Justification of need for position: This position is required to maintain the 24,989 trees in Waterloo's 52 parks, 3 golf
courses, and along the street rights -of -way. A large number of these trees in Waterloo will be dying in the near
future due to the emerald ash borer which has now been found in Waterloo. This position will not only be a step
toward keeping up with our routine dukes, but also it will be crutial in the removals of many ash trees as they die
from the emerald ash borer.
What are the likely consequences if the position is not filled?
- Longer response time to public tree trimming and removal requests.
- Possible increase in hazardous situations. Trees that are not maintained in a timely manner fall or drop large limbs
on property or people causing damage or personal injury and increase the number of insurance claims.

Dear Mayor and Council:
I am writing to advise that I will be retiring as City Attorney effective on 12/31/14. This should
allow you the necessary time to arrange for the appointment of a replacement and all of us to
otherwise plan and execute a smooth transition.
My 65th birthday just occurred (October 10) and it is now time for me to slow down, spend
some time with my new grandson and allow someone else to handle the job. I have been City
Attorney since 1991 serving under 5 mayors and 11 different City Councils since then (as I
calculate it). I have been at over 1,000 City Council meetings....but it seems like more. While I
can't truthfully say I have enjoyed all of it I can say it has been very interesting, that I have felt
useful doing the job required and that I did enjoy most of it. I have certainly enjoyed working
with and learning from all of you.
I am willing, subject to approval, to finish work on the significant EPA matter now pending and
the handful of economic development projects you have in the works and any other specific
matter you may want me to wrap up. If that is desired, I will do so as a private attorney paid by
the hour for specific projects and not as an appointed city attorney. I am also retiring from the
private practice of law at this time so any billings from this wrap-up work would come directly
from me (using the rate previously approved) and not from the Clark, Butler, Walsh & Hamann
law firm (and that firm name may well be changing also following my retirement).
I expect to still be involved in many downtown projects through my private real estate
company, JSA Development, and will also keep on with my roles at VGM Group. I will maintain
an office for JSA in downtown Waterloo.
It won't take me long to find other activities for Monday afternoons and evenings but I will miss
being closely involved in local government. That being said, I can't wait for my turn to stand on
the OTHER side of the council chambers rail and have my say on the issues of the day!
