ORDINANCE - NO. 5329
AMENDING ORDINANCE NO. 5079, AS AMENDED, CITY OF
WATERLOO ZONING ORDINANCE, BY AMENDING THE
OFFICIAL ZONING MAP REFERRED TO IN SECTION 10-4-4,
APPROVING THE REZONE OF 0.32 ACRES FROM "C-2"
COMMERCIAL DISTRICT TO "C -2,C -Z" CONDITIONAL
ZONING DISTRICT FOR THE PURPOSES OF ESTABLISHING
AN AUTO REPAIR BUSINESS, LOCATED AT 2006 DUBUQUE
ROAD.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA AS FOLLOWS:
Section 1. That'the Official Zoning Map referred to in
Section 10-4-4, Rezoning Certain Property, of Ordinance No.
5079, as amended, City of Waterloo Zoning Ordinance, be
amended to rezone the property legally described as follows:
THAT PART OF BLOCK 5 IN "COWIN'S 2ND ADDITION TO
WATERLOO, IOWA", BOUNDED AS FOLLOWS:
COMMENCING AT THE SOUTHWEST CORNER` OF SAID. BLOCK;
THENCE EAST ALONG THE SOUTH LINE OF SAID BLOCK A
DISTANCE OF=215.7 FEET; THENCE NORTHWESTERLY ALONG THE
ARC OF A`"CURVE, WHOSE RADIUS IS 726.6 FEET AND WHOSE
CHORD IS 245.8 FEET AND FORMS AN ANGLE OF 28° 39' 91/2"
WITH THE SOUTH LINE" OF SAID BLOCK, TO A POINT ON THE
WEST LINE OF SAID BLOCK THAT IS 117.7 FEET NORTH OF THE
-SOUTHWEST CORNER OF SAID BLOCK; THENCE SOUTH TO THE
POINT OF BEGINNING;
Now zoned on the Official Zoning Map of, Waterloo, Iowa, the
area generally located at 2006 Dubuque Road,, from "C-2"
Commercial District to "C-2, C -Z" Conditional Zoning
District, as above described and subject to the following
condition:
That the use be limited to an automobile repair
use or any use permitted in the "C-2" Commercial
District.
2 Construction -of a solid fence along,the southern
property line at least 6' in height.
3. Parking stops/bollards are shown setback 3' from
the west property line along Nevada Street to
keep vehicles from parking on the adjacent
sidewalk.
4. That the vehicular use area is' setback 5' from
the north property line of vacated Dubuque Road
-right-of-way.
5. That a 6" curb is constructed along the north
side of the vehicular use area adjacent to
Dubuque Road.
Section 2. That the City Clerk is hereby directed to
'file a certified copy of this Ordinance with the Recorder of
Black Hawk County, Iowa.
