RESOLUTION NO. 2019-693 RESOLUTION APPROVING A PERMANENT EASEMENT AGREEMENT WITH GRANT D. AND DENISE A. SCHILDROTH, IN THE AMOUNT OF $163.98, TO ALLOW FOR THE CONSTRUCTION AND FUTURE MAINTENANCE OF A STORM SEWER, LOCATED DIRECTLY NORTHEAST OF 2047 CARDINAL DRIVE, AND AUTHORIZE THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT. WHEREAS, the Permanent Easement Agreement, dated September 9, 2019, of the hereinafter described parcel, is to allow for the construction and future maintenance of a storm sewer, located directly northeast of 2047 Cardinal Drive, and owned by Grant D. and Denise A. Schildroth. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the Permanent Storm Sewer Easement Agreement, between Grant D. and Denise A. Schildroth and the City of Waterloo, Iowa, in the amount of$163.98, for property located directly northeast of 2047 Cardinal Drive, to allow for the construction and future maintenance of a storm sewer, for the hereinafter described parcel, is accepted and approved: DESCRIPTION OF PERMANENT EASEMENT UNDER, ACROSS, AND UPON THAT PORTION OF LOT 66, AUDITOR'S WHITNEY ROAD PLAT AND THAT PORTION OF VACATED RALPH ROAD IN LOBDELL'S SECOND ADDITION TO CASTLE HILL, CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA, BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHEAST CORNER OF LOT 16, HANSMEIER'S ADDITION, SAID CORNER ALSO BEING ON THE WEST LINE OF LOT 66, AUDITOR'S WHITNEY ROAD PLAT; THENCE SOUTH 85°07'44" EAST 60.94 FEET ALONG THE NORTHERN MOST LINE OF A SURVEY RECORDED AS FILE NUMBER 2005 9881 IN THE RECORDS OF BLACK HAWK COUNTY; THENCE SOUTH 00°14'42" EAST 15.00 FEET ALONG THE NORTHERN MOST EAST LINE OF A SURVEY RECORDED AS FILE NUMBER 2005 9881; THENCE NORTH 85°07'44" WEST 60.96 FEET PARALLEL WITH THE SAID NORTHERN MOST LINE SHOWN OF THE SURVEY RECORDED AS FILE NUMBER 2005 9881 TO THE WEST LINE OF LOT 66; THENCE NORTH 00°17'40" EAST 15.00 ALONG THE SAID WEST LINE OF LOT 66, TO THE POINT OF BEGINNING CONTAINING 911 SQUARE FEET.
