AN ORDINANCE AMENDING THE 1988 CODE OF ORDINANCES
OF THE CITY OF WATERLOO, IOWA, BY:
REPEALING SECTION 9-45, PERMIT FEE: AMOUNT,
DETERMINATION; TIME FOR PAYMENT, OF ARTICLE III,
MOVING BUILDINGS, OF CHAPTER 9, BUILDINGS; AND BY
ENACTING IN LIEU THEREOF A NEW SECTION 9-45,
PERMIT FEE, OF ARTICLE III, MOVING BUILDINGS, OF
CHAPTER 9, BUILDINGS; AND
BY REPEALING SUBSECTION (f), REGARDING FEES, OF
SECTION 33-10, CURB CUTS: PERMIT FROM THE CITY
ENGINEER REQUIRED; APPLICATION; APPROVAL OF PLANS
BY THE CITY ENGINEER; CRITERIA; CONSTRUCTION
STANDARDS; VIOLATION TO CONSTITUTE A NUISANCE AND
AN OFFENSE; FEES; APPEAL, OF CHAPTER 33, STREETS
AND SIDEWALKS; AND BY ENACTING IN LIEU THEREOF A
NEW SUBSECTION (f), REGARDING FEES, TO SECTION
33-10, CURB CUTS: PERMIT FROM THE CITY ENGINEER
REQUIRED; APPLICATION; APPROVAL OF PLANS BY THE
CITY ENGINEER; CRITERIA; CONSTRUCTION STANDARDS;
VIOLATION TO CONSTITUTE A NUISANCE AND AN OFFENSE;
FEES; APPEAL, OF CHAPTER 33, STREETS AND
SIDEWALKS; AND
REPEALING SUBSECTION (b), REGARDING FEES, OF
SECTION 33-102, REQUIRED; EXCEPTIONS, OF DIVISION
2, PERMITS, OF ARTICLE V, EXCAVATIONS, OF CHAPTER
33, STREETS AND SIDEWALKS; AND BY ENACTING IN LIEU
THEREOF A NEW SUBSECTION (b), REGARDING FEES, OF
SECTION 33-102, REQUIRED; EXCEPTIONS, OF DIVISION
2, PERMITS, OF ARTICLE V, EXCAVATIONS, OF CHAPTER
33, STREETS AND SIDEWALKS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA:
That Section 9-45, Permit Fee: Amount, determination;
time for payment, of Article III, Moving Buildings, of
Chapter 9, Buildings, of the 1988 Code of Ordinances of the
City of Waterloo, Iowa, is hereby repealed in its entirety;
that a new Section 9-45, Permit Fee, of Article III, Moving
Buildings, of Chapter 9, Buildings of the 1988 Code of
Ordinances of the City of Waterloo, Iowa, is hereby enacted
in lieu thereof as follows:
Sec. 9-45. Permit Fee.
The application for a permit to move a building
shall be accompanied by a permit fee in an amount set
by resolution of the city council and collected by the
city engineer's office.
In the event a building or structure is moved from the
City of Waterloo, Iowa, to Cedar Falls, Iowa, or to
Evansdale, Iowa, or if a building or structure is to be
moved from Cedar Falls, Iowa or Evansdale, Iowa, into
Waterloo, Iowa, the permit fee shall be equally divided
between the City of Waterloo, Iowa, and the other city
involved. In either event, only one permit fee shall be
charged and the permit fee shall be paid to the city from
which the building or structure is being moved.
Work performed by the city shall not require a permit
fee.
That Subsection (f), regarding fees, of Section 33-10,
Curb cuts: Permit from the city engineer required;
application; approval of plans by the city engineer;
criteria; construction standards; violation to constitute a
nuisance and an offense; fees; appeal, of Chapter 33,

Streets and Sidewalks, of the 1988 Code of Ordinances of the
City of Waterloo, Iowa, is hereby repealed in its entirety;
that a new Subsection (f), regarding fees, of Section 33-10,
Curb cuts: Permit from the city engineer required;
application; approval of plans by the city engineer;
criteria; construction standards; violation to constitute a
nuisance and an offense; fees; appeal, of Chapter 33,
Streets and Sidewalks, of the 1988 Code of Ordinances of the
City of Waterloo, Iowa, is hereby enacted in lieu thereof as
follows:
(f) All new driveway applications and driveway
repair applications shall be accompanied by a permit
fee in an amount set by resolution of the city council
and collected by the city engineer's office. Work
performed by the city shall not require a permit fee.
That Subsection (b), regarding fees, of Section 33-102,
Required; exceptions, of Division 2, Permits, of Article V,
Excavations, of Chapter 33, Streets and Sidewalks, of the
1988 Code of Ordinances of the City of Waterloo, Iowa, is
hereby repealed in its entirety; that a new Subsection (b),
regarding fees, of Section 33-102, Required; exceptions, of
Division 2, Permits, of Article V, Excavations, of Chapter
33, Streets and Sidewalks, of the 1988 Code of Ordinances of
the City of Waterloo, Iowa, is hereby enacted in lieu
thereof as follows:
(b) All new street excavation permits shall be
accompanied by a fee in an amount set by resolution of
the city council and collected by the city engineer's
office. Work performed by the city shall not require a
permit fee.
