BE IT ORDAINED by the City Council of the City of Waterloo, Iowa: Section 1 - That Section 5-A, Inspection Fees, as amended, of Ordinance No. 2446, known as the Milk Ordinance is hereby repealed. Section 2 - That the following new Section 5-A, Inspection Fees, of Ordinance No. 2446, known as the Milk Ordinance is hereby enacted in lieu thereof as follows: (1) Each milk producer inspected by the health officer or milk inspection department of the City of Waterloo, Iowa, shall pay to the City of Waterloo, Iowa, an inspection fee of six dollars ($6.00) per dairy farm producer per month. (2) Each milk distributor or milk plant inspected by the Waterloo Health Department selling, distributing or marketing milk or milk products either at retail or wholesale shall pay to the City of Waterloo, Iowa, an inspection fee of two cents ($,02) per one hundred pounds (100 lbs.) of fluid milk/or milk products which are sold, delivered, distributed or marketed as processed or pasteurized milk products within the city limits. A fee of one-half cent ($.005) per one hundred pounds (100 lbs.) shall be paid for milk sold outside the city limits. Processing plants not under inspection of the Waterloo Health Department shall pay two cents ($.02) per one hundred pounds (100 lbs.) for milk sold in city limits. This paragraph shall not apply to milk that is merely stored by said milk distributor or milk plant, and is not processed or marketed as processed or pasteurized milk or milk products. (3) Each person performing any or all of the operations of both a milk producer and a milk distributor or milk plant under the supervision of the Waterloo Milk Sanitation Department shall pay to the City of Waterloo, Iowa, an inspection fee of three and one-half cents ($.035) for each one hundred pounds (100 lbs.) of fluid milk produced and distributed or processed by such person in the milk plant of such person which is sold, delivered, distributed or marketed as processed or pasteurized milk or milk products. Inspection fee imposed under this paragraph shall be in lieu of other inspection fees imposed by this section only with respect to fluid milk produced and distributed or processed by one owner. (4) Fees required by this section shall be paid to the Treasurer of the City of Waterloo, Iowa, not later than fifteen (15) days after the end of the month for which they are due. Each payment shall be accompanied by a report in form approved by the milk inspection department of the City of Waterloo, Iowa, signed by the milk producer, milk distributor, or milk plant operator, or a duly designated agent, certifying the amount of milk upon which the payment is due. (5) Milk distributors or milk plants receiving and processing milk producers not affiliated with a marketing agent authorized to collect, account for and pay to the City of Waterloo, Iowa, the producers inspection fees, shall themselves collect, account for and pay such producers inspection fees for the milk received from such producers. Milk distributors of milk plants receiving and processing milk from producers affiliated with a marketing agency which is authorized and does collect, account for and pay to the City of Waterloo, Iowa, the producers inspection fees for its members on milk received by such milk distributors and milk plants are exempted from the provisions of this paragraph requiring them to collect, account for and pay such producers inspection fees on milk received from producers thus affiliated.
