ORDINANCE NO. 5301 AN ORDINANCE AMENDING ORDINANCE NO. 5079, AS AMENDED, CITY OF WATERLOO ZONING ORDINANCE, BY AMENDING THE OFFICIAL ZONING MAP REFERRED TO IN SECTION 10-4-4, REZONING CERTAIN PROPERTY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, as follows: Section 1. That the Official Zoning Map referred to in Section 10-4-4, Rezoning Certain Property, of Ordinance No. 5079, as amended, City of Waterloo Zoning Ordinance, be amended to rezone the property legally described as follows: Rezone "C -P" to "R -4,R -P" Part of the Southeast Quarter (SE k) of Section 11, Township 88 North, Range 13 West of the 5th Principal Meridian, City of Waterloo, Black Hawk County, Iowa being more particularly described as follows Commencing at the southwest corner of said Southeast Quarter (SE k); Thence North 0°12'13" West, 33.00 feet on the west line of said Southeast Quarter (SE k), to the north right-of-way line of East Shaulis Road; Thence North 89°34'39" East, a distance of, 1,286.37 feet on said north right-of-way line of East Shaulis Road; Thence North 0°23'27" West, 17.00 feet on said northerly right-of-way line of East Shaulis Road; Thence North 89°34'39" East, 130.30 feet on said north right- of-way line of East Shaulis Road, to the Point of Beginning. The proposed rezone area is in conformance with the Comprehensive Plan and Future Land Use Map, which designate this area as Low Density Residential, Mixed Residential, Professional Office and Neighborhood Commercial, allowing for infill development in the Primary Growth Area. 2. The site in question would appear to provide sufficient space to meet all required regulations including setbacks, drainage, landscaping, screening, etc. 3. Rezoning of the land will provide for additional ground within the City to be developed for future residential uses. 4. The proposed rezone area can be served by extension of existing utilities.
