ORDINANCE NO. �
AN ORDINANCE REGULATING THE DESIGN, CONSTRUCTION, OPERATION AND
MAINTENANCE OF PUBLIC SWIMMING POOLS INCLUDING ALL NECESSARY
APPURTENANCES.
BE IT ORDAINED BY THE City Council of the City of Waterloo, Iowa, as follows:
Chapter
Swimming Pools
Section 1. TITLE
This ordinance shall be known as the "Public Swimming Pool Ordinance," and may be so
cited and will be referred to as this Ordinance.
Section 2. SCOPE
The provisions of this ordinance shall apply to all public swimming pools as hereinafter
defined including all facilities incident thereto. The purpose of the Ordinance shall be
to provide a guide for the design, construction, operation, and maintenance of such pools
so that health and safety hazards will be minimized.
Section 3. DEFINITIONS
The following definitions shall apply:
a. Swimming Pool - Any artificial basin of water which has been modified,
improved, constructed or installed for the purpose of public swimming and includes pools
for community use, pools at apartments, clubs, camps, schools, institutions, park and
recreation areas, motels, hotels and other commercial establishments. This Ordinance
does not apply to pools at private residences intended only for the use of the owner or
his guests.
b. Person - any person, firm, partnership, association, corporation, company,
governmental agency, club, or organization of any kind.
c. Health Department - the Department of Health and Sanitation or its authorized
representatives acting under and pursuant to order and/or authority of said Department.
Section 4. SUBMISSION OF PLANS AND SPECIFICATIONS
a. No person shall begin construction of a public swimming pool or shall
substantially alter or reconstruct any public swimming pool without first having submitted
plans and specifications to the Health Department for review and approval. The Health
Department shall arrange for the review and approval of the plans and specifications by
other appropriate departments concerned with such matters as zoning, electrical, structural,
and plumbing requirements. No permit to construct, alter, or renovate shall be issued
by the Health Department until approval is granted by the other departments involved.
b. The application for permit to construct or remodel a public swimming pool
shall be on such forms as may be prescribed by the Health Department, together with any
supporting data as may be required for the proper review of the plans.
C. The pool and facilities shall be built in accordance with the plans as
approved unless approval of changes has been given in writing by the Health Officer. The
owner or his agent shall notify the Health Officer at specific predetermined stages of
construction and at the time of completion of the pool to permit adequate inspection of the
pool and related equipment during and after construction. The pool shall not be placed in
operation until such inspections show compliance with the requirements of this Ordinance.
Section 5. DESIGN, CONSTRUCTION, AND OPERATION FEATURES
Reasonable regulations shall be promulgated by the Health Department covering design,
construction, and operation of public swimming pools. No permit to construct, alter,
remodel, or license to operate shall be granted unless the pool conforms with these
Regulations. The Regulations shall cover but not be limited to the following items:
a. Water supply, sewer and waste connections
b. Design detail
c. Materials of construction
d. Walls, markings, and slopes
e. Overflow gutters, and skimmers
f. Inlets and outlets
g. Separation, zoning, and control of users
h. Recirculation equipment, piping, and appurtenances
i. Disinfection and chemical feed equipment
j . Bathhouse, and appurtenances including plumbing fixtures
k. Ladders, stairs, decks and walkways, diving equipment

Section 6. PERMITS TO OPERATE
a. No person as defined in Section 3 (b) shall operate or maintain a public
swimming pool unless he has obtained a permit to operate such pool from the Health
Department. Such permits shall be obtained by June 15 and shall be valid for one year
unless otherwise revoked for cause. Only persons who comply with this Ordinance shall be
entitled to receive and retain such a permit. Such permits are not transferrable.
b. The Health Department is authorized to promulgate Regulations and establish
fees to cover inspections and other services in connection with the operation and maintenance
of public swimming pools for the protection and promotion of public health and safety.
The Health Department shall perform inspections at reasonable hours to insure compliance.
Section 7. REVOCATION OF PERMITS
a. The Health Department may revoke any permit for failure to comply with the
duly promulgated Regulations referred to in this ordinance or in cases where the permit
has been obtained through non-disclosure, misrepresentation, or misstatement of a material
fact.
b. Before a permit is revoked, the person to whom the permit has been issued
shall have notice in writing enumerating instances of failure to comply with the Regulations.
He shall be given an opportunity for appeal to the Health Department, and failing, may
appeal to the Board of Health of the City of waterloo, regarding the reasonableness of the
revocation of permit.
C. The permit shall be reissued upon proper application and upon presentation
of evidence that the deficiencies causing revocation have been corrected.
Section 8. HEALTH AND SAFETY
a. No person infected with or having a communicable disease shall be employed at
a public swimming pool. All patrons known to be, or suspected by the health officer or the
management of being afflicted with an infectious disease, suffering from a cough, cold or
sores, or wearing bands or bandages shall be excluded from all public bathing places, except
on presentation of a written statement of current date as approved by the health officer.
b. No swimming pool owner shall permit the use of a swimming pool as defined
herein by any animal, fish, or fowl.
c. Appropriate facilities shall be provided for the safety of bathers as may be
required by the Health Department. This shall include lifesaving equipment, safety devices,
lifebuoys, lifehooks, first-aid kits, telephone, with adequate staff during swimming periods
who are competent in lifesaving and artificial resuscitation. Competent lifeguards shall
be on duty during all swimming periods when so ordered by the Health Officer or when a use
fee is charged.
d. Every swimming pool shall be under the supervision of a capable individual
who shall assume the responsibility for compliance with all parts of this Ordinance relating
to pool operation and maintenance, and safety of bathers.
e. When the swimming pool is not open for use, access to the pool shall be
prevented.
f. Instruction regarding emergency calls shall be prominently posted.
g. Not more than the maximum design bather load shall be permitted in the
swimming pool at any one time.

Section 9. INSPECTION.
The Health Department is authorized to conduct such inspections as it deems necessary to in-
sure compliance with all provisions of this Ordinance and shall have right of entry at any
reasonable hour to the swimming pool for this purpose.
Section 10. DISINFECTION AND QUALITY OF WATER
a. Swimming pools when in use shall be continuously disinfected by a chemical
which imparts an easily measured, free available residual effect. When chlorine is used,
a free chlorine residual of at least 0.4 ppm shall be maintained throughout the pool whenever
it is open or in use. If other halogens are used, residuals of equivalent disinfecting
strength shall be maintained. A testing kit for measuring the concentration of the
disinfectant, accurate within 0.1 ppm shall be provided at each swimming pool.
b. The Health Officer may accept other disinfecting materials or methods when
they have been adequately demonstrated to provide a satisfactory residual effect which is
easily measured and to otherwise be equally as effective under conditions of use as the
chlorine concentration required herein, and not be dangerous to public health, create
objectionable physiological effects, or impart toxic properties to the water.
C. The swimming pool water shall be maintained in an alkaline condition as
indicated by a pH of not less than 7.2 and not over 8.2. A pH testing kit accurate to the
nearest 0.2 pH unit shall be provided at each swimming pool. The alkalinity of the water
shall be at least 50 ppm, as measured by the methylorange test.
d. The water shall have sufficient clarity at all times so that a black disc,
six inches in diameter, is readily visible when placed on a white field at the deepest point
of the swimming pool. Failure to meet this requirement shall constitute grounds for
immediate closing of the pool.
e. Bacteriological quality of water in the pool shall not (i) contain more than
200 bacteria per milliliter, as determined by the standard (350 C) agar plate count, or
(ii) show positive test (confirmed test) for coliform organisms in any of the five
10-milliliter portions of a sample or more than 1.0 coliform organisms per 50m1, when the
membrane filter test is used. All samples shall be collected, dechlorinated, and examined
in accordance with the procedures outlined in the latest edition of Standard Methods for
the Examination of Water and Wastewater (APHA) . The Health Department shall arrange for
the collection and examination of samples on a routine basis when the swimming pool is in
active use.
f. Chemicals used in controlling the quality of water shall be demonstrated as
imparting no toxic properties to the water; Such chemicals as may be used for algae
control shall be approved for use by the Health Department.
Section 11. CLEANLINESS OF POOL.
Floating scum, sputum and debris shall not be allowed to accumulate in the pool: skimmers,
where provided, and water levels shall be maintained and operated to continuously remove
such material. The bottom and sides of the pool shall be cleaned as often as necessary
to keep in a clean condition. The sides and bottom of pools, decks, and other surfaces
shall be kept free of slime, and algae to prevent unnecessary sliperiness and danger of
accidents or drownings. All pools shall be provided with adequate filtration equipment.
Section 12. CLEANING AND MAINTENANCE.
All parts of the pool shall be maintained in good repair. Floors shall be kept
free from cracks and other defects. Walls, ceilings, and equipment shall be painted as
often as necessary to be kept in good conditions.
Hoses shall be maintained for regular flushing and cleaning. The whole pool area
shall be kept clean, sanitary, free of litter and vermin.
Toilets, urinals, showers, wash basins, and other plumbing fixtures shall be
maintained in a clean condition, and in good repair. Toilet paper shall be provided in the
toilet rooms.
Section 13. DECKS.
Decks shall be installed of cement or other impervious materials, which are rough and
nonskid, and sloping away from the pool to proper drains at no more than one-fourth to
three-eighths inch per foot. All areas within the pool enclosure shall be of this type
material.

Section 14. FEES FOR PERMIT
The fee for a permit to operate and maintain a public swimming pool shall be $25.00
per year, plus a fee of $5.00 for each off premises water sample testing performed by
the City of Waterloo Laboratory.
Section 15. SEVERABILITY OF SECTIONS.
Should any section, paragraph, sentence, clause, or phrase of this ordinance be declared
unconstitutional or invalid for any reason the remainder of said ordinance shall not be
affected thereby.
Section 16. EFFECTIVE DATE OF ORDINANCE.
This ordinance shall be in full force and effect upon its adoption and publication as
provided by law, and, at that time, all ordinances and parts of ordinances in conflict
with this ordinance are hereby repealed.
Section 17. FINE AND INJUNCTIVE RELIEF FOR VIOLATIONS.
Any person who shall violate any of the provisions of this ordinance shall be guilty of
a misdemeanor and, upon conviction thereof, shall be punished by a fine of not more than
$100.00 or not more than 30 days in jail. In addition thereto, such persons may be
enjoined from continuing such violations. Each day upon which such a violation occurs
shall constitute a separate violation.
