RESOLUTION NO, 2009-648
RESOLUTION APPROVING AGREEMENT AND DIRECTING
EXECUTION OF SAID AGREEMENT BY MAYOR.
WHEREAS, the Easement Agreement for the hereinafter described
parcels are for a utility easement generally located along the
north side of West Ridgeway Avenue between Deere Road and Martin
Road to provide telephone and Internet services for the new
development in the Greenbelt. Centre Business Park.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO. IOWA.., that. the Easement Agreement, by and between Qwest
Corporation, for the parcels hereinafter described, be and the
same hereby approved.
Legal Description of the Property
The West one-half of the Southeast Quarter of Section
32, Township 89 North, Range 13 West, Fifth Principal
Meridian, City of Waterloo, Black Hawk County, Iowa.
Except the East 475 feet of the South 790 feet thereof .
Legal Description of the Easement
An easement for telecommunication purposes over under
and across that part of the hereinbefore described
property described as follows :
Commencing at the southeast corner of said Southeast
Quarter of Section 32, Thence South 89 degrees 10
minutes 28 seconds West 1322 . 57 feet along the south
line of said Southeast Quarter to the southeast corner
of said West one-half of the Southeast Quarter; Thence
continuing South 89 degrees 10 minutes 28 seconds West
476 . 00 feet along said south line of said Southeast
Quarter; Thence North 00 degrees 49 minutes 32 seconds
West 33 . 00 feet to the point of beginning for the
easement to be described; Thence continuing North 00
degrees 49 minutes 32 seconds West 25 . 00 feet; Thence
South 89 degrees 10 minutes 28 seconds West 25 . 00 feet;
Thence South 00 degrees 49 minutes 32 seconds East
25 . 00 feet; Thence North 89 degrees 10 minutes 28
seconds East 25 . 00 feet to the point of beginning, all
in the City of Waterloo, Black Hawk County, Iowa.
Said easement contains 625 square feet more or less .
Said easement subject to easements, reservations and
restrictions of record, if any.
