RESOLUTION NO. 2009-998
RESOLUTION MAKING ASSESSMENT FOR REPAIRING
THE PAVE BOX AND SERVICE LINE AND PREVENTION
OF FURTHER DAMAGE AT 1019 LAFAYETTE STREET.
WHEREAS, the Board of Water Works Trustees of the City of
Waterloo, Iowa, did, as provided by law, notify by written notice
the property owners of the premises known as 1019 Lafayette
Street to have the pave box and service line repaired and further
damage prevented, and
WHEREAS, the property owners failed to comply with the order
of the Board of Water Works Trustees, as by law provided, and
WHEREAS, the Board of Water Works Trustees proceeded to have
the work done on the premises described as 1019 Lafayette Street,
in the City of Waterloo, Iowa, to comply with Ordinance No. 1118
of the City of Waterloo, Iowa, and
WHEREAS, the Board of Water Works Trustees filed with the
City Clerk on the 24th day of September, 2009, a report filing
claim for the repairing of the pave box and service line and
preventing further damage at above described premises and same
met all the requirements of the City ordinance and have been
fully completed.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the said report of the Board of Water Works
Trustees be, and the same is hereby, approved; that the work was
done under and by virtue hereby, accepted, and that the cost of
said work is hereby determined to be as follows, which amount can
be assessed over a ten-year period against the property:
William L. and Lou B . Bradford, husband and wife,
owners
1019 Lafayette Street, Waterloo, Iowa
Legal Description:
Northwesterly Thirty-seven (37) feet of Lots Nos . Eight
(8) and Nine (9) in Block No. Twenty-four (24) in the
Original Plat on the East Side of the Cedar River in
the City of Waterloo, Black Hawk County, Iowa.
Unpaid Assessment : $1, 102 . 07
BE IT FURTHER RESOLVED that there be, and are hereby
assessed and levied a special tax and assessment against the
property improved, described as 1019 Lafayette Street in the City
of Waterloo, Iowa, the amount of $1, 102 . 07, said assessment shall
bear interest from the date of levy of the assessment, viz :
October 5, 2009, at the rate of nine (9) percent per annum until
paid on all the unpaid amount of this assessment certified to the
County Treasurer of Black Hawk County, Iowa, and
BE IT FURTHER RESOLVED that the Deputy City Clerk be, and
she is hereby instructed to notify William L. and Lou B. Bradford
of said property, accordingly and also instructed to certify said
assessment to the County Treasurer of Black Hawk County, Iowa, to
be entered upon the tax list to be collected as other taxes, as
provided by law, and when collected to be credited to the Water
Works Fund of said City, and assessment to be made over a ten-
year period.
