RESOLUTION NO. 2009-545
RESOLUTION MAKING ASSESSMENT FOR REPAIRING
THE SERVICE LINE AND PREVENTION OF FURTHER
DAMAGE AT 404 WENDELL COURT.
WHEREAS, the Board of Water Works Trustees of the City of
Waterloo, Iowa, did, as provided by law, notify by written notice
the property owner of the premises known as 404 Wendell Court to
have the service line repaired and further damage prevented, and
WHEREAS, the property owner failed to comply with the order
of the Board of Water Works Trustees, as by law provided, and
WHEREAS, the Board of Water Works Trustees proceeded to have
the work done on the premises described as 404 Wendell Court, in
the City of Waterloo, Iowa, to comply with Ordinance No. 1118 of
the City of Waterloo, Iowa, and
WHEREAS, the Board of Water Works Trustees filed with the
City Clerk on the 3rd day of June, 2009, a report filing claim
for the repairing of the service line and preventing further
damage at above described premises and same met all the
requirements of the City ordinance and have been fully completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the said report of the Board of Water Works
Trustees be, and the same is hereby, approved; that the work was
done under and by virtue hereby, accepted, and that the cost of
said work is hereby determined to be as follows, which amount can
be assessed over a ten-year period against the property:

404 Wendell Court, Waterloo, Iowa
Legal Description:
Westerly Ten and Twenty-one Hundredths (10 . 21) feet of
Lots Nos . Thirty-two (32) and Thirty-three (33) in
Auditor Rainbow' s Plat No. 4 to Waterloo, Iowa; and
that part of Lot No . Thirty-seven (37) in said Auditor
Rainbow' s Plat No. 4 , bounded as follows : Commencing
at the Southeast Corner of said Lot; running thence
West along the South line of said Lot a distance of
Sixty-one and Sixty-two Hundredths (61 . 62) feet to the
Southwest Corner of said Lot; thence North 0 Degrees
18 ' 25" East a distance of One Hundred Ten (110) feet;
thence South 89 Degrees 6 ' East a distance of Sixty-two
and Five Hundredths (62 . 05) feet; thence South 0
Degrees 31' 25" West to the place of beginning, Black
Hawk County.
Unpaid Assessment : $1, 377 . 00
BE IT FURTHER RESOLVED that there be, and are hereby
assessed and levied a special tax and assessment against the
property improved, described as 404 Wendell Court in the City of
Waterloo, Iowa, the amount of $1, 377 . 00, said assessment shall
bear interest from the date of levy of the assessment, viz :
June 8 , 2009, at the rate of nine (9) percent per annum until
paid on all the unpaid amount of this assessment certified to the
County Treasurer of Black Hawk County, Iowa, and

BE IT FURTHER RESOLVED that the City Clerk be, and she is
oN hereby instructed to notify Thomas Page Anderson, of said
p 'E perty, accordingly and also instructed to certify said
E essment to the County Treasurer of Black Hawk County, Iowa, to
o l entered upon the tax list to be collected as other taxes, as
'ovided by law, and when collected to be credited to the Water
T ks Fund of said City, and assessment to be made over a ten-
o lea period.
