ORDINANCE VACATING CERTAIN EXCESS RIGHT-OF-WAY IN PART OF SECTION
30-89-12 IN VICINITY OF IDAHO STREET AND BUTLER STREET.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS
FOLLOWS :
An unplatted parcel of land located in the Southwest Quarter of
the Southwest Quarter of the Northeast Quarter of Section 30-89-
12 described as follows :
Commencing at a point of intersection of the East line of Idaho
Street and an Easterly extension of the center line of Butler
Street; thence South along said East line of Idaho Street a dis-
tance of 65 feet to the point of beginning; thence South along
the East line of Idaho Street a distance of 154 feet more or
less to the point of intersection with the Northeasterly Right-
of-Way line of the Illinois Central Railroad; thence Northwester-
ly along a Northeasterly extension of said Railroad Right-of-Way
a distance of 80 feet thence Northeasterly to the point of be-
ginning;
subject to a 25 foot building setback line along Idaho Street and
a 25 foot setback line along the Illinois Central Railroad tracks ,
and City's retention of a utility easement over, under and across
all of that part of said legally described parcel lying West of
the center line of Section 30-89-12,
shall be, and the same is hereby vacated.
Passed and adopted by the City Council on 26th day of September,
1977, approved by the Mayor on the 26th day of September, 1977.
