AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF WATERLOO, IOWA, BY REPEALING SUBSECTIONS (2)
THROUGH (5) OF SECTION 23 1 /2 - 22, TRASH AND WEEDS;
DUTY OF PERSON RESPONSIBLE, OF CHAPTER 23 1 /2, LITTER
CONTROL; AND ENACTING IN LIEU THEREOF NEW SUBSECTIONS
(2) THROUGH (5) OF SECTION 23 1 /2 - 22, TRASH; DUTY OF
PERSON RESPONSIBLE, OF CHAPTER 23 1 /2, LITTER
CONTROL.
BE IT ORDAINED by the City Council of the City of Waterloo,
Iowa, that:
THAT Subsections (2) through (5) of Section 23 1 /2-22,
Trash and weeds ; duty of person responsible, of Chapter
23 1 /2, Litter Control, are hereby repealed in their
entirety; that new Subsections (2) through (5) of Section
23 1 /2-22, Trash; duty of person responsible, of Chapter
23 1 /2, Litter Control, are hereby enacted in lieu thereof
as follows:
(2) All owners of lots, parts of lots or parcels of
ground, shall remove from the property between the sidewalk
line and the curb line in front of or at the side of their
property any litter or debris and shall keep said plot or
parking free from stumps, holes , pitfalls or other
obstructions.
(3) In the event the owners and occupants responsible
refuse to remove the trash, garbage or refuse from the
property on which it is allowed to accumulate, within seven
(7) days after notice in writing has been given by the city
to the person or persons responsible, he or she shall be
deemed guilty of a violation of this section.
(4) If the owner and/or occupant has not acted to correct
the violation, the department of sanitation shall hear and
consider any objections and protests to the proposed
removal by the city of the trash, garbage or refuse.
(5) If the owner of the property, after due notice, has
failed or refused to remove the trash, garbage or refuse,
and the department of sanitation has caused the removal of
said trash, garbage or refuse, in addition to all other
remedies, the city may assess costs incurred by it, and
this shall be a charge against the owner and shall be a
lien against the property from which the trash, garbage or
refuse has been removed.
PASSED AND ADOPTED by the City Council this g_ day of
Mfx 1984 and approved by the Mayor this
