"Shall Ordinance No. , granting to American
Cablevision of Waterloo, Inc. , a franchise to operate
a cable television system in the City of Waterloo,
Iowa, for a period of fifteen (15) years be approved?
Said Ordinance being as follows, to-wit: i
ORDINANCE NO.
AN ORDINANCE GRANTING UNTO AMERICAN CABLEVISION OF WATERLOO, INC. ,
ITS SUCCESSORS AND ASSIGNS, THE RIGHT, FRANCHISE AND AUTHORITY FOR
A PERIOD OF FIFTEEN (15) YEARS TO ERECT, MAINTAIN AND OPERATE A
CABLE TELEVISION SYSTEM WITHIN THE CORPORATE LIMITS OF THE CITY OF
WATERLOO, IOWA.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA:
Section 1. Term of franchise.
American Cablevision of Waterloo, Inc. , its successors and assigns, is hereby
granted a non-exclusive right, franchise and authority for a period of fifteen
(15) years to erect, maintain and operate a cable television system in Waterloo,
Iowa, and to sell and supply individuals, firms and corporations, within the
corporate limits of the City of Waterloo, Iowa, audio and video communications
services, subject to the conditions and restrictions as hereinafter provided
and subject to the ordinances of the City of Waterloo, Iowa.
Section 2. Effective date of franchise and acceptance of franchise.
This franchise and all rights thereunder shall become effective after final
passage and publication hereof and after approval by the voters of the City of
Waterloo, Iowa, as provided by the law of the State of Iowa; within thirty (30)
days after the date of approval of this franchise by the voters of the City of
Waterloo, Iowa, American Cablevision of Waterloo, Inc. shall file with the Clerk
an acceptance in writing of this franchise and pay all costs as required under
the laws of the State of Iowa. This franchise and all rights granted thereunder
shall terminate July 1, 1978, unless voter approval is obtained on or before
said date.
Section 3. Compliance with other requirements.
American Cablevision of Waterloo, Inc. shall abide by all provisions of this
franchise ordinance and any other ordinances, including cable television regulatory
ordinances, of the City of Waterloo, Iowa; American Cablevision of Waterloo, Inc.
shall comply with all rules and regulations of the Federal Communications
Commission.
Section 4. Transfer of franchise.
American Cablevision of Waterloo, Inc. shall not assign, sell or transfer this
franchise, or any rights thereunder, without the prior approval and consent of
the City Council of Waterloo, Iowa.
Section 5. Severability.
If any section, subsection, sentence, clause, phrase or portion of this franchise
ordinance shall be held invalid or unconstitutional, the remaining provisions
shall remain in full force and effect. f
