CREATED There is hereby created a City Plan and Program Commission for the City of Waterloo, Iowa as an administrative agency estab- lished under the provisions of Division IX, Chapter one thousand eighty-eight (1088), of the 1972 Code of Iowa. SEC. 2 . PURPOSE The purpose of this commission is to provide for the orderly growth and development of the community through the systematic develop- ment of a comprehensive plan and implementation program. SEC. 3 . COMPOSITION The City Plan and Program Commission shall consist of one (1) member each of the following boards and commissions of the City of Waterloo: Community Development Board, Park Com- mission, Low-Rent Housing Commission, Human Rights Com- mission, School Board; and two (2) members each of the Zoning Commission and the City Council; and six (6) members from the City at-Large. The board, commission and Council representa- tives shall be selected by their respective board, commission or Council as a whole. The six (6) commissioners from the City- at-Large shall be appointed by the Mayor subject to the approval of the Council. .31 TERM OF OFFICE The term of office of the members of the City Plan and Program Commission who are members of boards, commissions or City Council shall coincide with their term of office on said board, commission or Council. The members of the Plan and Program Commission from the City-at-Large shall serve a term of office of three (3) years except that two (2) of the members first named shall serve one (1) year; two (2) for two (2) years; and two (2) for three (3) years. .32 FILLING VACANCIES If any commissioner from among the City-at-Large representatives shall leave the City Plan and Program Commission through resigna- tion or otherwise, the Mayor shall appoint a successor subject to the approval of the Council. If any Plan and Program Commissioner who is a member of a board, commission or the City Council shall leave the commission, the members of his respective board, com- mission or Council shall appoint a successor. -2- .33 COMPENSATION All members of the commission shall serve without compensation except their actual expenses, which shall be subject to the approval of the Council. .34 ORGANIZATION The City Plan and Program Commission shall elect annually, at its first regular meeting, one of its City-at-Large Commissioners to act as chairman of the Commission, and another of its members as vice-chairman, who shall perform all the duties of the chair- man during his absence. .35 RULES AND REGULATIONS The commission shall adopt such rules and regulations governing its organization and procedure as may be deemed necessary. .36 COMMITTEES The commission shall establish any and all committees deemed necessary for the execution of its powers and duties. SEC. 4. POWERS AND DUTIES The City Plan and Program Commission shall have full power and authority to make or cause to be made such surveys, studies, maps, plans or charts of the whole or any portion of such munici- pality, and of any land outside thereof, which in the opinion of such commission bears relation to a comprehensive plan and program for development of the city, and shall submit these studies to the Council. The Commission may publish its studies and recommendations. .41 PLAN--ADOPTION--CONDITIONS For the purpose of making a comprehensive plan and program for the physical development of the municipality, the City Plan and Program Commission shall make careful and comprehensive studies of present conditions and future growth of the munici- pality with due regard to its relation to neighboring territory. The plan shall be made with the general purpose of guiding and accomplishing a coordinated, adjusted, and harmonious develop- ment of the municipality and its environs which will, in accord- ance with present and future needs, best promote health, safety, order, convenience, prosperity and general welfare, as well as efficiency and economy in process of development. Any and all plans and programs for the physical development of the munici- pality existing prior to the effective date of this ordinance shall remain effective until revised or incorporated by a plan adopted according to Sec. 4 of this ordinance . .42 Before adopting said comprehensive plan, or any part of it, or any substantial amendment therof, the Commission shall hold at least one (1) public hearing thereon, notice of the time and place of which shall be given by one (1) publication in a news- paper of general circulation in the municipality, not less than -3- ten (10) nor more than twenty (20) days before the date of hearing. The adoption of the plan or part or amendment thereof shall be by resolution of the commission carried by the affirmative vote of not less than two-thirds (2/3) of the members of the commission. After adoption of said plan by the commission, an attested copy thereof shall be certified to the council of said municipality and the Council may approve the same, and men said plan or any modification or amendment thereof shall receive the approval of the Council, said plan until subsequently modified or amended as authorized by this subsection and subsections .41 and .43 shall constitute the official city plan of said municipality. .43 AMENDMENT OF PLAN When said comprehensive plan has been adopted as above pro- vided for, no substantial amendment or modification thereof shall be made without such proposed change being first referred to the City Plan and Program Commission for its recommendation. If the City Plan and Program Commission disapproves the proposed change, it may be adopted by the City Council only by the affirmative vote of at least two-thirds (2/3) of all the membership of such council. .44 RECOMMENDATIONS FOR IMPROVEMENTS No plan for any street, park, parkway, boulevard, traffic-way, riverfront, public building, bridge, viaduct, levee, sewer, or other public structure or public improvement affecting the city plan shall be approved by the municipality for the erection or location thereof until and unless the general design and specific location proposed for such structure or improvement shall have first been submitted to the City Plan and Program Commission and said commission shall have had thirty (30) days within which to file its recommendations thereon. .45 EXCEPTIONS Such requirement for recommendations shall not act as a stay upon action for any such improvement where such commission after thirty (30) days written notice requesting such recommenda- tions shall have failed to file same. .46 APPROVAL OF PLATS All plans, plats, or replats of subdivisions or re-subdivisions of land embraced in said municipality or adjacent thereto, laid out in lots or plats with the streets, alleys, or other portions of the same intended to be dedicated to the public in such muni- cipality and all proposals for the vacation of a street, alley or public ground shall first be submitted to the City Plan and Program Commission and its recommendation obtained before approval of the City Council. SEC. 5. APPROPRIATION OF FUNDS The Council may annually appropriate a sum of money from the general funds for the payment of the expense of such commission. .51 EXPENDITURE OF FUNDS The commission shall have full, complete and exclusive authority to expend for and on behalf of such municipality all sums of money so appropriated. -4- .52 GRANTS. GIFTS AND DONATIONS All grants, gifts, donations or payments whatsoever which are received by such municipality for City Plan and Program purposes shall be placed in the City Plan and Program Commission fund, to be used by said commission in the manner and for the purposes designated by this ordinance. .53 DEBT-CONTRACTING POWERS The commission shall have no power to contract debts beyond the amount of its income for the current year. SEC. 6. TECHNICAL ASSISTANCE Technical assistance for the Plan and Program Commission shall be provided through the establishment of a Pian and Program Technical Committee. .61 COMPOSITION The Technical Committee shall be composed of, but not limited to the following: City Engineer, Finance Director, Parks Director, Housing Commission Director, Human Rights Commission Director, Community Development Director, Plan and Program Director, Zoning Director, and the Building Official. Department heads and board or commission directors whose agencies have a signi- ficant impact upon community development planning and programming may serve on the committee in a non-voting status. .62 POWERS AND DUTIES The committee shall have the authority to review, analyze and make recommendations of a technical nature on items which are brought before the Plan and Program Commission. .63 RULES AND REGULATIONS The Technical Committee shall adopt such rules and regulations governing its organization and procedures as may be deemed necessary subject to the approval of the commission. SEC. 7, STAFF AND PROFESSIONAL CONSULTANTS Subject to the limitations contained in this ordinance as to the expenditure of funds, the Commission may appoint such staff as it may deem necessary and prescribe and define their respective duties and fix and regulate the compensation to be paid to the persons employed by it. The commission may contract with professional consultants or county, regional, state and federal governments for local planning assistance, and may agree with each or all of them as to the amount, if any, to be paid for such planning assistance. SEC. 8. ANNUAL REPORT The Commission each year shall make a report to the Mayor and Council of its proceedings with a full statement of its receipts, disbursements and the progress of its work for the preceding fiscal year. V 4, �S SEC. 9. SEVERABILITY vv In the event that a section or subsection of this ordinance is declared unconstitutional or invalid, all other sections and subsections shall remain applicable. SEC. 10. REPEALER All ordinances and amendments or parts thereof which are in conflict with any section of this ordinance are hereby repealed. Passed, Adopted and Approved this rlL day of 19 .
