RESOLUTION NO. 2009-864
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION OF A PORTION OF THE 16' X 120'
PLATTED PUBLIC ALLEY IN BLOCK 6 OF RUSSELL
HEIGHTS ADDITION DIRECTLY NORTH OF PROPERTY
LOCATED AT 1415 WEST 11TH STREET AS
SEPTEMBER 21, 2009, AT 5 : 30 P.M. IN CITY HALL
COUNCIL CHAMBERS, WATERLOO, IOWA AND
INSTRUCTING THE CITY CLERK TO PUBLISH THE
NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS :
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa at 5 : 30 p.m. on the 21st day of September, 2009, for the
purpose of considering and acting upon a proposal to vacate the
16' x 120' platted public alley in Block 6 of Russell Heights
Addition directly north of property located at 1415 West 11th
Street, and legally described as follows :
The Sixteen (16) foot public alley as platted in Block
Six (6) , Russell Heights in the City of Waterloo, Iowa
lying Easterly of the Northerly extension of the West
line of Lot Three (3) in said Block Six (6) and lying
Westerly of the Northerly extension of the East line of
Lot Three (3) in said Block Six (6) , all in the City of
Waterloo, Black Hawk County, Iowa, subject to city' s
retention of a 4 ' utility easement over, under and
above the north 4' of the south half of said alley.
Section 2 . That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
PASSED AND ADOPTED this 8th day of September, 2009 .
