RESOLUTION NO. 2009-1009
RESOLUTION FIXING THE TIME AND PLACE OF
HEARING AND NOTICE TO BE GIVEN ON THE
VACATION OF A PORTION OF ELM STREET GENERALLY
LOCATED BETWEEN LAFAYETTE STREET AND MULBERRY
STREET, AND A PORTION OF THE ELM STREET
RIGHT-OF-WAY, AS OCTOBER 19, 2009, AT 5 : 30
P.M. IN CITY HALL COUNCIL CHAMBERS, WATERLOO,
IOWA, AND INSTRUCTING THE DEPUTY CITY CLERK
TO PUBLISH THE NOTICE OF HEARING.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA,
as follows :
Section 1 . That the Council of the City of Waterloo, Iowa,
shall meet at City Hall Council Chambers in the City of Waterloo,
Iowa, at 5 : 30 p.m. on the 19th day of October, 2009, for the
purpose of considering and acting upon a proposal to vacate a
portion of Elm Street generally located between Lafayette Street
and Mulberry Street, and a portion of the Elm Street right-of-way,
and legally described as follows :
That part of Elm Street in Lane and Fowler Second
Addition, Waterloo, Black Hawk County, Iowa, described
as follows :
Beginning at the Southeast corner of Lot Ten (10) ,
Block Fourteen (14) aforesaid Second Addition; thence
North along the East line of said Block Fourteen (14)
to the Northeast corner of Lot One (1) Block Fourteen
(14) ; thence East to the Northwest corner of Lot Four
(4) Block Thirteen (13) said Second Addition; thence
South along the West line of said Block Thirteen (13)
to the Southwest corner of Lot Seven (7) , said Block
Thirteen (13) ; thence Northwesterly to the point of
beginning; except the West Six (6) feet thereof;
subject to city' s retention of a permanent utility
easement over, under and upon the above described area,
all in the City of Waterloo, Black Hawk County, Iowa;
for $1 . 00, plus costs .
Section 2 . That the Deputy City Clerk is hereby directed to
publish notice of the time and place of said hearing in the
Waterloo Courier.
PASSED AND ADOPTED this 5th day of October, 2009 .
