BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA AS FOLLOWS: Section 1. That the Official Zoning Map referred to in Section 10-4-4 of Ordinance No. 5079 as amended, City of Waterloo Zoning Ordinance, be amended to approve a request by Mike Brustkern to rezone 1.50 acres from "A-1" Agricultural District to "R-2" One and Two Family Residence District located west of 3221 Osage Road, and legally described as follows: THAT PART OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER (SW 1/4 SW 1/4 ) OF SECTION NO. 28, TOWNSHIP NO. 89 NORTH, RANGE NO. 12 WEST OF THE 5TH PRINCIPAL MERIDIAN, BLACK HAWK COUNTY, IOWA, DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHWEST CORNER OF SAID SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER (SW 1/4 SW 1/4 ); THENCE S89°12'18"E ALONG THE SOUTH LINE OF SAID SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER (SW 1/4 SW 1/4 ) 996.55 FEET; THENCE N0°47'42"E 33.00 TO THE NORTH RIGHT-OF-WAY OF OSAGE AVENUE; THENCE CONTINUING N0°47'42"E 259.95 FEET; THENCE S89°12'18"E 255.14 FEET, THENCE S1°55'41"W 260.00 FEET TO SAID NORTH RIGHT- OF-WAY OF OSAGE AVENUE; THENCE N89°12'18" W 250.00 FEET ALONG SAID NORTH RIGHT-OF-WAY LINE OF OSAGE AVENUE TO THE POINT OF BEGINNING, CONTAINING 1.50 ACRES. That the final site plan meets all applicable city codes, regulations, etc. including, but not limited to,parking, landscaping, screening, drainage, etc. 2. That all new buildings be constructed to the requirements of the City of Waterloo Floodplain Regulations and the lowest floor elevation is at least 1' above the 100 Year Base Flood Plain Elevation. Section 2. That the City Clerk is hereby directed to file a certified copy of this Ordinance with the Recorder of Black Hawk County, Iowa.
