RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
PROPOSED DEVELOPMENT AGREEMENT WITH TOURNIER
MANUFACTURING, INC. TO SELL AND CONVEY FOR
$1 . 00, PLUS COSTS, PROPERTY GENERALLY LOCATED
AT THE NORTHEAST CORNER OF WAGNER ROAD AND
BROADWAY STREET, AS OCTOBER 12, 2009, AT 5 : 30
P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO,
IOWA AND INSTRUCTING THE CITY CLERK TO
PUBLISH THE NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
AS FOLLOWS :
Section 1 . That the Council of the City of Waterloo, Iowa
shall meet at City Hall Council Chambers in the City of
Waterloo, Iowa at 5 : 30 p.m. on the 12th day of October, 2009, for
the purpose of considering and acting upon a proposed
Development Agreement with Tournier Manufacturing, Inc . to sell
and convey for $1 . 00, plus costs, property generally located at
the northeast corner of Wagner Road and Broadway Street, and
legally described as follows :
A parcel of land situated in part of the Northwest 1/ of
Section 10, Township 89 North, Range 13 West of the 5th
Principal Meridian, City of Waterloo, County of Black
Hawk, State of Iowa, more particularly described as
follows :
Commencing at the West 1/ corner of said Section 10;
thence North 01° (Degrees) 30' (Minutes) 35" (Seconds)
West (assumed bearing for the purpose of this
description) on the West line of the Northwest 1/ of
said Section 10, a distance of 761 . 63 feet to the
Southwesterly right-of-way line of the Canadian
National Railroad; thence South 49°14 ' 48" East on the
Southwesterly right-of-way line of the Canadian
National Railroad, 101 . 34 feet to the point of
beginning of the parcel of land herein described;
thence continuing South 49°14 ' 48" East on the
Southwesterly right-of-way line of the Canadian
National Railroad, 708 . 00 feet; thence South 02°24' 41"
East, 77 . 63 feet; thence North 61°34 ' 53" West, 606 . 00
feet to a line that is 75 . 00 feet East of and parallel
with the West line of the Northwest 1/ of said Section
10; thence North 01°30' 35" West on the line that is
75 . 00 feet East of and parallel with the West line of
the Northwest 1% of said Section 10, a distance of
251 . 43 feet to the point of beginning.
Containing 86, 064 square feet or 1 . 98 acres, all in the
City of Waterloo, Black Hawk County, Iowa.
Section 2 . That the City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
