conditional Zoning, as above described." Section 2. That the Acting Clerk/Auditor be, and she is hereby directed to file a certified copy of this Ordinance with the Recorder of Black Hawk County, Iowa.
