ORDINANCE NO. 4945
AN ORDINANCE ESTABLISHING THE 800 BLOCK OF
RAINBOW DRIVE IN THE CITY OF WATERLOO, IOWA
AS A BENEFITED DISTRICT AND ESTABLISHING
CONNECTION CHARGE LINE COSTS.
WHEREAS, the F.Y. 2008 Street Reconstruction Program for the
City of Waterloo, Iowa included the 800 Block of Rainbow Drive,
and prior to the design of the reconstruction of Rainbow Drive,
most of the properties in the 800 block of Rainbow Drive were
served by septic systems.
WHEREAS, during the design phase of the F.Y. 2008 Street
Reconstruction Program, which included the 800 Block of Rainbow
Drive, some of the property owners asked if the City of Waterloo
was going to install sanitary sewer main, and it was determined
that sanitary sewer could be installed with a connection to an
existing sanitary sewer at Rainbow Drive/Northland Drive.
WHEREAS, due to the city's longstanding policy of requiring
the initial construction of sanitary sewer to be paid for by
adjacent properties, this extension was proposed as a connection
charge. With a connection charge, the city pays for the initial
cost of construction and then recovers its cost as adjacent
properties connect to the sewer, in the manner provided for in the
2007 Waterloo Code of Ordinances, Section 3A -4-1(E), Article A,
User Charges and Fees, of Chapter 3, Sewer Regulations of Title 8,
Public Utilities.
WHEREAS, the Waterloo City Council desires to establish
connection charges and hook -on charges for sanitary sewer
construction and connection for properties located in the
benefited district.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, as follows:
1. That the properties fronting on the 800 Block of
Rainbow Drive in the City of Waterloo, Iowa, are hereby
established as a benefited district for purposes of connection of
property to the city sanitary sewer system.
2. That the following schedule of connection charges and
hook -on charges is established for the benefited district,
calculated pursuant to Section 3A -4-1(E) of the Code of
Ordinances:

3. That said connection charges and hook -on charges will
be due and payable in full when an application for hook-up to the
city's sanitation sewer is filed with the City of Waterloo.
