HomeMy WebLinkAboutMinutes-10/28/2019COUNCIL WORK SESSION October 28, 2019 4:10 p.m. Harold E. Getty Council Chambers Members present: Feuss, Klein, Amos, Schmitt, and Juon. Absent: Jacobs. Mr. Morrissey participated in the meeting via telephone. Moved by Schmitt seconded by Amos that the Agenda, as proposed, be approved. Voice -vote Ayes: Six. Motion carried. Objective: Review of edits to Title 1 of the City Code. Council picked up discussion with Title 1 Article B: Censure. Mr. Feuss commented that he could go either way with the discussion Mr. Morrissey commented that he believes having censure in the rules of procedure is important. Consequences are in place for violating rules in existing at the state and federal level. Mrs. Kline commented that she wants to see the council drop the censure article, as it does not answer the fairness or unfairness of an accusation. She feels that political motives may be involved with bringing charges. Mr. Amos commented that he wants to continue with the discussion and something needs to be in place to hold fellow council members accountable. Mr. Schmitt commented that he sees this issue as being very divisive and wants to see the article removed from the code. Mrs. Juon commented that she believes this article is too complicated and would be interested in seeing some sort simplified process. Mayor Hart commented that there is a need for accountability as there is currently no due course for addressing an issue. Mrs. Kline commented that if she was the Mayor she would have directly asked the offender to explain themselves. Mr. Morrissey commented that the issue was brought up between beginning at the end of 2014 on into 2016, and it was discovered that there was no consequence for any kind of wrong doing by our city council and the rules and procedure don't address it. He further commented that council is not answerable to the Mayor, but to the people who elected council to office. He stated that he is in favor of continuing with censure rules. Mrs. Kline commented that she would prefer to see this start with a private admonishment by the Mayor's Office with 24 hours of it happening. Mrs. Juon questioned if a compromise could be bringing something to the Mayor's attention. Mr. Morrissey explained that the proposed censure wording does address the process for managing any violation of the rules by council or the mayor, and any consequences of the violation. Kelley Felchle, City Clerk, commented that council's comments show an interest in moving forward but with certain edits and requested clarification on a suggestion made by Mrs. Klein. Mrs. Klein provided an explanation. Page 2 Objective: Discussion of changes to the refuse and recycling ordinance. Randy Bennett, Public Works Division Manager, provided an update on converting to the new recycling program including public outreach and education about the program, the current refuse and recycling ordinance, and the proposed changes to the ordinance. Mrs. Juon questioned at what point the 11,000 carts would arrive to keep the program voluntary. Randy Bennett explained that he hopes that they would see the number hit 11,000 before March. Mrs. Juon requested clarification on advanced payment for additional services and whether transaction fees would be billed for. Randy Bennett commented that the council can discuss fees and payment for services at a later time as fees are managed by resolution and therefore completely flexible. With no further business before the Council, it was moved by Schmitt seconded by Feuss that the meeting be adjourned at 5:08 p.m. Voice -vote Ayes: Six. Motion carried. Kelley Felch City Clerk
