ORDINANCE NO. a
AN ORDINANCE RESTRICTING THE USE OF SNOWMOBILES IN
THE CITY OF WATERLOO, IOWA, AND PROVIDING PENALTIES
FOR VIOLATIONS.
BE IT ORDAINED by the City Council of the City of Waterloo, Iowa:
SECTION 1. PURPOSE. The purpose of this ordinance is to provide rules
and regulations for the maintenance and operation of snowmobiles and to
establish areas where snowmobiles may be used for the safety and general
welfare in the City of Waterloo, Iowa.
SECTION 2. DEFINITIONS. For use within this ordinance the following
terms are defined:
"Snowmobile" - means any self-propelled vehicle weighing less
than one thousand pounds which is equipped with sled type
runners or skis and endless belt type tread, or a combination
thereof, and is designed for travel upon snow, land or ice.
SECTION 3. OPERATION LIMITATIONS. Operators of snowmobiles shall observe
the following limitations as to where snowmobiles may be operated. Motor
driven snowmobiles shall be prohibited from all streets within the corporate
limits of the City of Waterloo, Iowa, except those streets enumerated below;
and snowmobile travel on thos streets shall be strictly limited to ingress
and egress to and from food,' eToand restroom facilities within the City.
A. Starting at the Waterloo city limits on Wagner Road, then
proceeding within both ditches along the road to Big Rock Road;
then proceeding eastward within both ditches to Highway 63,
terminating at Beaman's Truck Stop.
B. Starting at the Skelly Station on the corner of Fletcher Avenue
and Highway 63, proceeding southward within both ditches along
Highway 63 to the intersection of Highway 63 and Ridgeway Road. At
the junction of Highway 63 and Ridgeway Road, the route branches
west on Ridgeway Road to the proposed new site of Turf and Trail
near Black Hawk Creek.
C. Starting at the city limits of Waterloo on Highway 21, then
proceeding northward to Highway 412; then proceeding eastward
within both ditches to Murphy Road, then proceeding northeasterly
to Highway 218; then proceeding within both ditches along Highway
218 to Bopp Street; then proceeding northeast to Sheffield Street
and terminating at Holiday Station on Mitchell Avenue.
D. Starting at Payne's Mobil Station on Evans Road and Lafayette
Street, then proceeding north to Highway 20, then eastward to city
limits.
SECTION 4. OPERATION. The following regulations shall be observed by
operators of snowmobiles:
A. All snowmobiles operated in permitted areas of streets shall
be equipped with a muffler in good working order to prevent excessive
and unusual noises.
B. While operating said snowmobile within permitted areas the speed
of any snowmobile shall not operate at a rate of speed greater than the
posted speed limit.
C. No snowmobile shall be operated in permitted areas by anyone under
age of sixteen or without a valid motor vehicle operators license.
D. Where both ditches along the roadway are available for snowmobile
traffic, snowmobiles shall be operated on the right side of the road.
E. Snowmobiles shall be operated in a safe, reasonable and proper
manner under all existing circumstances.

F. No snowmobile shall be operated on private property without the
express consent of the owner.
G. All snowmobiles shall be equipped in accordance with state law.
H. Snowmobile operators shall be required to observe all traffic control
devices.
I. During a publicized thaw ban, snowmobiles shall be prohibited from
use when posted.
J. It shall be unlawful for the owner or operator to leave or allow a
snowmobile to be or remain unattended on public property while the motor
is running or with keys for starting the vehicle left in the ignition.
K. All snowmobiles while operating within the permitted areas within the
City shall display a flag with an area of not less than 50 square inches of
flourescent red color on a staff holder to put such flag at least 5 feet
above the surface of the street.
L. No snowmobile shall be operated in the city unless registered
pursuant to state law and unless the identifying number set forth in the
registration is displayed on each side of the snowmobile.
M. No snowmobile shall be operated within the City of Waterloo between
the hours of 12:00 A.M. and 6:00 A.M.
N. It is unlawful to operate a snowmobile without a lighted headlight and
tail light from sunset to sunrise and at such other times when conditions
provide insufficient lighting to render clearly discernible persons and
vehicles at a distance of five hundred feet ahead.
SECTION 5. PENALTIES. Any person who shall violate any of the provisions shall
be guilty of a misdemeanor punishable by a fine of one hundred dollars ($100.00)
or by imprisonment for not more than thirty (30) days.
SECTION 6. SEVERABILITY CLAUSE. If any provision or part of this ordinance
shall be adjudged invalid or unconstitutional such adjudication shall not affect
the validity of the ordinance as a whole or any section, provision, or part
thereof not adjudged invalid or unconstitutional.
SECTION 7. WHEN EFFECTIVE. This ordinance shall be in effect after its final
passage, approval and publication as provided by law.
