AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY
OF WATERLOO, IOWA, BY REPEALING SUBSECTION (125)
SUBSTANTIAL IMPROVEMENT OF SECTION 2A-3, DEFINITIONS,
OF PART III; AND BY ENACTING IN LIEU THEREOF A NEW
SUBSECTION (125) SUBSTANTIAL IMPROVEMENT OF SECTION
2A-3, DEFINITIONS, OF PART III; AND BY ADDING A NEW
SUBSECTION (124a) SUBSTANTIAL DAMAGE TO SECTION 2A-3,
DEFINITIONS, OF PART III.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO,
IOWA:
That Subsection (125) Substantial Improvement of Section
2A-3, Definitions, of Part III of the Zoning Ordinance of the
City of Waterloo, Iowa, is hereby repealed in its entirety; that
a new Subsection (125) Substantial Improvement of Section 2A-3,
Definitions, of Part III of the Zoning Ordinance of the City of
Waterloo, Iowa, is hereby enacted in lieu thereof as follows:
(125) Substantial Improvement: Any repair,
reconstruction, rehabilitation, addition or improvement of a
structure, the cost of which equals or exceeds 50% of the
market value of the structure before the start of
construction of the improvement. This term includes
structures which have incurred "substantial damage"
regardless of the actual repair work performed. The term
does not, however, include either (1) any project for
improvement of a structure to correct existing violations of
state or local health, sanitary, or safety code
specifications which have been identified by the local code
enforcement officer and which are the minimum necessary to
assure safe living conditions or (2) any alteration will
not preclude the structure's continued designation as a
"historic structure".
That Subsection (124a) Substantial Damage is hereby added to
Section 2A-3, Definitions, of Part III of the Zoning Ordinance of
the City of Waterloo, Iowa, as follows:
(124a) Substantial Damage: Damage of any origin
sustained by a structure whereby the cost of restoring the
structure to its before damage condition would equal or
exceed 50% of the market value of the structure before the
damage occurred.
