HomeMy WebLinkAbout3825-10/07/1991ORDINANCE NO. 3825 AN ORDINANCE VACATING PORTIONS OF WESTFIELD AVENUE, MCKINLEY STREET AND JEFFERSON STREET IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, that the following described portions of Westfield Avenue, McKinley Street and Jefferson Street: McKinley Street 66 -foot wide lying between the South right-of-way line of Westfield Avenue (formerly Miles Street) and a line between a point on the West right-of-way line of McKinley Street, which point is 205.5 feet South of the North line of the Northwest 1/4 of Section 26, Township 89 North, Range 13 West of the Fifth Principal Meridian to a point on the East right-of-way line of McKinley Street which point is 203.8 feet South of the North line of the Northwest 1/4 of said Section 26. Westfield Avenue (formerly Miles Street) of varied width lying between the following described lines: On the West. Commencing at the Southwest corner of Section 23; Township 89 North, Range 13 West of the Fifth Principal Meridian; thence North 1°0'35" West along the West line of the southwest 1/4 of said Section 23 a distance of 245.32 feet; thence South 48°25'27" East a distance of 150.87 feet to the point of beginning of the line described; thence North 48°25'27" West to the right-of-way line of the flood control levee on the East bank of Black Hawk Creek. On the East. The Southwest right-of-way line of Jefferson Street, as presently located, extended Northwesterly, and also All that part of Jefferson Street as presently located, as relocated by Town Lot Deed Book 134, Page 222, in the office of the Recorder of Black Hawk County, Iowa, being part of Lot 24 and adjacent railroad right-of-way as platted in Auditor's Falls Avenue and Mullen Avenue Plat in the City of Waterloo, Black Hawk County, Iowa, and described as follows: Beginning at a point on the Northwesterly extension of the Southwesterly line of Lot 28 in Auditor's Falls Avenue and Mullen Avenue Plat, which point is 12.0 feet Southeasterly from the Southeasterly line of Westfield Avenue (formally Miles Street) at a point 6.15 feet Southwesterly from the most Northerly corner of said Lot 24; thence Northwesterly along the Northwesterly extension of the Southwesterly line of said Lot 28 a distance of 12.0 feet; thence Southwesterly along the Northwesterly line of said Lot 24 a distance of 63.39 feet; thence Southeasterly along the Southwesterly line of the presently established Jefferson Street right-of-way a distance of 163.0 feet; thence North 24°13'24" West a distance of 143.64 feet to the point of beginning, all in the City of Waterloo, Black Hawk County, Iowa, shall be, and the same is hereby vacated, with the City's retention of a utility agreement over, under and above the above described parcels.
