Head Signature: # of Attachments: 2 SUBJECT: Weed ordinance amendment 7-5-1 & 7-5B-2 Submitted by: City of Waterloo Code Enforcement Department Recommended City Council Action: Summary Statement Expenditure Required: None Source of Funds Policy Issue Alternative Background Information: Add to section 7-5-1 Definitions: A volunteer tree is one that grows on its own, rather than being deliberately planted. A. Nuisance Declared; Abatement Required: All weeds, vines, brush, (Add volunteer trees), grass and noxious weeds as defined by the Iowa Code, or other growths which exceed a height of twelve inches (12") growing on lots and parcels of ground within the corporate city limits, are declared to be a weed hazard or a public nuisance; provided, however, that such height shall not exceed eight inches (8") on any lot or parcel of ground that has a residential zoning classification. Such hazards and nuisances shall be abated by the property owner or person in possession of the property. Adding the removal of volunteer trees will help to enhance the overall appearance of neighborhoods. It would allow for voluntary trees growing up and around houses, garages, along alleys, and fences to be removed. Every year, Code Enforcement receives several complaints of voluntary trees being a blight issue to the neighborhoods. They are not considered to be a weed. 7-513-1:DEFIKW00ONS: Unless otherwise expressly stated or the context clearly indicates a different intention, the following terms shall, for the purpose of this article, have the following meanings: CODE ENFORCEMENT OFFICER: Person(s) authorized to enforce the weed ordinance. COMPLAINANT: That person who files aweed nuisance complaint asdescribed inthe Waterloo weed complaint policies. ENFORCING AGENCY: The administration and enforcement ofthe provisions Vf this article shall be the duty of the code enforcement officers. NUISANCE: Any weeds which, due tothe manner oftheir growth and height, cause an annoyance tQthe general public, including, but not limited to, noxious weeds asdefined inthe Iowa Code. WEED COMPLAINT: The weed nuisance complaint form or a call into the code enforcement department asdescribed inthe Waterloo weed complaint policies. WEED HAZARD: Any weed, grasses or other herbaceous vegetation which interferes with any sidewalk or the traveled portion of any roadway or alley or with visibility at any intersection, or traffic control light mrsign orconstitutes a health, safety orfire hazard orotherwise endangers life orproperty. WEEDS: Includes all herbaceous vegetation that is not controlled, maintained and/or cared for under normal horticultural practices. Upon receipt of a complaint or observation by code enforcement, a notice shall be issued to the owner (as shown by the official records of Black Hawk County), agent, and/or person in possession or control of said property, describing the nuisance or hazard on said •ro erty. The first notice issued in respect of a given property in a calendar year shall demand abatement of the nuisance or hazard within five (5) days from the date of conspicuous posting at listed address, or parcel, and service by regular mail. Subsequent notices issued in respect of the same property in a calendar year shall demand abatement of t e nuisance or hazard within three (3) days from the date of conspicuous posting at listed address or parcel, and service by regular mail. Failure of the owner to abate the growth within the time frame set forth herein may result in the city's abating said growth and assessing all costs associated therewith against the affected property. For purposes of this section, days shall be measured in calendar days.
