AN ORDINANCE AMENDING THE CODE OF THE ORDINANCES OF THE CITY OF
WATERLOO, IOWA, BY REPEALING SUBSECTIONS (a) (4) AND (a) (5) OF
SECTION 34-42, CONNECTION CHARGES, OF ARTICLE III, SEWERS, OF
CHAPTER 34, UTILITIES, AND ENACTING IN LIEU THEREOF NEW
SUBSECTIONS (a) (4) , (a) (5) AND (a) (6) TO SECTION 34-42,
CONNECTION CHARGES, OF ARTICLE III, SEWERS, OF CHAPTER 34,
UTILITIES.
BE IT ORDAINED by the City Council of the City of Waterloo, Iowa,
that:
Section 1.
That Subsection (a) (4) of Section 34-42, Connection Charges , of
Chapter 34, Utilities, is hereby repealed in its entirety.
Section 2.
That new Subsection (a) (4) of Section 34-42, Connection Charges , of
Chapter 34, Utilities, is hereby enacted as follows :
" (4) Where the property to be served has not been subject to
assessment for the cost of the public sewer constructed after
January 1, 1978 , and before January 1, 1982, and the cost
thereof was paid by general taxation, the sewer connection
charge shall be calculated on the basis of Fifteen and no/100
Dollars ($15. 00) per front foot of actual lot frontage as
hereinbefore defined or the actual front footage construction
cost (including engineering, real and administrative charges)
whichever charge is lesser, plus a hook-on charge in the amount
of Two Hundred and no/100 Dollars ($200. 00) per acre pro-rated
to lesser portions of an acre with a minimum hook-on charge of
Fifty and no/100 Dollars ($50. 00) per hook-on. "
Section 3.
That Subsection (a) (5) of Section 34-42, Connection Charges , of
Chapter 34, Utilities, is hereby repealed in its entirety.
Section 4.
That New Subsection (a) (5) of Section 34-42, Connection Charges , of
Chapter 34, Utilities, is hereby enacted as follows :
"(5) Where the property to be served has not been subject to
assessment for the cost of the public sewer constructed after
January 1, 1982 , and the cost thereof was paid by general
taxation, the sewer connection charge shall be calculated on the
basis of the actual front footage construction cost (including
engineering, real and administrative charges) , plus a hook-on
charge in the amount of Two Hundred and no/100 Dollars ($200. 00)
per acre pro-rated to lesser portions of an acre with a minimum
hook-on charge of Fifty and no/100 Dollars ($50. 00) per
hook-on. "
Section 5.
That New Subsection (a) (6) of Section 34-42, Connection Charges , of
Chapter 34, Utilities, is hereby enacted as follows :
" (6) The provisions of the hook-on charge provided for in this
Chapter shall not apply to any property covered by a specific
hook-on charge ordinance. "
PASSED AND ADOPTED by the City Council this -, 7 day of
