O O A RESOLUTION DECLARING A MORATORIUM FOR A
< x PERIOD OF 120 DAYS FOR NEW ALCOHOL-RELATED

• CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA.

WHEREAS, the City of Waterloo is, and has been, in the
e process of reviewing portions of the City of Waterloo Zoning
• Ordinance No. 2479 as it pertains to the regulation of new
` alccohol-related drinking and retail establishments, and
WHEREAS, the moratorium shall apply to the following:
1 . Any premises or use that will be required by Iowa law
to have a license or permit for the sale or dispensing
of alcoholic beverages for off-premises consumption
regardless of the revenues actually realized from the
acv sale of such beverages .
2 . Such a license or permit for on-premises consumption if
r the business will realize more than 50 percent of its
`,3 � gross revenues at that location from the sale of
alcoholic beverages;
except that any such premises or use for which a complete
application or plans were submitted for approval before the
effective date of the moratorium, and
WHEREAS, the City Council of the City of Waterloo believes
that a moratorium should be declared for a period of 120 days,
until said amendments have been presented to, and adopted by, the
City Council of the City of Waterloo.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that a moratorium is hereby declared for a period
of 120 days on any and all new alcohol-related drinking and
retail establishments .
PASSED AND ADOPTED this 27th day of July, 2009 .
