HomeMy WebLinkAbout3725-07/02/1990ORDINANCE NO. 3725 AN ORDINANCE AMENDING THE 1988 CODE OF ORDINANCES OF THE CITY OF WATERLOO, IOWA, BY REPEALING SUBSECTION 14-59, FEES ESTABLISHED, OF ARTICLE III, FIRE PREVENTION INSPECTIONS, OF CHAPTER 14, FIRE PREVENTION AND PROTECTION; AND ENACTING IN LIEU THEREOF A NEW SUBSECTION 14-59, FEES, OR ARTICLE III, FIRE PREVENTION INSPECTIONS, OF CHAPTER 14, FIRE PREVENTION AND PROTECTION. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: That Subsection 14-59, Fees Established, and of Article III, Fire Prevention Inspections, of Chapter 14, Fire Prevention and Protection, of the 1988 Code of Ordinances of the City of Waterloo, Iowa, are hereby repealed in their entirety; that new Subsection 14-59, Fees, of Article III, Fire Prevention Inspections, of Chapter 14, Fire Prevention and Protection, of the 1988 Code of Ordinances of the City of Waterloo, Iowa, are hereby enacted in lieu thereof as follows: SEC. 14.59. LIFE SAFETY INSPECTIONS The purpose of this code is to provide minimum standards to safeguard life or limb, health, property and public welfare by regulating and controlling the design, construction, quality of materials, use and occupancy, location and maintenance of all non-residential buildings and structures within this jurisdiction and certain equipment specifically regulated by Uniform Building Code. New construction application for permit shall comply with the Uniform Building Code. SEC. 14.60. ANNUAL LIFE SAFETY PERMITS, LICENSES, AND CERTIFICATION FEES The following fees shall be established for the permits, licenses, certificates, approvals, life safety inspections and other functions performed under this Code and shall be payable to the City of Waterloo. Such fees shall accompany 'each application for such permit, approval, certificate, or other fee -related Code provisions. (1) ANNUAL FEE SCHEDULE FOR LIFE SAFETY INSPECTION* A sliding fee schedule will be developed according to square footage of the building, which will also be classified by the relative hazard of the occupancy, i.e. low hazard (LH), ordinary hazard (OH), or high hazard (HH). Low hazard occupancies shall be as defined in Division 4 of Section 701, Uniform Building Code. Ordinary hazard occupancies shall be as defined in Division 1, 2 and 3 of Section 701, Uniform Building Code. High hazard occupancies shall be as defined in Section 901 of the Uniform Building Code. *Non-residential businesses who install a certified sprinkler system will be exempt from the Annual Life Safety Inspection Fee for three (3) years after the installation of the sprinkler system. (2) ANNUAL FEE SCHEDULE FOR ADDITIONAL HAZARDS BASED ON THE UNIFORM BUILDING CODE OCCUPANCY DEFINITION. UNIFORM BUILDING CODE CLASSIFICATION OF ALL BUILDINGS BY USE OR OCCUPANCY AND GENERAL REQUIREMENTS FOR ALL OCCUPANCIES: Group A Occupancies Defined Sec. 601. Group A Occupancies shall be: Annual Fee Division 1. Any assembly building with a stage and an occupant load of 1000 or more in the building. $20.00 Division 2. Any building or portion of a building having an assembly room with an occupant load of less than 1000 and a stage. $20.00 Division 2.1 Any building or portion of a building having an assembly room with an occupant load of 300 or more without a stage, including such buildings used for educational purposes and not classed as a Group E or Group B, Division 2 Occupancy. $15.00 Division 3. Any building or portion of a building having an assembly room with an occupant load of less than 300 without a stage, including such buildings used for educational purposes and not classed as a Group E or Group B, Division 2 Occupancy. $10.00 Division 4. , Stadiums, reviewing stands and amusement park structures not included within other Group A Occupancies. Specific and general requirements for grandstands, bleachers and reviewing stands are to be found in Chapter 33 of the U.B.C. Code. $ 5.00 Group B Occupancies Defined Sec. 601. Group B Occupancies shall be: Division 1. Division 2. Annual Fee Gasoline service stations, garages where no repair work is done except exchange of parts and maintenance requiring no open flame, welding or used of Class I, II or III -A liquids. $ 5.00 Drinking and dining establishments having an occupant load of less than 50, wholesale and retail stores, office buildings, printing plants, municipal police and fire stations, factories and workshops using materials not highly flammable or combustible, storage and sales rooms for combustible goods, paint stores without bulk handling. (See Section 402 of the U.B.C. Code for definition of assembly buildings.) $10.00 BOOK 291 PAGE 9U1 Ordinance No. 3725 Page 3 Division 3. Annual Fee Buildings or portions of buildings having rooms used for educational purposes beyond the 12th grade with less than 50 occupants in any room. $10.00 Aircraft hangars where no repair work is done except exchange of parts and main- tenance requiring no open flame, welding or the used of Class I or II liquids. Open parking garages. Heliports. Division 4. Ice plants, power plants, pumping plants, cold storage and creameries. $10.00 $ 5.00 $80.00 $10.00 Factories and workshops using noncombus- tible and nonexplosive materials. $10.00 Storage and sales rooms containing only noncombustible and nonexplosive materials that are not packaged or crated in or supported by combustible material. Group E Occupancies Defined Sec. 801. Group E Occupancies shall be: Division 1. Division 2. Division 3. $10.00 Annual Fee Any building used for educational purposes through the 12th grade by 50 or more persons for more than 12 hours per week or four hours in any one day. Any building used for educational purposes through the 12th grade by less than 50 persons for more than 12 hours per week or four hours in any one day. $20.00 $10.00 Any building used for day-care purposes for more than six children. $10.00 Group H Occupancies Defined Sec. 901. (a) General. Group H Occupancies shall be: Division 1. Division 2. Annual Fee Storage, handling, use or sale of hazardous and highly flammable or explosive materials other than Class I, II or III -A liquids. $30.00 EXCEPTION: The storage, handling, use or sale of hazardous materials or chemicals that do not exceed the quantities listed in Table No. 9-A of the U.B.C. Code are permitted in other occupancies, provided the storage, handling, use or sale of such hazardous materials or chemical is in compliance with the Fire Code. Storage, handling, use or sale of Classes I, II and III -A liquids, dry cleaning plants using Class I, II or III -A liquids; paint stores with bulk handling; paint shops and spray -painting rooms and shops. $30.00 BOOK ?,91. PAGE. U Ordinance No. 3725 Page 4 EXCEPTION: The storage, handling, use or sale of liquids in quantities that do not exceed those set forth in Table No. 9-A of the U.B.C. Code are permitted in other occupancies, provided the storage, handling, use or sale is in compliance with the Fire Code. Division 3. Woodworking establishments, planing mills, box factories, buffing rooms for tire - rebuilding plants and picking rooms; shops, factories or warehouses where loose combustible fibers or dust are manufactured, processed, generated or stored; and pin -refinishing rooms. $20.00 Division 4. Repair garages not classified as a Group B, Division 1. $10.00 Division 5. Aircraft repair hangars. $10.00 Division 6. Semiconductor fabrication facilities and comparable research and development areas when the facilities in which hazardous production materials are used, are designed and constructed in accordance with Section 911 of the U.B.C. Code and when storage, handling and use of hazardous materials is in accordance with the Fire Code. $30.00 EXCEPTION: The specified uses need not be classified as a Group H, Division 6 Occupancy when the quantities of hazardous materials do not exceed those listed in Table No. 9-A of the U.B.C, Code, provided the storage, handling and use are in compliance with the Fire Code (b) Special Provisions. In buildings used for educational purposes, vocational shops, laboratories and similar areas need not be classified as Group H Occupancies, provided: 1. Such areas are separated from classrooms other than the classroom directly related to the use by not less than a one-hour fire -resistive occupancy separation. 2. Such areas are separated from each other by not less than a one-hour fire -resistive occupancy separation unless the uses are determined to be compatible. 3. The requirements of Sections 905, 908, 910 and the Fire Code shall be met when applicable. Group I Occupancies Defined Sec. 1001. Group I Occupancies shall be: Division 1. Division 2. Nurseries for the full-time care of children under the age of six (each accommodating more than five persons. Hospitals, sanitariums, nursing homes with nonambulatory patients and similar buildings each accommodating more than five persons. Nursing homes for ambulatory patients, homes for children six years of age or Annual Fee $10.00 BOOK 291 PACE. 903 Ordinance No. 3725 Page 5 Division 3. over (each accommodating more than five persons). $10.00 Mental hospitals, mental sanitariums, jails, prisons, reformatories and buildings when personal liberties of inmates are similarly restrained. EXCEPTION: Group I Occupancies shall not include buildings used only for private residential purposes for a family group. Group R Occupancies Defined Sec. 1201. Group R Occupancies shall be: Division 1. $20.00 Annual Fee Hotels and apartment houses. $20.00 Convents and monasteries (each accommodating more than 10 persons). Division 2. Not used. Division 3. Dwellings and lodging houses. $ 5.00 SEC. 14.61. EXPLOSIVES, AMMUNITION AND BLASTING AGENTS (a) PERMIT REQUIRED FEE - Manufacture, possess, store, sell or otherwise dispose of explosives, blasting agents or small arms ammunition. $25.00 -Operate a terminal $25.00 - Blasting: Blasting fees are for the use, handling and storage of explosives used primarily for construction or demolition Each site 1 - 30 days Each additional 30 days or fraction thereof FEE $150.00 $ 50.00 Note: No permit shall be valid for a period longer than 90 days. (b) CERTIFICATE OF FITNESS, FEES - Certificate of Fitness - New Blasting/Transportation Transportation only (c) CERTIFICATE OF FITNESS, RENEWAL -Certificate of Fitness Renewal Blasting/Transportation Transportation only FEE $25.00 $10.00 FEE $10.00 $10.00 SEC. 14.62 FIREWORKS (a) POSSESS, STORE, MANUFACTURE, SALE AND DISCHARGE OF FIREWORKS FEE - Certificate of Fitness - New $25.00 - Certificate of Fitness - Renewal $10.00 - Fireworks and Pyrotechnics: This includes the public display of fireworks and the use of pyrotechnic devices for stage shows, theater and other public displays. SEC. 14.63. FLAMMABLE AND COMBUSTIBLE LIQUIDS (a) PERMIT REQUIRED - Storage, Handling or Use, Class I - Storage, Handling or Use, Class II or IIIA - Manufacturing, processing, blending or refining -Storage in Stationary Tanks - Construct, Reconstruct, Alter Service Stations -Defuel - Slurry Fill - Abandon FEE $ 25.00 $ 25.00 $ 25.00 $ 25.00 $ 25.00 $ 25.00 $ 25.00 $ 25.00 -Flammable/Combustible Liquid Tank: Installation: This shall include all flammable/combustible liquid tanks installed above or below ground and required piping, valves and dispensing equipment. This shall include, but not be limited to, gasoline, diesel, oil, waste oil and other flammable and combustible liquids. Tanks FEE Each Tank $200.00 -Flammable/Combustible Liquid Tank: Modification: This shall include all flammable/combustible liquid tanks and required piping, valves and dispensing equipment. Tanks may be of the aboveground or belowground type. Modification shall include reconstruction, tapping, tank cutting, vent pipe relocations, dispenser piping, repiping and tank repair of repiping. Modification As described above Note: If the valuation of work performed exceeds of the replacement cost of the system the fees installation shall apply. FEE $ 50.00 50 percent for a new -Underground Tank Removal This shall apply to the removal of flammable or combustible liquid tanks in accordance with regulation 16-B of the Waterloo Fire Code. Removal Single Tank Multiple Tanks First Each Additional Tank FEE $150.00 $150.00 $ 25.00 BOOK 2,91 PAGE, 9 05 Ordinance No. 3725 Page 7 Note: No additional fee shall be charged for pump out when the pump out and tank removal work is performed concurrently. -Cargo Tankers: All flammable/combustible liquid and LPG cargo tankers which operate in the City of Waterloo are required to obtain a cargo tanker permit. The cargo tanker permit is required to be obtained annually, after major repairs and after construction of a new vehicle. -Inspections at Waterloo Fire Rescue Department Inspection Site: Cargo Tankers FEE Single Truck $ 50.00 Single Trailer $ 50.00 Truck with Pup Trailer $ 50.00 Tractor with Two Trailers $ 50.00 Note: This fee schedule shall apply to inspections conducted at the Waterloo Fire Rescue Department Inspection Site during regularly scheduled inspection hours. This fee schedule shall also apply to inspections by appointment which are conducted at the Waterloo Fire Rescue Department Inspection Site, other than during regularly scheduled inspection hours, if the appointment is made 10 calendar days prior to the inspection. -Inspections at a Site Other Than the Waterloo Fire Rescue Department Inspection Site Cargo Tankers Single Truck Single Trailer Truck with Pup Trailer Tractor with Two Trailers Business Hours $ 75.00 $ 75.00 $ 75.00 $ 75.00 After Regular Business Hours, Weekends, and Holidays $125.00 $125.00 $125.00 $125.00 Persons driving flammable or combustible liquid cargo carriers not displaying a permit shall be furnished written notice of the permit required by the Fire Chief or his designee. The cargo carrier in violation shall be impounded until it complies with the Fire Code and all fees are paid in accordance with the following. HAUNTED HOUSE -Haunted House: This includes any area, room or structures used at a carnival, party or similar event for the purpose of creating a maze to amuse, confuse or frighten participants. (a) Permit Required. It shall be unlawful for any person or organization to set up or cause to be set up a structure to be used as a place of amusement as a haunted house or any other type of comparable inside entertainment within the city limits of the City of Waterloo without first having made application to and received a permit to do so in accordance with the conditions and limitations as set out in this article. The applicant for such a permit shall file an application in writing with the Clerk/Auditor, which application shall be accompanied by a set of plans. Such applications shall further specify: (1) The name of person or organization which will use structure; (2) The address of such person or organization; (3) The names and addresses of the officers of such organizations; (4) The length of time the structure is intended to be used for the purposes applied for; (5) The hours of the day or night during which such structure is intended to be used by the public; (6) Such other relevant information as the fire marshal, building official or city council may require. (Ord. No. 3219, 6-14-82) (c) Liability Insurance. The applicant shall furnish evidence that a general liability insurance policy in the amount of three hundred thousand dollars ($300,000.00) naming the City of Waterloo as an additional insured, shall be in effect at the time such structure is to be occupied as a haunted house. (Ord. No. 3219, 6-14-82) (d) Restoration of property used. The applicant shall provide a signed statement that the property used will be cleaned up and restored to its original and safe condition. (e) Time for filing of application; inspection. The application shall be filed at least fifteen (15) days prior to the scheduled opening of the haunted house. Final inspection by the fire marshal and the building department shall be made seven (7) days prior to the opening date. (Ord. No. 3219, 6-14-82) (f) Safety standards. The fire marshal and building official shall determine if the applicant has made provision for minimum safety standards to protect the life, limb, health and property of the public. Note: State Code provides that all slides and moving walkways be approved by the Iowa Department of Labor. (Ord. No. 3219, 6-14-82) (g) Structure must conform to plans and specifications. If the fire marshal and building department find that all of the limitations and requirements of the permit and this article have been complied with and that the structure has been erected in accordance with the plans and specifications submitted with the application, the Clerk/Auditor shall grant a permit to occupy such premises. If the fire marshal and building department find that any of the limitations and requirements of the permit and this article have not been complied with or that the structure has not been erected in accordance with the plans and specifications submitted with the applications, the Clerk/Auditor may deny a permit to occupancy such premises. If the fire marshal or building department find that such structure or the premises on which it is located is being maintained in violation of any of the provisions of the permit or this article, the Clerk/Auditor may revoke the permit to occupy provided for herein. Notice of this revocation shall be served personally or sent by regular mail to the name and address indicated on the application. (Ord. No. 3219, 6-14-82) (i) Appeal of revocation or denial. Any person or organization whose permit to occupy has been denied or revoided as aforesaid may, within seven (7) days after receipt of a notice thereof, appeal to the city council for a hearing thereon, and the decision of the council in this regard shall be final. If no appeal is taken within seven (7) days as provided herein, the action of the Clerk/Auditor shall be final. (Ord. No. 3219, 6-14-82) (j) Supervisors required. The permittee shall provide one (1) supervisor for each five (5) patrons within the amusement area. (Ord. No. 3219, 6-14-82) (k) Permittee's responsibility for defense. The permittee shall defend, at his own expense, any litigation arising from the operation of the haunted house for which he holds a permit. (Ord. No. 3219, 6-14-82) (1) Violation; penalty. Any person who violates any of the provisions of this ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine of not more than one hundred dollars ($100.00) or by imprisonment for a term not exceeding thirty (30) days.
