RESOLUTION NO. 2016-084
RESOLUTION APPROVING A DEVELOPMENT AGREEMENT
WITH IOWA HEARTLAND HABITAT FOR HUMANITY TO
AUTHORIZE THE SALE AND CONVEYANCE OF A
PORTION OF CITY OWNED PROPERTY FOR $1 . 00
COMMONLY KNOWN AS 330 IRVING STREET, FOR THE
CONSTRUCTION OF 1 SINGLE-FAMILY HOME.
WHEREAS, the City of Waterloo, Iowa and Iowa Heartland
Habitat for Humanity have shall enter into a Development
Agreement dated February 1, 2016, to authorize the sale and
conveyance of a portion of City owned property for $1 . 00 commonly
known as 330 Irving Street, for the construction of 1 single-
family home, and
WHEREAS, the City of Waterloo, Iowa is the owner of real
property in the City of Waterloo, Iowa as described below, and
WHEREAS, a public hearing was held on February 1, 2016 at
5: 30 P.M. in the Council Chambers at City Hall for the City of
Waterloo, Iowa, on the proposal to sell and convey premises owned
by the City of Waterloo, Iowa, to Iowa Heartland Habitat for
Humanity, and
WHEREAS, it is the opinion of this Council that sale and
conveyance should be made as proposed.
NOW, THEREFORE, IT IS HEREBY RESOLVED BY _THE COUNCIL OF THE
CITY OF WATERLOO, IOWA, AS FOLLOWS:
1 . The d 'following'g escribed real property, as fully
described in the published notice in the Waterloo Courier on
January 25, 2016, is not presently needed and will not be needed
in the foreseeable future for municipal purposes and its
ownership is serving no municipal purpose, and
2 . That the offer of Iowa Heartland Habitat for
Humanity to purchase real property for the sum of $1 . 00, for real
property generally known as 330 Irving Street and legally
described as follows :
THE SOUTH 41 FEET OF LOT 11 IN ROBERT ROBINSON' S SUBDIVISION
OF THE EAST HALF OF THE WEST HALF OF LOTS 1 AND 2 OF HARDY
AND VIRDENS PLAT OF THE SOUTHEAST QUARTER OF SECTION 24,
TOWNSHIP 89 NORTH RANGE 13 WEST OF THE 5TH P.M. IN THE CITY
OF WATERLOO, IN BLACK HAWK COUNTY, IOWA;
3 . That the City of Waterloo, Iowa conveys said parcel of
real property to Iowa Heartland Habitat for Humanity by deed.
4 . That the Mayor and City Clerk are hereby authorized to
execute said deed.
5 . That the original of said deed fully executed and
acknowledged is hereby approved and confirmed by the Council.
6. That the City Attorney is authorized and directed to
deliver said deed of conveyance to Iowa Heartland Habitat for
Humanity upon receipt in the sum of $1 . 00 .
