NEW BUSINESS 1. Approval of request of Richard Hotchkiss to use city -owned property commonly known as 322 Fowler Street as a garden plot for the year 2012; and forward said request to the City Council agenda to set a date for public hearing —Submitted by Noel Anderson, Community Planning & Development Director. ADJOURNMENT Suzy Schares City Clerk Garden Plot Agreement — City of Waterloo Subject to the terms and conditions of this Garden Plot Agreement (the "Agreement") the City of Waterloo, Iowa, hereby grants permission to the person(s) identified below (the "Permittee") to use the following legally described City -owned property or right-of-way (the "Property") as a garden plot for the Year a1-, 0f -c• 1`& re. In consideration of the City's grant of permission to use the Property, Permittee hereby agrees to the following: 1. Permittee will maintain the Property free of weeds and other debris and, at the end of the growing season, will clean up the Property. Permittee will not use the Property for any purpose other than non-commercial gardening. No structures of any type are permitted on the Property. 2. Permittee agrees to indemnify, defend and hold harmless the City from and against any and all claims, demands, causes of action, damages, injuries, losses or liabilities whatsoever, including but not limited to attorneys' fees and expenses, whether to themselves or any other person, arising from or in connection with the acts or omissions of Permittee or any invitee of Permittee in any way relating to use of the Property. 3. Permittee agrees that City may terminate this Agreement and Permittee's rights hereunder at any time upon fourteen (14) days' advance written notice delivered to Permittee at its last -known address. Permittee agrees to waive and hereby does waive any and all demands or claims upon the City for damages to growing crops on the Property in the event of such termination. Permittee agrees that its use of the Property is undertaken at the sole risk of Permittee. 4. Permittee agrees that the permission granted herein is effective only for the year indicated above. This Agreement shall not automatically renew or be extended. 5. This Agreement is the entire agreement between the partiesand may not be modified except by a written instrument signed by both parties. The rights granted to Permittee hereunder are personal to Permittee and may not be assigned to any other person or entity without the prior written consent of City. This Agreement is binding on the parties and the respective heirs, personal representatives and assigns of each.
