ORDINANCE NO. 4935 AN ORDINANCE AMENDING THE 2007 CODE OF ORDINANCES OF THE CITY OF WATERLOO, IOWA, BY REPEALING CHAPTER 3, ELECTRICAL REGULATIONS, OF TITLE 9, BUILDING REGULATIONS; AND ENACTING IN LIEU THEREOF A NEW CHAPTER 3, ELECTRICAL CODE, OF TITLE 9, BUILDING REGULATIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: That Chapter 3, Electrical Regulations, of Title 9, Building Regulations, of the 2007 Code of Ordinances of the City of Waterloo, Iowa, and the Waterloo Electrical Code (Ordinance No. 2071, as amended), are hereby repealed in their entirety; that a new Chapter 3, Electrical Code, of Title 9, Building Regulations, of the 2007 Code of Ordinances of the City of Waterloo, is hereby enacted in lieu thereof as follows: CHAPTER 3. ELECTRICAL CODE ARTICLE 1. ELECTRICAL REGULATIONS, GENERALLY Sec. 9-3-1. Title. This ordinance shall be known as the Waterloo Electrical Code, may be so cited and may be referred to hereinafter as the "Code" . Sec. 9-3-2. Purpose and scope. It is the purpose of this ordinance to adopt an electrical code by reference, to provide for the examination, qualification and licensing of electrical contractors, electrical appliance dealers, journeyman electricians,' and= appliance wiremen, also including provisions for the Anspection and regulation of electrical installation, issuance of permits, the collection of fees, and to provide penalties for violations of this ordinance in order to protect the public health, safety and welfare. The provisions of this code shall apply to and govern all uses, installations, alterations, repairs, removals, renewals, replacements, connections, disconnections, and maintenance of all electrical equipment within the City of Waterloo, Iowa. Sec. 9-3-3. Definitions. The following words, terms and phrases, when used in this Code, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: (a) Appeal board means the board created in section 11-31. (b) Appliance dealer means undertaking, or offering to undertake, the planning and installation, alteration and repair of heating .-arid'=cooling systems to existing 4 Ordinance No. 4935 Page 2 circuits or services, and the employment, management, supervision, and control of appliance wiremen doing appliance wiring work. (c) Appliance wireman means any person performing electrical work on heating and 'cooling systems under the direction of an appliance dealer. (d) Approved by the electrical inspector means found by the inspector to comply with the requirements of this ordinance and, in the absence of such requirements, found by the inspector to be safe in respect to life and property as measured by the standards established in this ordinance and the National Electrical Code and National Fire Protection Association Standards. (e) Electrical contracting means undertaking, or offering to undertake, the planning and installation of electrical systems and equipment and the employment, management, supervision and control of electricians and apprentice electricians doing electrical work. (f) Electrical contractor means any person responsible for the activity of planning, or supervising electricians and apprentices doing., electrical wiring, work, or equipment installations -and connections to apparatus which is or will be conn-e(.aed`to an electric light and power source. (g) Electrical equipment means all electrical materials, wiring, conductors, fitting, conduits, devices, appliances, fixtures, signs and apparatus or parts thereof comprising an electrical system or control of such system. (h) Electrical maintenance work shall mean the repair of the existing electrical equipment, or limited replacement and extensions of branch circuits as determined by the Chief Electrical Inspector. (i) Electrical work means all installations, alterations, repairs, removals, replacements, disturbances, connections, disconnections and maintenance of wiring and electrical equipment, or control of any of the above, over 25 volts, and wiring systems through or by which is conveyed or intended to be conveyed, electrical current in,- above, or under any building, structure, tent or premise,, public or privately owned, in the City of Waterloo, Iowa. (j) Electrician means any person doing electrical work for an electrical contractor. (k) Examining board means the board created in section 11- 31. (1) Licensed or qualified person means any person who has been examined and licensed by the examining board and has its approval to install, remove, alter or make additions to any electrical work in the city. r Ordinance No. 4935 Page 3 (m) Shall means that the act to be performed is mandatory. Sec. 9-3-4. Rules of construction. In this ordinance certain terms shall be construed as follows: (a) Electrical terms are definitions relating to electrical equipment, wiring methods and special wiring locations and conditions shall be those accepted by the trade and listed in the National Electrical Code or other recognized safe wiring manuals or tests. (b) Building classification and occupancy shall be determined from the city building code and the city zoning ordinance. Sec. 9-3-5. National Electrical Code adoption. (a) The 2008 Edition of the National Electrical Code, including Article 90, Chapters 1 through 9, and Annex A, B, C, D and H, inclusive, as published by the National Electrical Code Committee, and adopted by the National Fire Protection Association, is hereby adopted by reference and is effective as if fully set forth in this article. Where, in any specific case, different sections of this article specify different materials, methods of construction or requirements, the most restrictive shall govern. Section 2. Section 11-6, National Electrical Code Amendments, of Article III, Electrical Regulations, of Chapter 7, Buildings, of the Code of Ordinances of the City of Waterloo, Iowa, is hereby repealed in its entirety, and new Section 11-6, National Electrical Code Amendments, of Article III, Electrical Regulations, of Chapter 7, Buildings and Building Regulations, is enacted in lieu thereof, as follows Sec. 9-3-6. National Electric Code -'Amendments. The provisions of this section specify certain amendments, by deletion, addition or substitution of the 2008 edition of the National Electrical Code. Where this section states that an article, subsection, enumeration or exception is deleted, only the specific article, subsection, enumeration or exception is deleted. Where this section states that an article or subsection is deleted in its entirety, all references listed thereafter associated with the specific article (with subsections, enumerations and exceptions) or subsection (with enumerations and exceptions) are deleted. (a) Amendments to 2008 NEC Chapter 2 Amendments: (1) 210.8 (A), Dwelling Units, of the 2005 edition of the National Electrical Code with any appropriate editing for cross references. (2) 210-11 (C)(3), Bathroom Branch Circuits, is amended by deleting_ the italicized paragraph entitled "Exception"'in its entirety. r Ordinance No. 4935 Page 4 (3) 220-61 (C) Prohibited Reductions, is amended by adding the following subparagraph: (3) Reduction of neutral or grounded conductor is allowed only under the direct supervision of an electrical engineer. (4) 230-30 Insulation, is amended by deleting the italicized paragraph entitled "Exception" (1) through (4) in its entirety, and adding the following new unnumbered exception: Exception: A grounded conductor shall be permitted to be uninsulated if it is part of a service entrance cable assembly. (5) "230-43. Wiring Methods for 600 Volts, Nominal, or Less, is amended by deleting items (1) and (6), and by adding the following as a new unnumbered paragraph at the end of the enumerated paragraphs: "Only items (3) Rigid metal conduit and (4) Intermediate metal conduit may be concealed." (6) 230-50(A) Underground Service Entrance Conductors is deleted in its entirety and the following sentence is subst'ituted therefore: "Service lateral conductors'shall``be installed in a raceway not less than two feet underground." (7) 250.4 General Requirements for Grounding and Bonding, is amended by adding the following item: "(C). Raceway and Cable Grounding. All raceways and cables shall have an equipment -grounding conductor. Exceptions: service cable and raceways, rigid metal conduit, intermediate metal conduit and electrical metallic tubing." (8) 250.52(a)(5) Rod and Pipe Electrodes, is deleted in its entirety and the following is substituted therefore: "Rod electrodes shall be not less than 2.5 m (8 ft) in length, not less than 15.87 mm (5/8 in.) in diameter, and shall be copper clad or equivalent." (9) 250.70 Methods of Grounding and Bonding Conductor Connection to Electrodes, is amended by deleting item (1), deleting from item (2) the words, "or plain or malleable. iron," and renumbering the remaining items as items (1) through (4). 2008 NEC Chapter 3 Amendments (1) 300.13(B) Device Removal, is deleted in its entirety and the following is substituted therefore: "(B) Device Removal. In all circuits the continuity of conductors shall not be dependent r Ordinance No. 4935 Page 5 upon device connections where the removal of such devices would interrupt continuity." (2) 310.2(B) Conductor Material, is amended by adding the following sentence at the end: "Service Grounding conductors shall be of copper and shall be insulated." (3) Table 310.15(b)(6) 120/240 -Volt, 3 -Wire, Single - Phase Dwelling Services and Feeders), is deleted in its entirety. Sec. 9-3-7. Requirements for existing residential type buildings. It is prohibited by this ord:n_ance to perform any repair, add to, or revamp any residential..,service less than 60 ampere electrical service without meeting the requirements of this section and other parts of this ordinance. All other services replaced or upgraded shall be required to also meet the requirements of this section and other parts of this ordinance. Article 110-26, subsection (e) Headroom, is amended by deleting the exception contained therein. (a) Minimum service size for a single-family dwelling with panel board receptacle: (1) 100 amperes for a three -wire service to a dwelling. The panel shall have a minimum of 20 spaces for branch circuits, and one main disconnecting means. (2) 200 amperes for a three -wire service to a dwelling. The panel shall have a minimum of 30 spaces for branch circuits, and one main disconnecting means - 2008 NEC Annex H (b) 89.9(C) Additions, Alterations, or Repairs. Additions, alternations, or repairs to any building, structure, or premises shall conform to that required of a new building without requiring the existing building to comply with all the requirements of this Code. Additions, alternations, installations, or repairs shall not cause an existing building to become unsafe or adversely affect the performance of the building as determined by the authority having jurisdiction. Electrical wiring added to an existing service, feeder, or branch circuit shall not result in an installation that violates the provisions of the Code in force at the time the additions are made. Sec. 9-3-8. Penalty, abatement of violations. (a) Any person violating any provision of this ordinance shall be deemed guilty, ,(Df a municipal infraction and, upon conviction thereof,shall be punished accordingly. (b) If any electrical work, including construction or Y Ordinance No. 4935 Page 6 repair, is performed within the city contrary to the provisions of this ordinance, it shall be deemed a municipal infraction and, in addition to penalties described, shall be abated in accordance with this ordinance. (c) The doing of any act prohibited or declared to be unlawful, an offense or .a municipal infraction by this ordinance or the National Electrical Code, or the omission or failure to perform any act or duty required by this ordinance or the National Electrical Code, is, unless another penalty is specified, punishable as provided in sections 1-15 through 1-17 of the Waterloo code. Sec. 9-3-9. Applicability of ordinance to existing buildings. (a) If any existing building is damaged due to fire, natural disaster or otherwise, the areas that are damaged shall be brought up to current city and national codes. If other areas of the building are altered or repaired due to damages that occurred, these areas must also be brought up to the current codes. (b) If the type of occupancy of an existing building is partially or entirely changed, the electrical wiring shall be made to conform to the requirements of the current city and national codes for the new type of occupancy. Sec. 9-3-10. Moved buildings. (a) Residential moved buildings shall be brought into compliance with the electrical requirements of existing residential -type buildings, section 11-7. (b) Electrical systems in any other moved buildings shall be brought into compliance with the provisions of this Code the same as for new construction. (c) The permanent service connection shall not be made by the power company until the electrical system is completely installed, and is approved by the inspector. (d) The existing service on the moved building shall not be connected to the .electrical power source unless specifically approved by''a.,n inspector. Sec. 9-3-11. Disclaimer. This ordinance shall not be construed to affect the responsibility or liability of any party owning, operating, controlling or installing any electrical equipment for damages to persons or property caused by any defect therein, nor shall the city be held as assuming such by reason of the inspection or reinspection authorized in this ordinance or the certificates of approval issued as provided in this ordinance, or by reason of the approval or disapproval of any equipment authorized in this ordinance. V Ordinance No. 4935 Page 7 Sec. 9-3-12. Liability of electrical inspector. The electrical inspector, acting in good faith and without malice in the discharge of his/her duties, shall not thereby render himself/herself liable personally and he/she hereby is relieved from all personal liability for any damage that may accrue to person or property as a result of any act required or by reason of any act of omission in the discharge of his/her duties. Any suit brought against the city because of such act or omission performed by him/her in the enforcement of any provisions of this ordinance shall be defended by the city. Sec. 9-3-13. Use of listed equipment required. It is intended by this ordinance that, wherever any electrical equipment or utilization -equipment is used, it shall first have been tested, listed,: and ':stamped by Underwriters' Laboratories, Inc., or by another recognized testing laboratory. Sec. 9-3-14. Unlawful connections. It shall be unlawful for any person to make connection from a supply of electricity to any electric equipment that has been installed or which has been disconnected or ordered to be disconnected by the electrical inspector, until inspected and approved by the electrical inspector. Sec. 9-3-15. Inspection of wiring required prior to installation of meter. It shall be unlawful for any person to set a meter for electric purposes to any building or premises, wiring of which has not been inspected and approved by the electrical inspector. A violation of this section will cause the electrical inspector to give written notice and immediately cause the removal of such conditions and the discontinuance of such current. Sec. 9-3-16. Alteration of identifi'dation or rating markings. It shall be unlawful to cover, remove, alter, change or deface the maker's name or identification mark or any of the rating markings on electrical equipment. Secs. 9-3-17 to 9-3-30. Reserved. ARTICLE 2. BOARD OF ELECTRICAL EXAMINERS AND APPEALS Sec. 9-3-31. Membership; appointment of members; term of office. (a) Establishment of the Board. There is hereby established a Board of Electrical Examiners and Appeals, hereinafter referred to as the "Board," with authority and responsibility as follows: (1) Authority to qualify and license a person as a master electrician, master appliance wireman, journeyman electrician or appliance wireman. (2) To act as a Board of Appeals as provided in the Waterloo Electrical Code. 11 Ordinance No. 4935 Page 8 (3) To periodically review the provisions of the Waterloo Electrical Code and make recommendations to the Building Official for improving and updating said documents. (b) Composition of the Board:.The Board shall consist of five (5) members, all of whose place of business, residence, or work is located in the City of Waterloo. All members shall be qualified by experience and training to pass judgement upon matters pertaining to electrical construction. The membership shall be as follows: Two licensed electrical contractors, one licensed, working electrician, a representative from a public utility company furnishing electrical power to the City, one electrical engineer capable of designing systems governed by this code. The electrical inspector shall serve as secretary to the Board. Said Board shall serve without compensation. (c) Appointment of Members and Terms of Office. The members of the Board of Electrical Examiners and Appeals shall be appointed by the Mayor with the approval of the City Council. After initial appointment of the Board the terms of the members shall be for three years except that the initial terms shall be so arranged and staggered so that the terms of no more that two members shall expire any one year; A vacancy within any term shall be filled by appointment of the Mayor with the approval of the City Council for the unexpired portion of that term only. Sec. 9-3-32. Powers and duties of the Board. The Board of Electrical Examiners and Appeals shall have the following powers and duties: (a) To prescribe rules for the conduct of examinations of applicants for licenses. (b) To hold regular meetings twice each year, or more frequently if determined necessary, for the purpose of conducting examinations of applicants for electrical licenses or electrical appeals. (c) To examine applications and applicants for licenses as master electricians, master appliance wiremen, journeyman electricians.iand appliance wiremen. (d) To act upon reports of violations by licensed master electricians, master appliance wiremen, journeyman electricians and appliance wiremen as filed by the electrical inspector with the Board. (e) To prescribe rules consistent with the provisions of this code for hearings before the Board to suspend, revoke or reinstate licenses. (f) To suspend or revoke any license, by majority votes of all members of the Board, for repeated violations of this code, but only after the person charged with a violation has been afforded the opportunity to be heard u Ordinance No. 4935 Page 9 in his/her own defense. (g) To keep a complete record of the official proceedings of the Board; to preserve all documents, books and papers relating to appeals, examinations for licenses, and hearing of complaints and charges for at least three years. (h) To hear appeals from the, decision of the electrical inspector and to rule on interpretations of the provisions of the Waterloo Electrical Code, and to determine the suitability of alternate materials and methods of construction consistent with the provisions of the Waterloo Electrical Code. Sec. 9-3-33. Meetings; records. (a) All meetings of the Board of Electrical Examiners and Appeals shall be held in the council chambers, or other location indicated in a public notice posted 24 hours prior to any meeting. (b) Three members .of the board shall constitute a quorum for the transacting of all business, but any action taken by the Board shall require a majority vote of all members of the Board. (c) The Board shall annually elect one of its members as chairperson of the Board. (d) The secretary of the Board shall keep a record of the Board meetings and register the names and residences of all persons examined by the Board and the kind of electrical license issued to each, if any. Sec. 9-3-34. Right of appeals. Any person shall have the right to appeal any decision of the electrical inspector to the Electrical Board of Examiners and Appeals by filing a written notice of such appeal with the electrical inspector within ten (10) days from the date of the inspector's decision. The Board shall forthwith fix a time and place of hearing such appeal which shall not be less than five (5) days nor more than fifteen (15) days after the date of filing of the notice of such appeal, and the electrical inspector shall notify the appellant in writing by registered mail of the time and place of such hearing. After the hearing of said appeal, the Board may sustain or overrule the decision of the electrical inspector. Decision of the Board shall be final unless appealed to the courts as by law provides. Secs. 9-3-35 to 9-3-50. Reserved. ARTICLE 3. ELECTRICAL INSPECTOR Sec. 9-3-51. Appointment; qualifications. (a) The electrical inspector is hereby authorized, directed and empowered to inspect any and all buildings, structures, tents and premises, public and private, Ordinance No. 4935 Page 10 and, as provided in this ordinance, to condemn and order removed or remodeled and put into proper and safe condition for the prevention of fire and for safety to life and property, all electrical equipment installations and connections of electrical current for light, heat and power I purposes, and to control the disposition and arrangement of such equipment so that persons and property shall not be in danger therefrom. (b) The electrical inspector shall have successfully passed any and all examinations administered by the Civil Service Commission, have been recommended to said position by the Building Official, appointed by the Mayor, and confirmed by the majority of all members of the City Council. (c) The appointee shall: (1) Be a qualified electrician and shall have at least five years of practical experience in the electrical trade or five years of experience as an electrical inspector, or, in lieu of such experience, shall be a graduate in electrical or mechanical engineering of a college or university considered by the Personnel Director as having suitable requirements for graduation and shall have had two years'of practical electrical experience; (2) Be possessed of such executive ability as requisite for the performance of required duties and have thorough knowledge of the standard material and methods used in the installation of electrical equipment; and (3) Be well versed in improved methods of construction for safety to persons and property, the statutes of the state relating .to electrical work and any orders, rules and regulations issued by authority thereof, and in the National Electrical Code. (d) The electrical inspector shall hold a current journeyman electrical license with the city or shall be required to pass an examination for journeyman prior to his/her appointment. (e) He/she shall hold membership in the International Association of Electrical' -Inspectors and the National Fire Protection Association. Sec. 9-3-52. Conflict of interest. It shall be unlawful for the electrical inspector or assistant electrical inspectors to engage in the business of the sales, installation or maintenance of electrical equipment, either directly or indirectly, and they shall have no financial interest in any concern engaged in such business in the city of Waterloo, at any time, while holding said offices. Ordinance No. 4935 C: Page 11 Sec. 9-3-53. Records. The electrical inspector shall keep or cause to be kept records of all permits issued and inspections made and all other business of his/her office. The records shall be available to the public. A list of inspected electrical equipment issued by Underwriters' Laboratories, Inc., shall be kept on file and accessible to the public during regular office hours. Sec. 9-3-54. Interpretation of regulations. The electrical inspector shall have full power to exercise judgment in a reasonable and proper manner and rule accordingly on all special cases in regard to any matters in this ordinance or not specifically covered thereby, subject to section 11-34, pertaining to appeals. Sec. 9-3-55. Right of entry. Whenever necessary to make an inspection to enforce any of the provisions of this ordinance, or whenever the electrical inspector or his/her authorized representative has reasonable cause to believe that there exists in any building or upon any premises any condition which makes such building or premises unsafe, the electrical inspector or his/her authorized representative may enter such building or premises at all reasonable times to inspect the building or premises or to perform any duty imposed upon the inspector by this ordinance, provided that, if such building or premises are occupied, he/she shall first present proper credentials and request entry, and if such building or premises are unoccupied he/she shall first make a reasonable effort to locate the owner or other persons having charge or control of the building or premises and request entry. If such entry is refused, the electrical inspector or his/her authorized representative shall have recourse to every remedy provided by law to secure entry. In case of an emergency involving hazard or danger to life 'or.property, the electrical inspector shall take immediate action'to alleviate the hazard from the faulty electrical system. Secs. 9-3-56 to 9-3-70. Reserved. ARTICLE 4. LICENSING Sec. 9-3-71. Licenses required. (a) Unless otherwise specified, any reference to licenses in this Ordinance shall mean a license issued by the City of Waterloo or the State Electrical Board. (b) No person or business entity shall engage in any business which does or performs electrical work unless such person or business entity has obtained an electrical contractor's license issued by the City or the State Electrical Board. (c) No person or business entity shall engage in any business which does or performs appliance wiring work unless such person or -business entity has obtained a City of Waterloo appliance contractor's license or Ordinance No. 4935 Page 12 Special Electrician License from the State Electrical Board pursuant to this chapter. (d) No person or business entity holding an electrical contractor's license shall employ any person to do any electrical work unless such -employee holds a master electrician's license or"` a journeyman electrician's license issued by the City or State pursuant to this chapter, except that any person not so licensed shall be classed as an apprentice or helper, and shall be permitted to work on the same job site with a licensed master electrician or licensed journeyman electrician present at all times, at a ratio of not more than three apprentices or helpers to one licensed master electrician or journeyman electrician. (e) No person or business entity holding an appliance contractor's license shall employ any person to do appliance wiring work unless such employee holds a master appliance wireman's license or a State Special Electrical License or an appliance wireman's license issued by the City or State pursuant to this chapter, except that any person not so licensed shall be classed as an apprentice or helper, and shall be permitted to work on the same job site with a licensed master appliance wireman or licPnsed:appliance wireman present at all times, at a ratio of not more than three apprentices or helpers to one licensed master appliance wireman or appliance wireman. Sec. 9-3-72. Application for license; examinations generally. (a) Any person desiring to be examined for a license as a master electrician, special electrician license or journeyman electrician shall make application therefore to the State Electrical Board. (b) No NEW master electrician, journeyman or appliance wireman licenses will be issued after January 1, 2009. Only existing Waterloo licenses or State of Iowa Class A licenses will be accepted by the City of Waterloo. A State of Iowa Class B license will be accepted by the City of Waterloo if the electrician has held a Waterloo license after January 1, 1990. Existing City of Waterloo licenses will be re -issued to the electrician if the electrician chooses not to get a State of Iowa electrical license. (c) Existing license fees will apply for electricians choosing to renew current City of Waterloo electrical licenses. If you have a new State of Iowa electrical contractor's license and wish to pull a permit in the City of Waterloo, a one-time registration fee of $150.00 will be charged if you have never held a City of Waterloo license. Sec. 9-3-75. Reciprocity. (a) Any person who holds a valid State of Iowa Class A Master Electrician license, Class A Journeyman Electrician license, or State of Iowa Special t Ordinance No. 4935 Page 13 Electrician license allowed to work in current ordinances. issued by the State of Iowa will be the City of Waterloo under the Sec. 9-3-76. Electrical Contractor's license. (a) In order to hold an electrical contractor's license under this chapter, the business entity shall at all times have an owner or employee of the business entity who is actively involved in the business and who holds a master electrician's license. Every business entity shall certify the name of such owner or employee to the electrical inspector upon request, and in no event any less often than annually. Such owner or employee shall be designated as the master electrician of record for such business entity. If at any time the business entity fails to have an owner or employee who meets the requirements of this subsection, the business entity shall immediately notify the electrical inspector of that fact, and such business entity shall immediately cease performing any electrical work until the business entity again has an owner or employee who meets the requirements of this subsection. (b) Each electrical contractor shall file a certificate of insurance as specified in Section 11-82 of this ordinance at least annually. (c) Each electrical contractor shall pay a fee for said license in an amount established annually by resolution of the City Council. (d) If the electrical contractor holds a State of Iowa license, a one-time registration fee of $150.00 will be charged. Sec. 9-3-77. Appliance Contractor's license. (a) In order to hold an appliance contractor's license under this chapter, a business entity shall at all times have an owner or employee of the business entity who is actively involved in the business and who holds a master appliance wireman's license. Every business entity shall certify the name of such owner or employee to the electrical inspector upon request, and in no event less than annually. Such owner or employee shall be designated as the master appliance wireman of record for such business entity. If at any time the business entity fails to have an owner or employee who meets the requirements of this subsection, the business entity shall immediately notify the electrical inspector of that fact, and such business entity shall immediately cease performing any appliance wiring work until the business entity again has an owner or employee who meets the requirements of this subsection. (b) Each appliance contractor shall file a certificate of insurance as specified; `:_"fin' -Section 11-82 of this ordinance at least annual's. Ordinance No. 4935 Page 14 (c). Each appliance contractor shall pay a fee for said license in an amount established annually by resolution of the City Council. Sec. 9-3-78. Master electrician`icense.` (a) A master electrician is a person who has the necessary experience as described ,in Section 11-72 and who has demonstrated the ability 'and experience to plan and supervise journeymen electricians and apprentices doing electrical work. (b) All persons who held a valid electrical contractor's license issued by the City as of May 22, 2000, shall be deemed to meet the requirements of a master electrician and shall be eligible for a master electrician's license upon paying the necessary fee for said license as provided in this chapter. (c) A master electrician may be the master electrician of record for no more than one electrical contractor. He or she shall provide written documentation establishing that said person is an owner or employee who is actively involved in the business of such electrical contractor. (d) A master electrician who' holds a valid license under this chapter shall be authorized to perform any electrical work. (e) The fee for a master electrician's license shall be in such amount as is established annually by resolution of the City Council. Sec. 9-3-79. Master Appliance Wireman License. (a) A master appliance wireman is a person who has the necessary experience as described in Section 11-72 and who has demonstrated the ability and experience to plan and supervise appliance wiremen and apprentices doing appliance work. (b) All persons who held a valid appliance dealer's license issued by the City as of (put in date ordinance is approved) shall be deemed to meet the requirements as a master appliance wireman's license upon paying the necessary fee for said license as provided in this chapter. (c) A master appliance wireman. may be the master appliance wireman of record for no more than one appliance contractor. He or she shall provide written documentation establishing that said person is an owner or employee who is actively involved in the business of such appliance contractor. (d) A master appliance wireman who holds a valid license under this chapter shall be authorized to perform any appliance wiring work. Ordinance No. 4935 Page 15 (e) The fee for a master appliance wireman shall be in such amount as is established -annually by resolution of the City Council. Sec. 9-3-80. Journeyman Electrician License. (a) The person who holds a journeyman electrician's license is permitted to perform any electrical work under the direction of a master electrician who is an owner or employee of the electrical contractor by whom the journeyman is employed. (b) The fee for a journeyman electrician's license shall be in such amount as is established annually by resolution of the City Council. Sec. 9-3-81. Appliance Wireman's License. (a) A person who holds an,,a,pplia,n.ce wireman's license is permitted to perform any, appliance wiring work under the direction of a master appliance wireman who is an owner or employee of the appliance contractor by whom the appliance wireman is employed. (b) The fee for an appliance wireman's license shall be in such amount as is established annually by resolution of the City Council. Sec. 9-3-82. Conditions of certificates of insurance. (a) Any firm or corporation installing, removing, altering, or making addition to any electrical equipment in the City of Waterloo shall execute and file with the Waterloo Building Official (or a specified inter- governmental agency if so designated by the Building Official) a Certificate of Insurance written by a company authorized to transact business in the State of Iowa, in limits of no less than Three Hundred Thousand Dollars ($300,000.00) combined single limit to any person and One Hundred Thbusand Dollars ($100,000.00) property damage; said Certificate to be written on a standard form and carrying an endorsement naming the City of Waterloo, Iowa, and its employees (or the inter -governmental agency designated by the Building Official) as additional insureds as its interest may appear and conditioned upon the faithful performance of all duties required of such contract by any ordinances, rules and regulations of the City of Waterloo, Iowa. It shall be a further condition of said Certificate of Insurance that the obligator will hold the City (through the specified inter -governmental agency if so designed) harmless from any and all damages sustained by reason of neglect or incompetency on the part of such contractor, his/her agents or employees in the performance of the work done under a license or permit issued upon the filing of said Certificate. (b) Said Certificate of Insurance shall be issued by the 31st day of December of each year, and shall be refiled on or before said date for each subsequent year and shall be in continuous full force and effect. That it Ordinance No. 4935 Page 16 is the intent and purpose of said Certificate of Insurance to also bind the individual, company, firm, association or partnership, whether it be trade name, corporation, or other:;. business association or arrangement with which the:>principal is associated. Sec. 9-3-83. Expiration and renewal of license; display; transfer. (a) All licenses issued under this ordinance shall expire on December 31 of each year and may be renewed by the holder upon application and payment of the required fee, and certificate of insurance where applicable, at any time within the 30 -day period prior to December 31. Any license not renewed prior to December 31 shall expire 30 calendar days thereafter and shall not be renewed without examination, except on the recommenda- tion of the Board of Electrical Examiners and Appeals. If the Board approves the renewal of the license without re-examination, the license shall be renewed after payment of a double fee. (b) Code update certificate - Renewal of a Waterloo Master Electrician license and a Journeyman Electrician license shall require­'eachapplicant to attend and complete an approved `ei4ht=hour National Electrical Code (N.E.C.) update class within twelve months of January 1st of the date on the latest N.E.C. book. A certificate of completion must be submitted to the Electrical Inspection Office before licenses will be renewed. (c) The validity and right of renewal shall be dependent upon strict compliance by the licensee with all city ordinances, and upon the payment of all fines and penalties which are required as a consequence of violations of city ordinances. (d) Every holder of an electrical contractor's license or appliance dealer's license shall keep his/her license displayed in a conspicuous place in his/her places of business at all times. (e) Licenses are not transferable, nor shall they be loaned or rented. Secs. 9-3-84 to 9-3-100. Reserved ARTICLE 5. PERMITS, FEES, INSPECTIONS AND METERING LOCATIONS Sec. 9-3-101. Permit required; conditions; exceptions. (a) Work requiring permit or approval. An electrical permit or prior approval from the electrical inspector is required before commencing the installation or alteration of any wiring system through or by which is conveyed or intended to be conveyed, electrical current for power, heating, cooling or illuminating purposes or control of any of the above, over 25 volts, in, on or under any building, structure, tent or premises, public Ordinance No. 4935 Page 17 or privately owned. There shall be no removal, replacement, alteration or addition made in any such existing equipment without first making application to the electrical inspector and obtaining the required permit therefor, except as provided in section 11- 101 (g), "Minor Repairs". (b) Application for permit. Except as otherwise provided, all persons applying for a permit under this ordinance shall be duly licensed. Applications for permits shall be filed with the Building Department, in writing. All permits in all buildings of more than one (1) occupancy shall be applied for by separate applications. Such application(s) shall describe the material and equip- ment desired to be used aiid the location by street and number where such material and equipment is to be installed. The application(s) shall show the name of the owner. (c) Electrical plans and specifications. If required by the Plan Review Specialist, one or more copies of specifications and of plans drawn to scale with sufficient clarity and detail to indicate the nature and character of the work, shall accompany the application. All plans and specifications shall contain information in the form of notes or otherwise, as to the proposed occupancy, contemplated electrical loads, both lighting and power, proposed entrance service equipment, feeder and branch circuits, special circuits and distribution equipment. Such information shall be specific, shall state wire sizes, and this code shall not be cited as a whole or in part, nor shall the term legal or its equivalent be used as a substitute for specific.information. Exception: Plans and specifications need not be submitted for small, minor work when authorized by the Building Official. (d) Permits. If the Building Official/Plan Review Specialist is satisfied that the work described in an application for permit and the plans filed therewith conform to the requirements of this code and other pertinent laws and ordinances, he/she shall issue a permit therefor. A permit issued shall be construed as approval to proceed with the work but shall not be construed as authority to violate, cancel, alter, or set aside any of the provisions of this code, nor shall such issuance of a permit prevent the electrical inspector from thereafter requiring a correction of error in plans or in construction, or of violations of this code. (e) False statements in application or plans. The Building Official shall revoke any permit or approval issued under the provisions of this ordinance in case of false statement, misrepresentatlon''or negligence as to a material fact in the application or plans on which a permit or approval was based. Ordinance No. 4935 Page 18 (f) Expiration of permit. Every permit issued shall expire by limitation and become null and void if the work authorized by such permit is not commenced within 60 days from the date of approval of the application, or if the work is suspended or abandoned at any time after work is commenced for a period of 120 days, except for conditions beyond the applicant's control such as weather, strikes, etc. Before such work can be re- commenced, a new permit shall first be obtained to do SO. The fee shall be one-half of the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work; and provided further that such suspension or abandonment did not exceed one year. (g) Minor repairs. A permit is not required for replacement of lamps, connection of electrical equipment by attachment cord and cap to permanently installed receptacles or the replacement of faulty equipment the cost of which does not exceed $125.00. Sec. 9-3-102. Permit for installation by homeowner. In cases where the owner desires to install electrical equipment in the residence in wh-ipfl. tithe owner lives, the owner shall appear before the electrical`' inspector and show competency in the installation of electrical equipment. Upon such showing of competency, a permit application may be submitted and, upon approval and payment of required 'fees, an electrical permit shall be issued. Such permit authorizes the owner only to install electrical equipment in the dwelling owned and occupied by the owner, without license or certificate of insurance, and without help from persons other than family members. Sec. 9-3-103. Annual permit. All firms, corporations and government agencies such as hospitals, schools, industrial plants, etc., which regularly employ one or more full time maintenance electricians shall make application for and be issued an annual permit for work performed on existing electrical systems, including installation, maintenance and equipment rearrangement, covering power, light signals, electric consuming and generating equipment and devices in or on the premises owned or occupied bythe holder as described in the permit. This do not allow holder to perform any new electrical installation work. All work performed shall be subject to the following conditions: (a) An annual fee shall be paid, in the following amounts: 1-5 electrical maintenance employees, inclusive -- amounts as established by City Council. 6-10 electrical maintenance employees, inclusive -- amounts as established by*City Council. 11 or more electrical maintenance employees --amounts as established by City Council. (b) The filing of a certificate of insurance as required by section 11-80. Ordinance No. 4935 Page 19 (c) The maintenance electricians, who shall be competent in the safe installation, extension, maintenance and repair of electrical systems and equipment, shall be designated by name. The electrical inspector shall be informed of changes of. personnel. (d) All work done shall be in conformity with applicable provisions of this ordinance and any further regulations or requirements of the state. (e) A record of all work performed under the permit shall be kept, and shall be accessible to the electrical inspector at all reasonable times. (f) The electrical inspector shall have the unrestricted right to check the premises of the permit holder at any reasonable time, unless;prohibited by government regulations. Sec. 9-3-104. Fees. (a) Payment of fees for electrical permits shall be made on or before the tenth day of the month following the date of application for the permit or the date of the statement from the electrical inspector. All fees shall be paid to the electrical inspector, and be payable to the City of Waterloo. The inspector shall receipt for the fees in duplicate, and one of the receipts shall be filed in the office of the elec- trical inspector and the other given to the appli- cant. Failure to comply with the fee payment schedule will automatically cause the person to cease work. (b) Inspection fees shall be paid in such amounts as established by Resolution by the city council. Sec. 9-3-105. Inspections. (a) When any electrical equipment is to be hidden from view by the permanent placement of parts of the building or cover of a trench, the person installing the equipment shall notify the electrical or combination inspector, and such equipment shall not be concealed until it has been inspected and approved by the electrical inspector, or until 48 hours, exclusive of Saturdays, Sundays and holidays, has elapsed from the time of such notification. (b) On large installations, where the concealment of equipment proceeds continuously, the person installing the electrical equipment shall give the electrical inspector due notice and inspections shall be made periodically during the progress of the work. (c) The electrical or combination inspector shall have authority to cause the removal of any cover which may prevent the proper inspection of any electrical equipment. (d) The installation of any electrical equipment contrary to the provisions of this ordinance or in a dangerous 5 Ordinance No. 4935 Page 20 or unsafe manner shall be stopped immediately upon posted notice from the electrical inspector. A written notice shall be given to the owner of the property or the owner's agent, to the person in possession or to the person doing the work, and shall state the conditions' under which the work may be resumed. (e) Upon the completion of any installation of electrical equipment, the person making the installation shall notify the electrical or combination inspector. The inspections required are rough -in for new work and rewires, wire pull in raceway systems and services, and finals for new work, rewires and services. (f) The electrical or combination inspector, after making an inspection, shall post a notice of approval or rejection with required corrections and notice to recall for inspection after corrections have been made. Sec. 9-3-106. Entrance services and meters. (a) Before installing any service entrance conductors, a service spot and meter location is required. The electric utility will"'furnish, install and maintain all meters through < wh" ch service is supplied. Service point of attachment will be located by electric utility employees. (b) Residential electrical meter installations shall be made on the outside of dwellings. All meter locations shall be designated by the electric utility. (c) It is mandatory to maintain adequate working space at all points of access to meters, metering transformers, etc. The placement of air conditioning units or any equipment in this workspace is a violation, and shall be abated by relocation. Sec. 9-3-107 to 9-3-120 . ........................ Reserved. ARTICLE 6. UNSAFE EQUIPMENT Sec. 9-3-121. Removal or repair re-quired. An electrical equipment which is unsafe and constitutes a fire hazard, or is otherwise dangerous to human life by reason of inadequate maintenance, overload, obsolescence, defect or instal- lation not conforming to this ordinance, is hereby declared illegal, and shall be abated by removal, repair or replacement in accordance with the procedure set out in this Code. Sec. 9-3-122. Notice. Whenever the electrical inspector shall find any electrical equipment to be unsafe as defined in this Code, the inspector shall, in accordance with established procedure for, legal notices, give to the person responsible for the equipment written Ordinance No. 4935 Page 21 notice stating the defects thereof. The notice shall require those persons responsible to place the equipment in a safe condition in accordance with provisions of this ordinance, within a stated time. Sec. 9-3-123. Disconnection of electric service on failure to comply with notice. Upon failure to comply with written notice as set forth in section 11-122, the electrical inspector is hereby authorized to notify the utility company supplying electric energy to the building, structure, tent or other premises to discontinue electric service until instructed by the electrical inspector to restore service; however, when appeal has been filed under section 11-34, the service shall not be discontinued until the appeal has been heard. Sec. 9-3-124. Emergency disconnection. In case of emergency, or where necessary for safety to person or property, or where the electrical equipment may interfere with the work of the fire department, the electrical inspector shall have the authority to immediately disconnect or cause the disconnection of any electrical equipment.
