RESOLUTION NO. 2016-109 RESOLUTION SETTING DATE OF HEARING AS MARCH 21, 2016 TO APPROVE AN AMENDMENT TO THE MARTIN ROAD DEVELOPMENT PLAN AND SETTING A CONSULTATION WITH TAXING ENTITIES ON MARCH 2, 2016, AND INSTRUCT CITY CLERK TO PUBLISH NOTICE. WHEREAS, this Council previously has found and determined that certain areas located within the City are eligible and should be designated as an urban renewal area under Iowa law, and has approved and adopted the Martin Road Development Plan (the "Plan") for the Martin Road Development Plan Area (the "Urban Renewal Area") described therein, which Plan is on file in the office of the City Clerk; and WHEREAS, City staff has caused there to be prepared a form of Amendment to the Plan (the "Plan Amendment"), a copy of which has been placed on file for public inspection in the office of the City Clerk and which is incorporated herein by reference, the purpose of which is to amend and otherwise update the Plan through the approval of the Plan Amendment in order to reflect current City objectives and to describe current,and anticipated project activities and City actions that may be undertaken in the Urban Renewal Area; and WHEREAS, the Iowa statutes require the City Council to notify all affected taxing entities of the consideration being given to the Plan and Plan Amendment and to hold a consultation with such taxing entities with respect thereto, and the statutes further provide that the designated representative of each affected taxing entity may attend the consultation and make written recommendations for modifications to the proposed division of revenue included as a part thereof, to which the City shall submit written responses as provided in Section 403.5, as amended; and WHEREAS, the Iowa statutes further require the City Council to hold a public hearing on the Plan Amendment subsequent to notice thereof by publication in a newspaper having general circulation within the City, which notice shall describe the time, date, place and purpose of the hearing, shall generally identify the urban renewal area covered by the Plan, as amended, and shall outline the general scope of the urban renewal project activities under consideration, with a copy of the notice also being mailed to each affected taxing entity. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA: Section 1. That the consultation on the Plan Amendment required by Section 403.5(2) of the Code of Iowa, as amended, shall be held on the 2nd day of March, 2016, in the Council Chambers, City Hall, 715 Mulberry Street, Waterloo, Iowa, at two o'clock p.m., and the Community Planning and Development Director and the City Planner are hereby appointed to serve as the designated representative and the alternate designated representative, respectively, of the City, for purposes of conducting the consultation, receiving any recommendations that may be made with respect thereto, and responding to the same in accordance with Section 403.5(2). Section 2. That the City Clerk is authorized and directed to cause a notice of such consultation to be sent by regular mail to all affected taxing entities, as defined in Section 403.17(1), along with a copy of the Plan Amendment, the notice to be in substantially the following form: Page 2 Resolution No. 2016-109 DATE: February 18, 2016 RE: NOTICE OF CONSULTATION—AMENDMENT TO THE AMENDED MARTIN ROAD DEVELOPMENT PLAN. Pursuant to Iowa Code Chapter 403.5,please find enclosed a copy of the Martin Road Development Plan Amendment. A consultation to discuss this proposal will be held on March 3, 2016 in the Mollenhoff Conference Room located on the second floor of City Hall, 715 Mulberry Street, and will commence at 10:00 a.m. This plan was previously approved by the City of Waterloo,however we are amending the plan to add additional area and to update wording of the plan, including project details and project budget. If you should have any questions,please do not hesitate to contact our office at 319.291.4366. (End Notice) Section 3. That the Plan Amendment be submitted to the Planning and Zoning Commission for review and recommendation as to its conformity with the general plan for the development of the City as a whole, with such recommendation to be submitted in writing to this Council within thirty(30) days of the date hereof. Section 4. That a public hearing shall be held on the Plan before the City Council'at its meeting which commences at 5:30 p.m. on March 21, 2016, in the Council Chambers, City Hall, 715 Mulberry Street, Waterloo, Iowa. Section 5. That the City Clerk is authorized and directed to publish notice of this public hearing in the Waterloo Courier, once on a date not less than four (4) nor more than twenty (20) days before the date of the public hearing, and to mail a copy of the notice by ordinary mail to each affected taxing entity, such notice in each case to be in substantially the following form: IMPORTANT NOTICE—PUBLIC HEARING MONDAY, MARCH 21, 2016 AT 5:30 P.M., CITY COUNCIL CHAMBERS, CITY HALL, WATERLOO, IOWA. THE PURPOSE OF THE PUBLIC HEARING IS'TO DISCUSS AND MAKE ANY NECESSARY AMENDMENTS TO THE MARTIN ROAD DEVELOPMENT PLAN IN ORDER TO ADD ADDITIONAL AREA AND TO INCLUDE ADDITIONAL PROJECTS AND UPDATE RELATED FINANCIAL INFORMATION. The Martin Road Development Plan area is an economic development area within the meaning of Iowa Code Section 403.17(10). Such area is appropriate for commercial and industrial enterprises and is eligible for an urban renewal project and otherwise meets all requisites under the provisions of Iowa Code Chapter 403. The general scope of urban renewal activities in the area involves the rehabilitation, conservation, development, and redevelopment of such area, or a combination of such activities in the area,to promote continued growth and development of commercial activities in the area through various public purpose and special financing activities outlined in the Plan. These activities are deemed is necessary in the interest of the public health, safety or welfare of the residents of the City of Waterloo. 1 The Plan Amendment is an amendment to the Martin Road Development Plan (the "Plan"), originally adopted in 1996 and subsequently amended in 2004 and 2014. Among other modifications to the Plan,the Plan Amendment proposes to add the following additional area to the Plan: z That part of the Southwest Quarter(SWl/4) of the Southeast Quarter(SE/4) of Section Thirty-three (33), Township Eighty-nine North (T89N), Range Thirteen West(R13W) of the Fifth Principal Meridian, Waterloo, Black Hawk County,Iowa, described as follows: Beginning at the Southwest corner of-aforesaid Southwest Quarter (SW/4) of the Southeast Quarter(SEI/4); thence N01052'25"W Thirty-three (33.00) feet along the West line of said Southwest Quarter(SWI/4) of the Southeast Quarter(SEI/4)to the Page 3 Resolution No. 2016-109 North Right-of-Way line of Ridgeway Avenue; thence NOI°53'44"W Six Hundred Twenty-four and Twenty-six Hundredth (624.26) feet still along said West line to the Southeast corner of Parcel "K", Document No. 2003-27008 in the Black Hawk County Recorder's Office; thence NO °3711"W Six Hundred Sixty-seven and Fifty- two Hundredths (667.52) feet along the East line of said Parcel "K"to the Northwest corner of aforesaid Southwest Quarter(SWI/4) of the Southeast Quarter(SEl/4), which is also on the South line of Jane Addition; thence N89°14'00"E Two Hundred Ninety- five and Eighty-eight Hundredths (295.88) feet along the South line of said Jane Addition to the Southeast corner of'said Jane Addition; thence S01°45'23"E One Thousand Three Hundred Twenty-four and Sixteen Hundredths (1324.16) feet to the South line of aforesaid Southwest Quarter(SW/4) of the Southeast Quarter (SEI/4); thence S89°06'56"W Two Hundred Ninety-five and Eighty-eight Hundredths (295.88) feet along said South line to the point of beginning. The Plan provides that the City may issue bonds or use available funds for purposes allowed by the Plan Amendment, and that tax increment reimbursement of such costs will be sought if and to the extent incurred by the City. The Plan may be further amended from time to time to respond to future development opportunities. The public hearing will be held at 5:30 p.m. on Monday, March 21, 2016, in the City Council Chambers at City Hall in Waterloo, Iowa. Any questions regarding the proposed Plan Amendment to,the Martin Road Development Plan should be directed to the Planning and Zoning Office at 291-4366. Anyone who is interested may appear at same time and place and be heard or may file written objections or comments with the City Clerk, City Hall, 715 Mulberry Street, Waterloo, Iowa,before the date set for said hearing. That the Plan Amendment for the Urban Renewal Area described therein is hereby officially declared to be the proposed Plan Amendment for the Martin Road Development Plan referred to in the notice for purposes of such consultation and hearing and that a copy of the Plan Amendment shall be placed on file in the office of the City Clerk.
