Getty Council Chambers, Waterloo, Iowa, at 5:30 p.m., on Monday, March 2, 2020. Mayor Quentin Hart in the Chair. Roll Call: Boesen, Amos, Morrissey, Klein, Feuss, Grieder, Juon. Prayer or Moment of Silence. Pledge of Allegiance: Veterans in attendance 157468 - Juon/Amos that the Agenda, as proposed, for the Regular Session on Monday, March 2, 2020, at 5:30 p.m., be accepted and approved. Voice vote -Ayes: Seven. Motion carried. 157469 - Juon/Amos that the Minutes, as proposed, for the Regular Session on Monday, February 24, 2020, at 5:30 p.m., be accepted and approved. Voice vote -Ayes: Seven. Motion carried. ORAL PRESENTATIONS Forest Dillavou, 1725 Huntington Road, thanked the Waterloo Water Works staff for checking to ensure that fire hydrants, open. David Dryer, 3145 W. 4t' Street, questioned the difference between a low income home and a blighted home. Mayor Hart commented that a blighted home is one that is in need of repair. Mr. Boesen commented that he received several complaints over the weekend regarding signs for a gun show in the right of way and thanked Code Enforcement for addressing the issue. 157470 - Juon/Grieder that the above oral comments be received and placed on file. Resolutions to approve the following: Resolution approving Finance Committee Invoice Summary Report, dated March 2, 2020, in the amount of $2,3 52,062.3 6, a copy of which is on file in the City Clerk's office, together with recommendation of approval of the Finance Committee. Resolution adopted and upon approval by Mayor assigned No. 2020-132. 2. Resolution approving Variance to Noise Ordinance request from Riverloop Association, Inc., for events to be held at the Riverloop Amphitheater and the Expo Plaza from May 1, 2020 through November 15, 2020, from 10:00 a.m, to midnight, in conjunction with music concerts, wedding receptions, movies on the river, etc., including bands and the use of a PA system. Resolution adopted and upon approval by Mayor assigned No. 2020-133. Resolution approving preliminary plans, specifications, form of contract, etc. and setting date of bid opening as March 19, 2020 and date of public hearing as March 23, 2020, for the FY 2020 Street Reconstruction Program, Contract No. 993, and instruct City Clerk to publish said notice. Motion carried. 157482 - Morrissey/Amos March 2, 2020 Page 5 that proof of publication of notice of public hearing on FYE 2021 Budget Maximum Property Tax Levy, as published in the Waterloo Courier on February 20, 2020, be received and placed on file. Voice vote -Ayes: Seven. Motion carried. This being the time and place of public hearing, the Mayor called for written and oral comments. Alex Martin, 511 Wildwood Road, commented that the city needs many areas of improvement. These include providing additional funding to the Fire Department and Library. 157483 - Morrissey/Amos that the hearing be closed and oral comments be received and placed on file. Voice vote -Ayes: Seven. Motion carried. 157484 - Morrissey/Amos that "Resolution approving the Maximum Property Tax Askings as defined under Iowa Code Section 384.15A in the amount of $36,365,972, an increase in total collections of $2,836,291, or 8.46%, for the budget year ending June 30, 2021", be adopted. Roll -call vote -Ayes: Six. Nays: One (Klein). Motion carried. Michelle Weidner, Chief Financial Officer, explained that this is a new hearing required under state law. It requires that the city set the maximum for the general tax levies. She explained that it is set at the highest it can be, which is at the $8.10 limit. The city will continue to have work sessions to discuss the budget and a final budget hearing on March 19. Mr. Morrissey clarified that the vote requires a two-thirds vote to approve. Michelle Weidner confirmed and stated that this resolution must be adopted before the next hearing date can be set. Pat Morrissey questioned what would happen if this fails to pass with the required two-thirds vote. Michelle clarified that a recess could be held to discuss an amount that council would support. RESOLUTIONS 157485 - Morrissey/Feuss that "Resolution setting date of public hearing as March 19, 2020 at 5:30 p.m. in the Harold E. Getty Council Chambers to approve the FYE 2021 budget, and instruct City Clerk to publish said notice", be adopted. Roll call vote -Ayes: Seven. Motion carried. Resolution adopted and upon approval by Mayor assigned No. 2020-144. 157486 - Morrissey/Feuss that "Resolution approving Completion of Project and Acceptance of Work for work performed by K & W Electric, Inc., of Cedar Falls, Iowa, and release of retainage in the amount of $10,000, in conjunction with the Dubuque/Osage Road Traffic Safety Improvements Project, Iowa DOT Grant Project Number CS-TSF-8155(745)--85-07, and authorizing the Mayor to execute said document", be adopted. Roll call vote -Ayes: Seven. Motion carried. Resolution adopted and upon approval by Mayor assigned No. 2020-145. 157487 - Morrissey/Feuss that "Resolution authorizing an exception to the City of Waterloo's Purchasing Procedures Policy, to approve the purchase of one (1) 2019 Ford Transit 250 Van, in the amount of $29,500, from Auto Mart Corporation of Cedar Rapids, Iowa", be adopted. Randy Bennett, Public Works Division Manager, provided an overview of the item. Resolution adopted and upon approval by Mayor assigned No. 2020-146. 157488 - Klein/Feuss that "Resolution approving contract, bonds and certificate of insurance with Woodruff Construction, LLC, of Waterloo, Iowa, in the amount of $16,587,300, in conjunction with the Wastewater Treatment Plant Biosolids Modifications, Contract No. 994, and authorizing the Mayor to execute said documents", be adopted. Roll call vote -Ayes: Seven. Motion carried. Resolution adopted and upon approval by Mayor assigned No. 2020-147. 157489 - Klein/Feuss that "Resolution approving award of bid to Don Gardner Construction Company, of Waterloo, Iowa, in the amount of $129,360, and approving the contract, bonds, and certificate of insurance, in conjunction with the FY 2019 Young Arena Roof Replacement Project, Contract No. 998, and authorizing the Mayor and City Clerk to execute said documents", be adopted. Roll call vote -Ayes: Seven. Motion carried. Resolution adopted and upon approval by Mayor assigned No. 2020-148. 157490 - Klein/Feuss that "Resolution approving a Professional Services Agreement with Greenlots d/b/a Zeco Systems, Inc., in an amount not to exceed $650 annually, for services and subscription of Greenlots software system for the downtown charging stations, and authorizing the Mayor to execute said documents", be adopted. Roll call vote -Ayes: Seven. Motion carried. David Dryer, 3145 W. 4' Street, questioned why MidAmerican energy is not paying to maintain these charging stations. Noel Anderson, Community Planning and Development Director, explained that the documents do show that MidAmerican will be paying the $650 in fees for the first three years, and possibly beyond. Resolution adopted and upon approval by Mayor assigned No. 2020-149. 157491 - Grieder/Amos that "Resolution approving a Temporary Construction Easement Agreement with ONeal Steel, LLC, of Waterloo, Iowa, in the amount $1,035, in conjunction with the FY 2020 Lot 2, Brock 3rd Addition Sanitary Sewer Extension, Contract No. 986, located at 2680 Sergeant Road, and authorizing the Mayor and City Clerk to execute said document", be adopted. Roll call vote -Ayes: Seven. Motion carried. Resolution adopted and upon approval by Mayor assigned No. 2020-150. 157492 - Grieder/Amos that "Resolution approving a Construction Agreement with the Waterloo Water Works Board of Trustees, .in conjunction with the FY 2020 Street Reconstruction Program, Contract No. 993, and authorizing the Mayor and City Clerk to execute said document", be adopted. Resolution adopted and upon approval by Mayor assigned No. 2020-151. 157493 - Grieder/Amos that "Resolution approving a Construction Agreement with Waterloo Water Works Board of Trustees, in conjunction with the FY 2020 University Avenue Reconstruction - Phase 3, Contract No. 971, and March 2, 2020 Page 7 authorizing the Mayor and City Clerk to execute said document", be adopted. ORDINANCES 157494 - Morrissey/Feuss that "an ordinance amending the Code of Ordinances of the City of Waterloo, Iowa, by amending Article B1, Definitions, and Article B2A, Nuisance Declared, Abatement Required, of Chapter 5, Vegetation, all of Title 7, Public Ways and Property", be received, placed on file, considered and passed for the first time. Roll call vote -Ayes: Seven. Motion carried. 157495 - Morrissey/Feuss that rules requiring ordinances to be considered and voted for passage at two prior meetings be suspended.
