AN ORDINANCE VACATING A PORTION OF KIMBALL AVENUE AND
SAN MARNAN DRIVE EXCESS RIGHT-OF-WAY IN THE CITY OF
WATERLOO, IOWA.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
that the following described portion of Kimball Avenue and San
Marnan Drive excess right-of-way:
That part of the SE 1/4 of Section 4-88-13 described as
follows:
Beginning at the Southeasterly corner of Tract C, Granger's
Second Addition, Waterloo, Black Hawk County, Iowa; thence
N 22°13'55" E along the Easterly line of said Tract C a
distance of 193.36 feet; thence S 11°58'42" W a distance of
194.09 feet; thence N 88°28'33" W a distance of 479.28 feet;
thence N 00°00'23" W a distance of 10.00 feet to the
Southwesterly corner of said Tract C; thence S 88°28'33" E
along the Southerly line of said Tract C a distance of
446.39 feet to the point of beginning, all in the City of
Waterloo, Black Hawk County, Iowa,
shall be, and the same is hereby vacated with the City's
retention of a permanent utility easement over, under and above
the above described property.
