RESOLUTION SETTING DATE OF HEARING AS MARCH 7, 2016 TO
APPROVE AN AMENDMENT TO THE RATH URBAN RENEWAL AND
REDEVELOPMENT PLAN AND SETTING A CONSULTATION WITH
TAXING ENTITIES ON FEBRUARY 18, 2016, AND INSTRUCT CITY
CLERK TO PUBLISH NOTICE.
WHEREAS, this Council previously has found and determined that certain areas located
within the City are eligible and should be designated as an urban renewal area under Iowa law,
and has approved and adopted the Rath Urban Renewal and Redevelopment Plan (the "Plan") for
the Rath Urban Renewal and Redevelopment Area (the "Urban Renewal Area") described
therein, which Plan is on file in the office of the City Clerk; and
WHEREAS, City staff has caused there to be prepared a form of Amendment to the Plan
(the "Plan Amendment"), a copy of which has been placed on file for public inspection in the
office of the City Clerk and which is incorporated herein by reference, the purpose of which is to
amend and otherwise update the Plan through the approval of the Plan Amendment in order to
reflect current City objectives and to describe current and anticipated project activities and City
actions that may be undertaken in the Urban Renewal Area; and
WHEREAS, the Iowa statutes require the City Council to notify all affected taxing
entities of the consideration being given to the Plan and to hold a consultation with such taxing
entities with respect thereto, and further provides that the designated representative of each
affected taxing entity may attend the consultation and make written recommendations for
modifications to the proposed division of revenue included as a part thereof, to which the City
shall submit written responses as provided in Section 403.5, as amended; and
WHEREAS, the Iowa statutes further require the City Council to hold a public hearing on
the Plan subsequent to notice thereof by publication in a newspaper having general circulation
within the City, which notice shall describe the time, date, place and purpose of the hearing, shall
generally identify the urban renewal area covered by the Plan and shall outline the general scope
of the urban renewal project activities under consideration, with a copy of the notice also being
mailed to each affected taxing entity.
NOW THEREFORE; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WATERLOO, IOWA:
Section 1. That the consultation on the Plan Amendment required by Section 403.5(2) of
the Code of Iowa, as amended, shall be held on the 18th day of February, 2016, in the Council
Chambers, City Hall, 715 Mulberry Street, Waterloo, Iowa, at two o'clock p.m., and the
Community Planning and Development Director and the City Planner are hereby appointed to
serve as the designated representative and the alternate designated representative, respectively, of
the City, for purposes of conducting the consultation, receiving any recommendations that may
be made with respect thereto, and responding to the same in accordance with Section 403.5(2).
Section 2. That the City Clerk is authorized and directed to cause a notice of such
consultation to be sent by regular mail to all affected taxing entities, as defined in Section
403.17(1), along with a copy of the Plan, the notice to be in substantially the following form:

Pursuant to Iowa Code Chapter 403.5, please find enclosed a copy of the Rath Urban
Renewal and Redevelopment Plan Amendment. A consultation to discuss this proposal
will be held on February 18, 2016 in the Mollenhoff Conference Room located on the
second floor of City Hall, 715 Mulberry Street, and will commence at 10:00 a.m. This
plan was previously approved by the City of Waterloo, however we are updating wording
to the plan, including,project details and project budget.

Section 3. That a public hearing shall be held on the Plan before the City Council at its
meeting which commences at 5:30 p.m. on March 7, 2016, in the Council Chambers, City Hall,
715 Mulberry Street, Waterloo, Iowa.
Section 4. That the City Clerk is authorized and directed to publish notice of this public
hearing in the Waterloo Courier, once on a date not less than four (4) nor more than twenty (20)
days before the date of the public hearing, and to mail a copy of the notice by ordinary mail to
each affected taxing entity, such notice in each case to be in substantially the following form:
IMPORTANT NOTICE—PUBLIC HEARING MONDAY, MARCH 7, 2016 AT 5:30
P.M., CITY COUNCIL CHAMBERS, CITY HALL, WATERLOO,IOWA.
THE PURPOSE OF THE PUBLIC HEARING IS TO DISCUSS AND MAKE ANY
NECESSARY AMENDMENTS TO THE RATH URBAN RENEWAL AND
REDEVELOPMENT PLAN, TO INCLUDE ADDITIONAL PROJECTS AND UPDATE
RELATED FINANCIAL INFORMATION.
The Rath Urban Renewal and Redevelopment Plan area is an area of slum and blight and
an economic development area within the meaning of Iowa Code Section 403.17(10).
Such area is appropriate for commercial and industrial enterprises and is eligible for an
urban renewal project and otherwise meets all requisites under the provisions of Iowa
Code Chapter 403. The rehabilitation, conservation, development, redevelopment, or a
combination of such activities, of such area is necessary in the interest of the public
health, safety or welfare of the residents of the City of Waterloo.
The area included within the Rath Urban Renewal and Redevelopment Plan, initially
adopted November 19, 1990 by Resolution No. 1990-644 and amended on June 14, 2004
by Resolution No. 2004-372 and on July 6, 2009 by Resolution No. 2009-633, is as
follows, and the proposed amendment does not alter the area included within said plan:
Beginning at the point of intersection of the centerline of East Eleventh street and the
Northerly bank of the`Cedar River,thence Northeasterly along the centerline of East
Eleventh Street to its intersection with the centerline of Franklin Street, thence
Southeasterly and Easterly along the centerline of Franklin Street to it`s intersection
with the centerline of Vinton Street,thence, Southerly along the centerline of Vinton
street to its intersection with,the centerline of Sycamore Street,thence Southeasterly
along the centerline of Sycamore Street to its intersection with the centerline of
Dunham Place,thence Southerly along the centerline of Dunham Place and an
extension of the centerline of Dunham Place to its intersection with the Cedar River,
thence Northwesterly along the Northerly bank of the Cedar River to the point of
beginning, all in the City of Waterloo, Black Hawk County, Iowa(the "Original
Area").
And
Beginning at the intersection of the centerline of Nevada Street and Lafayette Street,
thence Southeasterly along the centerline of Lafayette Street to the centerline of

Glendale Street, thence South along the centerline of Glendale Street and an extension
thereof, to the point where said extension would intersect the extension Easterly of the
centerline of Hawthorne Avenue,thence West along the extension of the centerline of
Hawthorne Avenue and the centerline of Hawthorne Avenue to the centerline of
northbound Washington Street,thence Northwesterly along the centerline of
northbound Washington Street to the centerline of West 12th Street, thence
Northeasterly along the centerline of West"12th Street and its extension Northeasterly
to the Southerly line of the Cedar River, thence Northwesterly along the Cedar River
to centerline of West 1 lth Street,thence Northeasterly across Cedar River along the
centerline of the 1 lth Street bridge and continuing Northeasterly along the centerline
of East 1 lth Street to the centerline of Sycamore Street,thence Northwesterly along
the centerline of Sycamore Street to the centerline of East 7th Street, thence
Northeasterly along the centerline of East 7th Street'to the centerline of Franklin
Street, thence Northwesterly along the centerline of Franklin Street to the centerline
of Westbound Martin Luther King Jr. Drive,thence Northeasterly following said
Westbound centerline to the centerline of South Barclay Street, thence South along
the centerline of South Barclay Street to the centerline of Martin Luther King Jr.
Drive, thence Northeasterly along the centerline of Martin Luther King Jr. Drive to
the centerline of Linden Avenue, thence South along the centerline of Linden Avenue
to the centerline of the Canadian National Illinois Central Railroad,thence following-
said railroad centerline to the centerline of Nevada Street, thence South along the
centerline of Nevada Street to the point of beginning, except the Original Area.
And
That part of Sections 29, 30, 31 and 32 in Township 89 North, Range 12 West of the
5th Principal Meridian in the City of Waterloo, Black Hawk County, Iowa, more
particularly described as follows: Commencing at the intersection of the centerline of
Lafayette Street and the centerline of Glendale Street; thence South along the
centerline of Glendale Street to its intersection with the centerline of the existing spur
line of the Canadian National Railroad, said point also being the Point of Beginning;
thence continuing South along the platted, now vacated centerline of Glendale Street
to the point of intersection with the Northeasterly line of the Cedar River;thence
Southeasterly following the Northeasterly line of the Cedar River to its intersection
with the East line of the City of Waterloo Corporate Limits (as now established in
Section 32, Township 89 North, Range 12 West); thence North following said
Corporate Limit line to the Southerly line of Dubuque Road;thence Northwesterly
following the Southerly line of Dubuque Road to its intersection with the East line of
Block 8 of Blowers Addition;thence South along the East line of said Block 8 to the
most Southerly corner of Lot 19 Block 8 said addition; thence South to the most
Northeasterly corner of Lot 9 Block 17 Blowers Addition; thence South along the
East line of said Block 17, and an extension thereof to the Southerly line of Lafayette
Street; thence Northwesterly along the Southerly line of Lafayette Street to the
Southeasterly line of Block 2 Kahler's Addition; thence Southwesterly along the
Southeasterly line of Block 2 Kahler's Addition to the centerline of the existing spur
line of the Canadian National Railroad; thence Northwesterly along said railroad line
to the Point of Beginning.
The public hearing will be held at 5:30 p.m. on Monday, March 7, 2016, in the City
Council Chambers at City Hall in Waterloo, Iowa. Any questions regarding the proposed
amendment to the Rath Urban Renewal and Redevelopment Plan should be directed to
the Planning and Zoning Officeat 291-4366. Anyone who is interested may appear at
same time and place and be heard or may file written objections or comments with the
City Clerk, City Hall, 715 Mulberry Street, Waterloo, Iowa,before the date set for said
hearing.

Section 5. That the Plan Amendment for the Urban Renewal Area described therein is
hereby officially declared to be the proposed Plan Amendment for the Rath Urban Renewal and

Redevelopment Plan referred to in the notice for purposes of such consultation and hearing and
that a copy of the Plan Amendment shall be placed on file in the office of the City Clerk.
