ORDINANCE NO. 4953
ORDINANCE AMENDING ORDINANCE NO. 2479, AS
AMENDED, BY ADDING SUBSECTION NO. 402 TO
SECTION 2A-5, REZONING CERTAIN PROPERTY.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA:
Section 1. That Section 2A-5, of Ordinance No. 2479, as
amended, be further amended by adding after Subsection No. 401,
of said Section, the following Subsection No. Four Hundred Two
(402) .
"402.
Roth Park Camp Part of Lots 14, 15, 16, and 17,
described as follows; Beginning at the Northeast Corner
of Lot 17, thence South along the East line of Roth
Park Camp 175 feet, thence West, parallel with the
North line of Lot 14 a distance of 82 feet; thence
North, parallel with the West line of Lots 14 and 15 to
the North line of Lot 15; thence Northwesterly to the
Northwest Corner of Lot 17; thence East to the Point of
Beginning, and Lot 18, 19, 20, 21 and 17 foot right of
way as platted South of and adjacent to Lot 20, all in
the City of Waterloo, Black Hawk County, Iowa;
now zoned on the Zoning Map of Waterloo, Iowa, as "C-1"
Commercial District, be and the same is hereby zoned as 11C-2"
Commercial District with Conditions", subject to the following
condition:
1. That conditions be placed on the rezoning request
to minimize and diminish the affect the new use
would have upon the surrounding area, by the means
of screening the property from the residential
uses to the east by either constructing a fence or
planting additional vegetation, and restricting
the use of the property to an auto sales lot with
incidental repair.
Section 2. That the City Clerk be, and she hereby is,
directed to file a certified copy of this Ordinance with the
Recorder of Black Hawk County, Iowa.

PASSED 2nd CONSIDERATION: August 17, 2009
PASSED 3rd CONSIDERATION: August 24, 2009
PASSED AND ADOPTED by the City Council of the City of
Waterloo, Iowa, on the 24th day of August, 2009, and approved by
the Mayor on the 26th day of August, 2009.
