ORDINANCE NO. 3984
AN ORDINANCE AMENDING THE 1988 CODE OF
ORDINANCES OF THE CITY OF WATERLOO, IOWA, BY
REPEALING SUBSECTIONS 7-33, LICENSE FEE, 7-49,
REDEMPTION OF IMPOUNDED DOGS OR CATS OR OTHER
ANIMALS, 7-52, CONFINEMENT, AND 7-55, NOISY,
ANNOYING ANIMALS OF CHAPTER 7, ANIMALS AND
FOWL; AND ENACTING IN LIEU THEREOF NEW
SUBSECTIONS 7-33, LICENSE FEE, 7-49,
REDEMPTION OF IMPOUNDED DOGS OR CATS OR OTHER
ANIMALS, 7-52, CONFINEMENT, AND 7-55, NOISY,
ANNOYING ANIMALS OF CHAPTER 7, ANIMALS AND
FOWL.
BE IT ORDAINED by the City Council of the City of Waterloo,
That Subsections 7-33, License Fee, 7-49, Redemption of Impounded
Dogs or Cats or Other Animals, 7-52, Confinement, and 7-55, Noisy,
Annoying Animals of Chapter 7, Animals and Fowl, of the 1988 Code
of Ordinances of the City of Waterloo, Iowa, are hereby repealed in
their entirety; that new Subsections 7-33, License Fee, 7-49,
Redemption of Impounded Dogs or Cats or Other Animals, 7-52,
Confinement, and 7-55, Noisy, Annoying Animals of Chapter 7,
Animals and Fowl, of the 1988 Code of Ordinances of the City of
Waterloo, Iowa, are hereby enacted in lieu thereof as follows:
Sec. 7-33. License fee.
(a) The annual license fee shall be five dollars ($5.00) for
each altered dog or cat. The annual license fee shall be ten
dollars ($10.00) for each unaltered dog or cat. After March 31st
of each year, there shall be a penalty of five dollars ($5.00) and
ten dollars ($10.00) respectively.
(b) Any dog or cat altered before November 8, 1993, shall be
entitled to a free license for a period of three (3) years from the
date of alteration. As of January 1, 1996, there shall be no free
licenses.
(c) Duplicate licenses shall be issued at a cost of two
dollars ($2.00).
(d) The city license fee shall be waived for all dogs or cats
if the owner of said dogs or cats has a valid state pet shop
license, state boarding kennel operator's license, state commercial
kennel license, state hobby kennel license, state commercial
breeder's license, or state dealer's license for said dogs or cats.
(e) The owner of all dogs or cats six (6) months old or older
must comply with all code provisions of this article including the
obtaining of rabies vaccination and license tag even though the
license fee has been waived. A written certificate from a licensed
veterinarian shall be required to prove that a dog or cat is
incapable of breeding and has been vaccinated for rabies.
Sec. 7-49. Redemption of impounded dogs or cats or other animals.
(a) Any dog or cat or other animal restrained or impounded in
accordance with provisions of this article may be redeemed by the
owner of such animal by payment of costs of impoundment. The costs
of impoundment shall include all feed and boarding fees, which
shall be paid to the humane society. In addition to the costs of
impoundment, the owner shall pay to the City Clerk a pickup fee of
fifteen dollars ($15.00) for the first pickup which occurs in a
calendar year. All such pickup fees shall be paid within four (4)
days of picking up the animal pursuant to a signed agreement. The
pickup fee shall increase ten dollars ($10.00) for each additional
pickup fee within the calendar year [i.e., second pickup fee is
twenty-five dollars ($25.00), third pickup fee is thirty-five
dollars ($35.00), etc.]. Failure to pay any pickup fee shall

result in a citation being issued to the owner. Said citation
shall be punishable as provided in section 7-63.
(b) If such dog, cat or other animal restrained or impounded
is unlicensed, the humane society shall keep said animal for a
period of five (5) days. Within said five (5) days the owner of
said dog or cat or other animal may redeem said animal by signing
an agreement to have said dog or cat or other animal vaccinated
pursuant to section 7-35 and licensed pursuant to section 7-30 of
this chapter and by paying the cost of impoundment and a daily
boarding fee to the humane society.
Sec. 7-52. Confinement.
When a member of the health department, police department or
humane officer receives information that any person has been bitten
by an animal, or that a dog, cat or other animal is suspected of
having rabies, the official shall order the owner to confine such
animal in the manner and place the official directs. If the owner
fails to confine such animal in the manner directed, the animal
shall be apprehended and impounded by such official, and after ten
(10) days the animal may be humanely destroyed. If such animal is
returned to its owner, the owner shall pay the cost of impoundment,
which shall include a pickup fee and daily boarding fee.
Sec. 7-55. Noisy, annoying animals.
(a) It shall be unlawful for the owner of a dog, cat or other
animal to permit or allow said dog, cat or other animal to cause
serious annoyance or disturbance to a person or persons by frequent
and habitual howling, whining, yelping, barking or vocal emittance
to the annoyance of others.
(b) After the first written warning, three (3) adjoining
neighbors must sign a citation. If the owner pleads not guilty,
the neighbors will be required to appear in court to testify.
(c) Proof of ownership of a dog, cat or other animal shall
constitute in evidence a prima facie presumption of permission of
the owner in any proceedings charging any violation of this
section.
