RESOLUTION FIXING THE TIME AND PLACE OF
HEARING TO BE GIVEN UPON THE CITY' S REQUEST
TO REZONE FROM "R-3 ,P-P" PLANNED RESIDENCE
DISTRICT TO "C-P" PLANNED COMMERCIAL DISTRICT
APPROXIMATELY 1 ,47 ACRES GENERALLY LOCATED AT
THE NORTHEAST CORNER OF IDAHO STREET AND
MARTIN LUTHER KING JR. DRIVE, AS J,GLY 20,
2009, AT 5 : 30 P.M: IN THE COUNCIL CHAMBERS IN
CITY HALL AND INSTRUCTING CITY 'TERK TO
PUBLISH NOTICE OF HEARING.
WHEREAS, the Council of the City of Waterloo, Iowa, shall
meet in the Council Chambers in the City Hall in the City of
Waterloo, Iowa, at 5 : 30 p.m. on the 20th day of July, 2009, for
the purpose of considering and acting upon the City' s request to
rezone from "R-3 , R-P" Planned Residence District to "C-P" Planned
Commercial District approximately 1 . 47 acres generally located at
the northeast corner of Idaho Street and Martin Luther King Jr.
Drive and legally described as follows :
Parcel H
A part of the Southeast lA of Section 19, Township 89
North, Range 12 West of the 5th P.M. , and a part of
existing Idaho Street in the Southeast IA of said
Section 19, all in the City of Waterloo, County of
Black Hawk, State of Iowa, more particularly described
as follows :
Commencing at the center of said Section 19; thence
North 88° (Degrees) 43 ' (Minutes) 55" (Seconds) East
(assumed bearing for the purpose of this description)
on the North line of the Southeast 1A of said Section 19
a distance of 16 . 50 feet to the present East right-of-
way line of Idaho Street, the point of beginning of the
parcel herein described; thence North 88°43 ' 55" East on
the North line of the Southeast 1/ of said Section 19,
also being the present East right-of-way line of Idaho
Street and its extension Easterly, 182 . 94 feet to the
Southwesterly line of the Canadian National Railroad;
thence Southeasterly on the Southwesterly line of the
Canadian National Railroad, being a 1, 879 . 86-foot
radius curve concave Southwesterly and having a 105 . 63-
foot long chord bearing South 46°28 ' 08" East, 105 . 64
feet (arc length) ; thence Southwesterly on a 211 . 04-
foot radius curve concave Southeasterly and having a
215 . 72-foot long chord bearing South 12°01' 17" West,
226 . 42 feet (arc length) ; thence South 52°56 ' 38" West,
67 . 54 feet; thence North 70°38 ' 19" West, 164 . 88 feet;
thence North Ol°05 ' 55" West, 265 . 78 feet to the point
of beginning.
By survey containing 63 , 883 square feet, or 1 .47 acres,
all in the City of Waterloo, Black Hawk County, Iowa.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the City Clerk is hereby directed to publish
Notice of the time and place of said hearing in the Waterloo
Courier.
