RESOLUTION NO. 2009-387 RESOLUTION APPROVING THE APPLICATION TO THE IOWA DEPARTMENT OF ECONOMIC DEVELOPMENT REQUESTING RECERTIFICATION AND EXPANSION OF AN ENTERPRISE ZONE IN THE CITY OF WATERLOO AND PROVIDING FOR THE EXEMPTION FROM TAXATION OF THE IMPROVEMENTS MADE BY BUSINESSES WITHIN THE ZONE. WHEREAS, the City of Waterloo (hereinafter referred to as the "City" ) , State of Iowa, is a political subdivision organized and existing under the law and the Constitution of the State of Iowa (the "State" ) ; and WHEREAS, the purpose of 1997 Iowa Acts, House File 724 (the "Act" ) is to encourage mutual development objectives between communities and private business and to promote economic investment in enterprise zones within the State; and WHEREAS, the Act and administrative rules adopted by the Iowa Department of Economic Development require the City to approve, by resolution, the establishment of an enterprise zone and the submission of a request for certification to the Iowa Department of Economic Board; and WHEREAS, under the Act, one of the benefits provided to eligible businesses locating within a certified enterprise zone is a City exemption from taxation of all, or a portion, of the actual value added by improvements to real property that is : 1) directly related to new jobs created by the location or expansion of an eligible business in the zone, and 2) used in the operation of an eligible business within the zone; and WHEREAS, it is the intention of the City of exempt from location taxation all or a portion of the assessed real estate value added by improvements to the property, beginning the first year the improvements are assessed for taxation in the enterprise zone . NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows : Section 1 . The City certifies that it is an eligible participant under the Act and meets the following distress criteria required under Section 4 of the Act : a) The area has a per capita income of $12, 648 or less based on the 2000 Census . b) The area has a family poverty rate of 12 percent or higher based on the 2000 Census . c) Ten percent or more of the housing units are vacant in the area. Resolution No. 2009-387 Page 2 d) The valuations of each class of property in the designated area is 75 percent or less of the citywide average for that classification based upon the most recent valuations for property tax purposes . e) The area is a blighted area, as defined in Iowa Code Section 403 . 17 . Section 2 . The City hereby requests enterprise zone certification from the Iowa Department of Economic Development Board as authorized in Section 2 of the Act for the following designated site of 14 . 96 square miles or 9575 . 8 acres, which the City certifies is less than 1 percent of the county area for the purposes of receiving the benefits under the Act . The legal description of the enterprise zone area to be certified is : Waterloo Enterprise Zone, being those portions of land located in Township 89 North, Range 12 West, and Townships 88 and 89 North, Range 13 West of the Fifth Principal Meridian, in the City of Waterloo, Black Hawk County, Iowa, and being more particularly described as follows : Beginning at the Northwest corner of Section 10, Township 89 North, Range 13 West (locally known as the intersection of Wagner Road and West Airline Highway) ; thence East along the North line of Sections 10 & 11, Township 89 North, Range 13 West (West Airline Highway) to the Northeast corner of said Section 11 (locally known as the intersection of Airline Highway and Logan Avenue) ; thence South along the East line of Sections 11 and 14 , Township 89 North, Range 13 West (Logan Avenue) to the centerline of the Canadian National Railroad; thence East along the centerline of said railroad to the centerline of East 4th Street; thence North along the centerline of East 4th Street to the centerline of East Louise Street; thence East along the centerline of East Louise Street to the platted centerline of Mildred Street; thence North along the platted centerline of Mildred Street to the North line of Section 13 , Township 89 North, Range 13 West (East Donald Street) ; thence East along said North line (East Donald Street) to the Northeast corner of said Section 13 ; thence East along the North line of Section 18 , Township 89 North, Range 12 West (East Donald Street) to the centerline of Idaho Street; thence South along the centerline of Idaho Street to the North line of Section 19, Township 89 North, Range 12 West (locally known as the intersection of Idaho Street and Newell Street) ; thence East along the North lines of Sections 19, 20 and 21, Township 89 North, Range 12 West (Newell Street) to the Northeast corner of the Section 21, Township 89 North, Range 12 West (locally known as the intersection of Newell Street and North Elk Run Road) ; thence South along the East line of said Section 21 (North Elk Run Road) to its intersection with the Northerly right-of-way of the Union Pacific Railroad; thence Southwesterly following said Northerly Railroad line to the West line of the Northeast 'A of the Northeast 'A of said Section 21; thence South along said East line of Government Lot 1 to the Easterly line of the Cedar River; thence Southerly following the Easterly line of the Cedar River to its intersection with the centerline of US Highway 20, (as now established) ; thence Westerly along the centerline of said US Highway 20 to the West line of Section 11, Township 88 North, Range 13 West (Hammond Avenue) ; thence North along the West lines of Sections 11 & 2 , Township 88 North, Range 13 West (Hammond Avenue) to the Northwest corner of said Section 2 (locally known as the intersection of Hammond Avenue and East Ridgeway Avenue) ; thence East along the North line of said Section 2 to its intersection with the centerline of LaPorte Road; thence North along said centerline of LaPorte Road to its intersection with the centerline of the Southeasterly bound lanes of Washington Street; thence Northwesterly along said centerline to its intersection with the North line of Section 36, Township 89 North, Range 13 West; thence West along the North lines of Sections 36 & 35, Township 89 North, Range 13 West (Williston Avenue) to its intersection with the centerline of West 8th Street; thence North and Northeasterly along the centerline of West 8th Street to the centerline of Randolph Street; thence Northwesterly along the centerline of Randolph Street and the extension thereof to the Northwesterly right- of-way line of West 4th Street; thence Southwesterly along the Northwesterly line of West 4th Street, and its extensions, to its intersection with the extended Resolution No. 2009-387 Page 4 West right-of-way of Sullivan Avenue; thence North following the West line of Sullivan Ave . to the Northerly most corner of Lot 3 Block 1 Summit Addition, (said point also being a point on the South line of Elmwood Cemetery property) ; thence Westerly following the Northerly line of Summit Addition to the East line of Marsh Street; thence Northwesterly across Marsh Street Right-of-Way to a point on the West line of Marsh Street that is on the North line of Prospect Heights Addition; thence Northwesterly following the North boundary of Prospect Heights Addition to the centerline of Chicago St; thence South along the centerline of Chicago Street to the centerline of Summit Avenue; thence West along the centerline of Summit Avenue and its extension thereof, to the centerline of Fletcher Avenue; thence North along the centerline of Fletcher Avenue to the Northerly line of the former Chicago and Great Western Railway right-of- way; thence Northeasterly along said Northerly Railroad right-of-way line and its extension to the centerline of University Avenue; thence Easterly along the centerline of University Avenue to the centerline of Mullan Avenue, as platted; thence Northeasterly along the centerline of Mullan Avenue (as platted) to the centerline of the main channel of the Cedar River; thence Northwesterly along the centerline of the main channel of the Cedar River to the centerline of relocated Conger Street; thence Easterly along the centerline of relocated Conger Street to its intersection with the centerline of Burton Avenue; thence South along the centerline of Burton Avenue to the centerline of the Canadian National Railroad spur line; thence following said railroad spur line Easterly, Northeasterly, Northerly, and Northwesterly to its intersection with the centerline of the Canadian National Railroad mainline (said intersection lying Northeasterly of the Broadway Street Right-of-Way) ; thence Northwesterly following said Railroad mainline centerline to its intersection with the West line of Section 10, Township 89 North, Range 13 West (Wagner Road) ; thence North along the said West line (Wagner Road) to the Northwest corner of said Section 10 and the Point of Beginning. A detailed map of the area described above is identified in Exhibit "B" to this Resolution. Section 3 . The City exempts from taxation One Dollar ($1 . 00) . Section 4 . The City shall provide a copy of this resolution to the Iowa Department of Economic Development and shall file this resolution with the Black Hawk County Assessor. Section 5 . The following officers of the City are hereby authorized to take such further actions as are deemed necessary in order to carry into effect the provisions of this resolution: Tim Hurley, Mayor, and Nancy Eckert, City Clerk. Section 6 . All resolutions and parts thereof in conflict herewith are hereby repealed to the extent of such conflict . Resolution No. 2009-387 Page 5 Section 7 . The provisions of this resolution are hereby declared to be severable; and if any section, phrase, or provision shall for any reason be declared to be invalid, such declaration shall not effect the validity of the remainder of the sections, phrases, and provisions hereof . Section 8 . This resolution shall become effective immediately upon its passage and approval .
