RESOLUTION NO. 2019-943 RESOLUTION APPROVING A PERMANENT EASEMENT AGREEMENT WITH MIDAMERICAN ENERGY, TO ALLOW FOR THE CONSTRUCTION OF A TWO ELECTRIC VEHICLE CHARGING STATIONS NEAR THE CENTER FOR THE ARTS PARKING LOT AT 225 COMMERCIAL STREET, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID DOCUMENT. WHEREAS, the Permanent Easement Agreement, dated December 9, 2019, of the hereinafter described parcel, is to allow for the construction of a two electric vehicle charging stations near the Center for the Arts parking lot at 225 Commercial Street. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, that the Permanent Easement Agreement, between MidAmerican Energy and the City of Waterloo, Iowa, for construction of a two electric vehicle charging stations near the Center for the Arts parking lot at 225 Commercial Street, as hereinafter described, is accepted and approved: DESCRIPTION OF PROPERTY CONTAINING EASEMENT AREA: A PART OF BLOCK 2 AND BLOCK 3 AND WEST 2ND STREET RIGHT OF WAY, ALL PART OF THE ORIGINAL PLAT ON THE WEST SIDE OF THE CEDAR RIVER IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. DESCRIPTION OF EASEMENT AREA: BEGINNING AT THE SOUTHERLY CORNER OF LOT 10 OF SAID BLOCK 3; THENCE NORTH 41° 46' 40" EAST ON THE SOUTHEASTERLY LINE OF SAID LOT 10, A DISTANCE OF 38.00 FEET; THENCE NORTH 48° 13' 20" WEST, 20.00 FEET; THENCE NORTH 41° 46' 40" EAST, 20.00 FEET; THENCE SOUTH 48° 13'20" EAST, 20.00 FEET TO SAID SOUTHEASTERLY LINE; THENCE NORTH 41° 46' 40" EAST ON THE SOUTHEASTERLY LINE OF SAID LOT 10 AND LOT 1 OF SAID BLOCK 3, A DISTANCE OF 142.00 FEET; THENCE SOUTH 48° 13'20" EAST, 320.00 FEET TO THE SOUTHEASTERLY LINE OF LOT 2 IN SAID BLOCK 2; THENCE SOUTH 41° 46' 40" WEST, 300.00 FEET; THENCE SOUTH 41° 46' 40' WEST, 160.00 FEET; THENCE SOUTH 48° 13' 20" EAST, 60.00 FEET TO THE SOUTHEASTERLY RIGHT OF WAY LINE OF WEST 2ND STREET; THENCE SOUTH 41° 46'40" WEST ON SAID SOUTHEASTERLY LINE, 20.00 FEET TO THE NORTHEASTERLY RIGHT OF WAY LINE OF COMMERCIAL STREET; THENCE NORTH 48° 13' 20" WEST ON SAID NORTHEASTERLY LINE, 80.00 FEET TO THE POINT OF BEGINNING AND CONTAINING 11,600 SQUARE FEET.
