PUBLIC NOTICE IS HEREBY GIVEN that the above mentioned governmental body will meet at the date, time and place above set out. The tentative agenda for said meeting is as follows: • Resolution fixing date for a meeting on the proposal to reallocate certain unspent proceeds of the General Obligation Bonds, Taxable Series 2007C, and providing for publication of notice thereof Such additional matters as are set forth on the additional 6 page(s) attached hereto. (number) This notice is given at the direction of the Mayor pursuant to Chapter 21, Code of Iowa, and the local rules of said governmental body. City Clerk, Wa'rloo, Iowa Nancy Ecker . - 1 - June 22 , 2009 The City Council of Waterloo, Iowa, met in regular session, in the Council Chambers, City Hall, Waterloo, Iowa, at 5: 30 o'clock P .M., on the above date. There were present Mayor Tim Hurley , in the chair, and the following named Council Members: Cole, Getty, Hart, Greenwood. Steve Schmitt, Welper, Reggie Schmitt Absent: none * * * * * * * - 2 - Council Member Hart introduced the following Resolution entitled "RESOLUTION FIXING DATE FOR A MEETING ON THE PROPOSAL TO REALLOCATE CERTAIN UNSPENT PROCEEDS OF THE GENERAL OBLIGATION BONDS, TAXABLE SERIES 2007C, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF", and moved that the same be adopted. Council Member Reggie Schmitt seconded the motion to adopt. The roll was called and the vote was, AYES: Cole, Getty, Hart, Greenwood, Steve Schmitt, Welper, Reggie Schmitt NAYS: none Whereupon, the Mayor declared the resolution duly adopted as follows: RESOLUTION NO. 2009-609 RESOLUTION FIXING DATE FOR A MEETING ON THE PROPOSAL TO REALLOCATE CERTAIN UNSPENT PROCEEDS OF THE GENERAL OBLIGATION BONDS, TAXABLE SERIES 2007C, AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF WHEREAS, pursuant to a Resolution approved on June 6, 2007, the City Council of the City of Waterloo, Iowa has previously issued its General Obligation Bonds, Taxable Series 2007C, in the aggregate principal amount of$1,090,000 (the "Taxable Series 2007C Bonds"), for the purpose of paying costs, among other things, of aiding in the planning, undertaking and carrying out of urban renewal project activities under Chapter 403 of the Code of Iowa, as amended, and the Urban Renewal Plans for the San Marnan Urban Renewal Area, the Logan Tax Increment Redevelopment Area, the Rath Tax Increment Redevelopment Area, the Martin Road District, and the Downtown Waterloo Riverfront Urban Renewal and Redevelopment Area, including property acquisitions, demolition, and clearance for public and private redevelopment, incentive payments relating to the acquisition and private redevelopment of properties within such areas, and the construction, repair and improvement of the East Park Avenue Parking Ramp Facility; the reconstruction, remodeling, improvement and repairing of City buildings and facilities, including the Five Sullivan Brothers Center, Young Arena, Central Garage, Fire Stations, and Public Library, and the acquisition of computer replacements and system upgrades to the City's data management and information - 3 - processing systems; the acquisition of capital equipment and vehicles for various City departments and operations; and the reconstruction and improvement of City golf courses; and the reconstruction, renovation and improvement of the Riverfront Stadium, swimming pools and sports facilities; and improvements to the Center for the Arts and Youth Pavillion; and WHEREAS, certain proceeds of the Taxable Series 2007C Bonds remain unspent, and City staff has recommended that not to exceed $50,000 of such unspent proceeds (hereinafter referred to as the "Unspent Proceeds") be applied for the purpose of paying costs of constructing a paved parking lot for visitors and those attending events at Young Arena, the Center for the Arts, the Expo Plaza and Amphitheater; and WHEREAS, there being no procedure specified under Iowa law for consideration or approval of such a reallocation, it is hereby determined, pursuant to Section 364.6 of the Code of Iowa, that the procedure set forth in Section 384.25 should apply and that a hearing be held upon the proposal to reallocate the Unspent Proceeds to provide funds for the purpose of paying costs of constructing a paved parking lot for visitors and those attending events at Young Arena, the Center for the Arts, the Expo Plaza and Amphitheater. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That this Council meet in the Council Chambers, City Hall, Waterloo, Iowa, at 8: 0 0 o'clock A.M., on the 2 9th day of June , 2009, for the purpose of taking action on the matter of the proposed reallocation of the Unspent Proceeds of the Taxable Series 2007C Bonds to pay costs of constructing a paved parking lot for visitors and those attending events at Young Arena, the Center for the Arts, the Expo Plaza and Amphitheater. Section 2. That the City Clerk is hereby directed to cause one publication to be made of notice of said meeting, in a legal newspaper,printed wholly in the English language, published at least once weekly, and having general circulation in said City, said publication to be not less than four clear days nor more than twenty days before the date of said public meeting. Section 3. The notice of the proposed action shall be in substantially the following form: - 4 - NOTICE OF MEETING OF THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, ON THE MATTER OF THE PROPOSED REALLOCATION OF CERTAIN UNSPENT PROCEEDS OF THE GENERAL OBLIGATION BONDS, TAXABLE SERIES 2007C, OF THE CITY OF WATERLOO, IOWA, AND THE PUBLIC HEARING THEREON PUBLIC NOTICE is hereby given that the Council of the City of Waterloo, Iowa, will hold a public hearing on the 29th day of June , 2009, at 8 00 o'clock A .M., in the Council Chambers, City Hall, Waterloo, Iowa, at which meeting the Council proposes to take additional action for the reallocation of certain unspent proceeds of the General Obligation Bonds, Taxable Series 2007C (the "Taxable Series 2007C Bonds") of the City of Waterloo, Iowa, in the aggregate amount of not to exceed $50,000, in order to pay costs of constructing a paved parking lot for visitors and those attending events at Young Arena, the Center for the Arts, the Expo Plaza and Amphitheater. Any person interested may appear at the public hearing, either orally or in writing, and be heard as to the reallocation of said proceeds of the Taxable Series 2007C Bonds for the above purpose. This Notice is given by order of the Council of Waterloo, Iowa, as provided by Sections 364.6 and 384.25 of the Code of Iowa, 2009, as amended. Dated this 22nd day of June , 2009.
