RESOLUTION NO. 2009-1097 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF A PORTION OF RIVER ROAD ABUTTING THE CURRENT MANATT' S, INC. PROPERTY ON MULLAN AVENUE FOR $1 . 00, PLUS COSTS, AND AUTHORIZING THE MAYOR AND DEPUTY CITY CLERK TO EXECUTE AND DELIVER DEED FOR SAME. WHEREAS, the City of Waterloo, Iowa, is the owner of real property in the City of Waterloo, Iowa, as described below, and WHEREAS, an offer to purchase said certain parcels of real property in the sum of $1 . 00, plus costs, has been made by Manatt' s, Inc . , and WHEREAS, a public hearing was held on October 19, 2009, at 5 : 30 p.m. in the Council Chambers in City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal to sell and convey property owned by the City of Waterloo, Iowa, to Manatt' s, Inc . , and WHEREAS, it is the opinion of this Council that sale and conveyance should be made as proposed. NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS : 1 . The following described real property, as fully described in the published notice in the Waterloo Courier on October 9, 2009, is not presently needed and will not be needed in the foreseeable future for municipal purposes and its ownership is serving no municipal purpose, and 2 . That the offer of Manatt' s, Inc . , to purchase real property for the sum of $1 . 00, and costs, be and it is hereby accepted for real property described below: That part of River Road right-of-way adjoining Manatts, Inc . property in Government Lot 7, Section 23 , Township 89 North, Range 13 West of the Fifth Principal Meridian including part of Blocks 2 and 5, James Eggers Addition and part of vacated Thompson Avenue in the City of Waterloo, Iowa, described as follows : Commencing at the most Westerly corner of Lot 5 in Block 2, James Eggers Addition in the City of Waterloo, Iowa; thence North 41°09' 59" East along the Northwesterly line of said Lot 5 a distance of 25 . 00 feet to the point of beginning; thence North 49°00' 59" West of distance of 3 . 82 feet; thence North 01°02' 43" West a distance of 314 . 38 feet; thence North 29°54 ' 02" East a distance of 42 . 71 feet; thence North 88°13 ' 04" East a distance of 19 . 35 feet; thence North 01°46' 56" West a distance of 140 . 09 feet; thence North 18°54 ' 38" East a distance of 25 . 91 feet to the most Northerly corner of property owned by Manatts, Inc . , recorded in City Land Deed Book 600, Page 465; thence South 01°20' 34" East along the Westerly line of said Manatts, Inc . property a distance of 60 . 00 feet; thence South 01°22 ' 17" East a distance of 175 . 62 (recorded as 175 . 72) feet; thence South 00°31' 57" East a distance of 113 . 08 feet to the Northwesterly line of vacated Resolution No. 2009-1097 Page 2 Thompson Avenue; thence South 41°09' 59" West along the Northwesterly line of vacated Thompson Avenue a distance of 21 . 23 feet to the Northwesterly extension of the Southwesterly line of Lot 14 , Block 1, James Eggers Addition; thence South 49°00' 59" East along said Northwesterly extension a distance of 20 . 00 feet; thence South 01°49' 50" East a distance of 87 . 98 feet to a point on the Northwesterly line of Lot 5, Block 2, James Eggers Addition that is 44 . 54 feet Southwesterly of the most Northerly corner of said Lot 5 ; thence South 05°45' 50" East a distance of 98 . 25 feet to a point on the Southeasterly line of the Northwesterly 11 feet inches of Lot 4 , Block 2, James Eggers Addition which is 111 . 86 feet Southwesterly of the most Easterly corner of the Northwesterly 11 feet 4 of said Lot 4 ; thence South 41°09' 59" West along said Southeasterly line a distance of 3 . 54 feet; thence North 49°00' 59" West parallel with the Southwesterly lines of said Lots 4 and 5 a distance of 71 . 77 feet to the point of beginning. This parcel contains 19, 624 square feet . Bearings are based on the Southwesterly line of Block 2 , James Eggers Addition, which is assumed to bear South 49°00' 59" East, all in the City of Waterloo, Black Hawk County, Iowa, subject to City' s retention of a utility easement over, under and upon the above described property; for $1 . 00, plus costs . 3 . That the City of Waterloo, Iowa, convey said parcels of real property to Manatt' s, Inc . , by deed. 4 . That the Mayor and Deputy City Clerk are hereby authorized to execute and deliver deed to Manatt' s, Inc . 5 . That the original of said deed fully executed and acknowledged is hereby approved and confirmed by the Council . 6 . That the Deputy City Clerk is authorized and directed to deliver said deed of conveyance to Manatt' s, Inc . , upon receipt of the sum of $1 . 00, and costs .
