RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE SALE
AND CONVEYANCE OF LAND LEFT OVER AFTER THE
CONSTRUCTION OF FITZWAY DRIVE TO VGM
DEVELOPMENT CORP. AS JULY 13 , 2009, AT 5 : 30
P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO,
IOWA AND INSTRUCTING THE CITY CLERK TO
PUBLISH THE NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS :
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 5 : 30 p.m. on the 13th day of July, 2009, for the purpose
of considering and acting upon a proposal to sell and convey land
left over after the construction of Fitzway Drive to VGM
Development Corp. , and legally described as follows :
That part of the Northeast Quarter (NE1/,) of Section
Eight (8) , Township Eighty-eight North (T88N) , Range
Thirteen West (R13W) of the Fifth Principal Meridian,
City of Waterloo, Black Hawk County, Iowa, described as
follows :
Commencing at the Northwest corner of parcel described
as Fee Simple Acquisition A in Acquistion Plat
Ansborough Avenue Interchange Document No. 2006-01395,
Black Hawk County Recorder' s Office; thence S89°40' 05"W
One Hundred Seventeen and Twenty Hundredths (117 . 20)
feet along the South line of parcel described in
Document No. 2006-06189 to the point of beginning;
thence continue S89°40 ' 05"W Seventy-one and Fifty-seven
Hundredths (71 . 57) feet still along said South line to
the Southwest corner of said parcel; thence N00°18 ' 43"W
One Hundred Fifty-seven and Seventy-five Hundredths
(157 . 75) feet along the West line of said parcel to the
Northwest corner of said parcel ; thence N89°40' 05"E
Three and Ninety Hundredths (3 . 90) feet along the North
line of said parcel to the Southwest corner of tract
described in Document No. 2006-07260, in aforesaid
Recorder' s Office; thence N00°54 ' 37"W One Hundred
Twenty-eight and Eighty-nine Hundredths (128 . 89) feet
along the West line of said tract to the Northwest
corner of said tract; thence N89°05 ' 30"E One Hundred
Eighty-five and Twenty-seven Hundredths (185 . 27) feet
along the North line of said track to the Northwest
corner of property described in Document No. 2006-
06187, in aforesaid Recorder' s Office; thence Southerly
Fifty-five and Ninety-four Hundredths (55 . 94) feet
along the arc of a Seven Thousand Nine Hundred Fifty-
one Hundredth (7951 . 00) foot radius curve, concave
Westerly with a long chord of Fifty-five and Ninety-
four Hundredths (55 . 94) feet bearing S00°58 ' 06"E along
the West line of said property; thence S89°40 ' 05"W
Sixty-five and Thirty Hundredths (65 . 30) feet; thence
