RESOLUTION NO. 2012-401
RESOLUTION APPROVING RELEASE OF REAL ESTATE
MORTGAGE WITH GARY C. MARSHALL AND SHARON K.
MARSHALL FOR 6910 ANSBOROUGH AVENUE, FOR
PAYMENT OF PROMISSORY NOTE IN CONJUNCTION
WITH THE KIMBALL SOUTH RURAL WATER MAIN
PROJECT AND DIRECTING EXECUTION OF SAID
RELEASE OF REAL ESTATE MORTGAGE BY MAYOR.
WHEREAS, Gary C. Marshall and Sharon K. Marshall have paid
the Waterloo Water Works the remaining balance of the Promissory
Note and Mortgage for 6910 Ansborough Avenue in conjunction with
the Kimball South Rural Water Main Project for the following
described property:
The South 718 . 81 feet of the East 303. 05 feet of the
Southeast Quarter of the Southeast Quarter of Section
20, Township 88 North, Range 13 West of the 5th
Principal Meridian in Black Hawk County, Iowa, except
for the South 215 . 61 feet of the East 303 . 05 feet
thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
WATERLOO, IOWA, that the Release of Real Estate Mortgage dated
May 7, 2012, for payment of Promissory Note in conjunction with
the Kimball South Rural Water Main Project, by and between Gary
C. Marshall and Sharon K. Marshall and the City of Waterloo,
Iowa, be and the same is hereby approved, and the Mayor and City
Clerk authorized to execute the same in behalf of the City of
Waterloo, Iowa.
PASSED AND ADOPTED this 7th day of May, 2012 .
