RESOLUTION NO. 2009-868
RESOLUTION APPROVING REQUEST OF DON GARDNER
CONSTRUCTION ON BEHALF OF BPI, INC. FOR A
MINOR SITE PLAN AMENDMENT TO THE "M-2 , P"
PLANNED INDUSTRIAL DISTRICT FOR CONSTRUCTION
OF A 30' X 197' WAREHOUSE ADDITION TO THE
EXISTING BPI FACILITY WITHIN THE TYSON FOODS
FACILITY GENERALLY LOCATED AT 501 N. ELK RUN
ROAD.
WHEREAS, it has been proposed that the Council of the City
of Waterloo, Iowa, approve the request of Don Gardner
Construction on behalf of BPI, Inc . for a minor Site Plan
Amendment to the "M-2, P" Planned Industrial District for
construction of a 30' x 197' warehouse addition to the existing
BPI facility within the Tyson Foods facility generally located at
501 N. Elk Run Road, legally described as follows :
The Southwest 1/ of the Northwest 1/ of Section 21,
Township 89 North, Range 12 West of the 5th Principal
Meridian, all in the City of Waterloo, Black Hawk
County, Iowa.
WHEREAS, due to the insignificant nature of said minor Site
Plan Amendment, the Council did not deem it necessary to hold a
public hearing, and
WHEREAS, it is the opinion of this Council that said minor
Site Plan Amendment should be approved as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WATERLOO, IOWA, that the minor Site Plan Amendment to the
"M-2, P" Planned Industrial District for construction of a 30' x
197' warehouse addition to the existing BPI facility within the
Tyson Foods facility generally located at 501 N. Elk Run Road, be
and the same is hereby approved.
PASSED AND ADOPTED this 8th day of September, 2009, and
approved by the Mayor this 10th day of September, 2009 .
