RESOLUTION NO. 2009-377
RESOLUTION GRANTING PERMISSION TO JOHN
BRUNSON FOR A WAIVER FOR A CONCRETE DRIVEWAY
TO BE LOCATED AT 205 JOY DRIVE, AND
AUTHORIZING CONSTRUCTION OF A CONCRETE
DRIVEWAY WITH ELIMINATION OF THE SIDEWALK
SECTION DUE TO THE INABILITY TO MEET
REQUIREMENTS OF THE DRIVEWAY AND SIDEWALK
POLICY, PARAGRAPH 1 .
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
WHEREAS, the City Engineer has made written application to
the City Council asking that John Brunson be authorized and
permitted to construct a concrete driveway with elimination of
the sidewalk section due to the inability to meet requirements of
the driveway and sidewalk policy, paragraph 1 to be located at
205 Joy Drive, and legally described as follows :
Clyde Miller Heights Second Subdivision Castle Hill all
Lot 8 & that part of Lot 9 lying within the following
described as beginning at the Southwest corner of Lot 8
Clyde Miller Heights Second Subdivision, thence
Southeasterly along the Northeasterly line of Joy Drive
37 . 14 feet to a point 30 feet Easterly measured at
right angle of the Southerly extension of the Westerly
line of Lot 8, thence deflecting left 125 Degrees 57
Minutes 25 Seconds on a line parallel with the Westerly
line Lot 8 98 . 84 feet to a point on a line between the
Southeasterly corner of Lot 9 of Clyde Miller Heights
Second Subdivision and angle point in a Westerly line
of said Lot 9, thence deflecting left 70 Degrees 47
Minutes 15 Seconds 31 . 76 feet to said angle point,
thence deflecting left 109 Degrees 12 Minutes 45
Seconds along the Westerly line of Lots 9 & 8 87 . 54
feet to point of beginning and also that part of Lot 9
lying Southerly of the following described parcel
beginning at the Southeasterly corner of Lot 9, thence
Northwesterly along the Northwesterly extension of the
Northeast line of Lot 7 of Clyde Miller Heights Second
Subdivision 75 . 29 feet to a point 30 feet Southeasterly
from the Northwesterly line of said Lot 9, thence
deflecting left 109 Degrees 44 Minutes on a line
parallel to said Northwesterly line 15 . 91 feet, thence
deflecting left 16 Degrees 13 Minutes 20 Seconds on a
line parallel with Southwesterly line of Lot 8 of Clyde
Miller Heights Second Subdivision 6 . 15 feet, thence
deflecting left 70 Degrees 47 Minutes 15 Seconds 69 . 24
feet to point of beginning, all in the City of
Waterloo, Black Hawk County, Iowa;
and
WHEREAS, it is the sense of the Council of the City of
Waterloo, Iowa, that said request should be granted.
NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is
hereby granted to John Brunson to construct a concrete driveway
with elimination of the sidewalk section due to the inability to
meet requirements of the driveway and sidewalk policy, paragraph
1 to be located at 205 Joy Drive, subject to the following
conditions :

1 . Work to be performed by an approved and bonded
contractor.
2 . A permit is to be obtained from the office of the City
Engineer prior to construction.
3 . All work shall be performed under the supervision of
the City Engineer and at no cost to the City of
Waterloo.
BE IT FURTHER RESOLVED that the City Clerk is authorized and
directed to forward a certified copy of this resolution to the
Black Hawk County Recorder for recording and the Black Hawk
County Auditor for filing in order that this said action may
become a matter of official County Record.
