RESOLUTION SETTING DATE OF PUBLIC HEARING AS
MARCH 23, 2020 TO APPROVE A REQUEST
BY AUTOZONE, INC., FOR A SITE PLAN AMENDMENT TO
THE "S-1" SHOPPING DISTRICT, TO CONSTRUCT A NEW
RETAIL STORE LOCATED SOUTH OF 3115 KIMBALL
AVENUE, AND INSTRUCT CITY CLERK TO PUBLISH SAID
NOTICE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS
FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa, shall meet in the Council
Chambers in the City Hall, City of Waterloo, Iowa, at 5:30 p.m. on the 23th day of March 2020,
for the purpose of considering the request by AutoZone, Inc., for a Site Plan Amendment to the
"S-1" Shopping Center District, to allow for the construction of a new retail store located south of
3115 Kimball Avenue, and legally described as follows:
LOT 1
THAT PART OF PARCEL "C", LOCATED IN THE NORTHWEST
FRACTIONAL QUARTER OF SECTION 3, AND THE NORTHEAST
FRACTIONAL QUARTER OF SECTION 4, ALL IN TOWNSHIP 88 NORTH,
RANGE 13 WEST OF THE FIFTH PRINCIPAL MERIDIAN, IN THE CITY OF
WATERLOO, BLACK HAWK COUNTY, IOWA, AND BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE NORTHWEST CORNER OF LOT 1, SOUTHHAVEN
ADDITION TO THE CITY OF WATERLOO, A #5 REBAR FOUND FOR
CORNER; THENCE CONTINUING NORTHERLY, ON A GRID BEARING OF,
NORTH 00°54'26" WEST, ON THE EAST RIGHT-OF-WAY LINE OF
KIMBALL AVENUE, 248.55 FEET, TO THE TRUE POINT OF BEGINNING;
THENCE CONTINUING NORTHERLY, ON THE EAST RIGHT-OF-WAY
LINE OF KIMBALL AVENUE, 248.55 FEET, TO A#4 REBAR WITH PLASTIC
CAP FOUND ON THE SOUTH LINE OF THE NORTH 540 FEET SOUTH OF
THE SOUTH LINE OF RIDGEWAY AVENUE; THENCE DEPARTING SAID
EAST RIGHT-OF-WAY LINE, EASTERLY, NORTH 89°21'13" EAST, ALONG
THE SOUTH LINE OF THE NORTH 540 FEET SOUTH OF THE SOUTH LINE
OF RIDGEWAY AVENUE, 175.05 FEET, TO A FOUND #4 REBAR WITH
PLASTIC CAP; THENCE SOUTHERLY, SOUTH 00°54'01" EAST, 250.00
FEET; THENCE WESTERLY, SOUTH 89°21'13" WEST, 175.02 FEET, TO THE
POINT OF BEGINNING.
CONTAINING A TOTAL CALCULATED AREA OF 43,759 SQUARE FEET,
OR 1.005 ACRES,MORE OR LESS.
Section 2. That the City Clerk is hereby directed to publish notice of the time and place
of said hearing in the Waterloo Courier.
